Clarice Pearman - Ordinances Page _1
From: Jeremy Pate
To: Conklin, Tim; Housley, Judy; Monreal, Cindy; Smith, Sondra; Williams, Kit
Date: 1/18/06 10:51 AM
Subject: Ordinances
Judy, please find the attached ordinances you requested from last night's City Council approvals. In future
agenda requests to the City Clerk's office (beginning this week), Planning staff will be emailing you the
draft ordinances on the day that we submit an item to the City Clerk's office. We hope that this will
eliminate the step of you trying to get the information you need from us after City Council approval. Per
Kit's instructions, we will no longer amend any ordinances passed by the City Council, only the
amendments that affect specific conditions of approval in our staff report, which we will then forward on to
you. Additionally, it is my understanding that we will only draft ordinances for ANX, RZN and PZD items
(including appeals), but we will no longer draft resolutions or ordinances pertaining to ADM items. Please
let me know if there is anything more we can do to help.
RZN 06-1887 Cato Springs Rd (Hoggatt) - this ordinance was amended by CC to rezone to RT-12
(Planning did not amend the ordinance that is attached)
RZN 05-1833 Bellafont - no amendments (a bill of assurance should be attached to this rezoning, though)
MDP R-PZD 05-1796 Park West - no amendments
MDP R-PZD 05-1816 Skate Place - amendments to the conditions of approval (not the ordinance), which
we have made and attached, as requested by Kit last night
ADM 06-1899 Gypsum Rd Realignment - no amendments
ADM 05-1657 Mt Sequoyah South - Leif is working on the amendments to the maps/exhibits as requested
by Kit last night and we will forward those once GIS and Leif can get finished. The ordinance is attached,
but must also be amended per last night's approval.
Thanks,
Jeremy

We are concerned not only from an environmental standpoint, but also about possible damage to
our property. We have wetlands on our property, just north of the property line. If Park West is
developed right up to our property line, with all the infrastructure, foundations, buildings, and
streets that could affect the natural flow of water from north to south, those improvements could
adversely affect our property. We think it would be appropriate to ask for more time to allow a
geologist or an engineer that specializes in wetlands, or whomever the professional would be that
could provide a study on the effects development would have, to take a close look at our land,
the Park West land, and what adverse
.effects
wwe7 might get as a result of development.
