A. CONSENT AGENDA 1 . APPROVAL OF THE MINUTES: Approval of the February 15, 2000 City Council minutes. 2. MANHOLE REHABILITATION: A resolution approving a construction contract with Kim Construction, Inc. for sanitary sewer manhole rehabilitation, Illinois Basin 6-9 and 16, and White River Minisystem 9A, in the amount of $937,705, and approve a 5% contingency of $46,885. 3. AIRPORT CIP PROJECTS: A resolution approving a contract with McClelland Consulting Engineers, Inc. for engineering services for the Capital Improvement Program projects at the Airport for the term of one year extendable by contract amendment not to exceed three years. 4. AIRPORT CAPITAL IMPROVEMENT: A resolution approving Task Order # 1 to the contract with McClelland Consulting Engineers, Inc. for engineering services for the CIP projects at the Airport. The amount of the Task Order # 1 is not-to-exceed $71 ,283 .00 and will cover the scope of the design and oversight of the construction of the access drive on the east side of the airport. 5. PARK'S BUDGET ADJUSTMENT: A resolution approving a budget adjustment in the amount of $ 106, 121 to realign the Park's Divisions expenditures. 6. QUESTEC CORPORATION: An ordinance awarding a contract to QuesTec Corporation for preparation of a business plan, waiving competitive bidding, and appropriating up to $200,000 for preparation of a business plan. 2. PUBLIC FACILITIES BOARD: An ordinance to expand the role of the Public Facilities Board to include recreational facilities and multi-family housing as provided by State Law. C. NEW BUSINESS 1. WATER/SEWER EASEMENT: An ordinance vacating a 50 ft. wide water easement, filed in Washington County in 1973 (Book 856 at Page 720). Sewer line is not located within easement area and new easements have been acquired for the proper location of the lines. 2. 6th STREET IMPROVEMENT: An ordinance authorizing the City Attorney to seek court ordered possession of land, permanent drainage easement area and temporary construction easement area from part of Lots 5 and 6, Block 10, Ferguson' s Addition, being a part of property owned by Estate of Lonnie and Hazel Shook for the extension of 6`h Street and Hwy 7 1 B intersection improvement. 3. SENIOR COMMUNITY CENTER: Presentation and discussion on the construction of the Senior Center. 4, CHILDREN'S HOUSE/SAGE HOUSE: Discussion on a potential land lease for the construction of Children's House. 5, BOTANICAL GARDEN: An ordinance approving an agreement for professional services with Portoco Group for the feasibility study of the Botanical Garden Society of the Ozarks, Inc. as part of the matching grant program award from the Arkansas Department of Parks and Tourism. The contract amount is $21 ,895.40. A bid waiver is requested. Approval of a budget adjustment recognizing the grant funding and city match is also requested. The request is to rezone the property to R-2, Medium Density Residential. 7, RZ 00-2: An ordinance approving rezoning request RZ 00-2 submitted by Bill Keating of Keating Enterprises Inc. for property located at Lots 1 and 2 Sunbridge East. To: Fayetteville City Council Re: Appeal of Planning Commission Action of February 14, 2000. Property owner: Lake Hills Church 444-7797 Contact Person: Dr. Jon H Allen, Pastor 634-3434 1 . We were offered a 3 .5 acre parcel of property before it was on the open market. We were concerned about building on the property which was only 180' wide, so.we approached Alette Little. She looked at our plans and said, "I don't see a problem. " Based on her "unofficial" review, we purchased the property. 3 . We secured the services of the Benham Group for design, engineering, and architectural work. 4. Before we could submit plans to the planning department, Alette Little left for another position. We worked with the new planning staff, and on April 26, 1999, submitted our plans to the Planning Commission for a rezoning to R-0 and a conditional use permit to build a church facility based on that R-0. Our request met all the required findings and, like Alette Little before, the planning staff recommended approval of our plans. a. We requested R-0 because we wanted to make multiple use of the parcel by including three rental offices in a wing of our church building. We had master planned the maximum size for a building that could fit on this property and still have adequate space for parking, driveways, green space, etc. However, such a building would be larger than our current needs. By including offices we would be able to receive rental income until our congregation grew to the point that we needed to use the office space for our own needs. All this had been explained to Alette Little and the subsequent planning staff in the above mentioned conversations. b. This property is joined on the north side by the Williams Center which is zoned R- 1 . A church facility would serve as an appropriate buffer between the Williams Center ao,! the property to the south which, according to the owner, will be developed in the future. 5. The minutes of the April 26, 1999, Planning Commission meeting will indicate that they spent considerable time reviewing our request and considering options including rezoning only the front half of the property. Finally, assuming a negative vote, they recommended Viat we withdraw our request to avoid a year wait for another rezoning request and that we work Nvith planning staff and return with a rezoning request that would be appropriate for the church plans. 6. At that April 26 meeting, the Planning Commission granted us a conditional use permit to build on the present A- 1 zoning if we so chose. That conditional use permit was inadequate since our original design called for a 10,400 square foot building based on the ten foot setbacks of the requested R- 1 zoning. The present zoning A- 1 requires 20 foot setbacks. The property is 180' wide. Denial of the rezoning request had the effect of reducing the north-south footprint of our building by approximatcly 20%. Thus, we would have had to increase the size of the building by approximately 20% on its east-west axis. This is an impossible size to build unless the side of the hill is excavated, much like the Williams Center. This would leave a huge "ugly" scar. on the hill and the removal of much of the natural habitat including many very large, very old trees. Or, the building could be relocated on top of the hill, a flatter area, making it further from Crossover and requiring removal of much of the woodland habitat. 7. We spent considerable time and money on more engineering and architectural studies, including aerial photography, and in cooperation with the planning staff, we submitted a new request for the parcel to be rezoned P- 1 . Our request meta the required findings and the planning staff recommended approval of the rezoning request. Benefit: Rezoning to P- 1 (with ten foot setbacks) would allow us to build close to Crossover rather than on top of the hill, and we would not have to do the enormous excavations. Rezoning to P- 1 (with ten foot setbacks) would allow us preserve the natural beauty of much of the woodlands. 8. The Planning Commission denied our P- 1 request. They seemed concerned that they would lose control of the property by removing the present A-1 zoning. Despite the facts of the unique character of this parcel, and despite the fact that we had done, at considerable expense, what they had asked us to do (outlined in 5 above), they felt that since we already had received a conditional use permit, they denied our P- 1 request. 9. We are basing our appeal to the City Council on the basis of the above and that a. P- 1 is the appropriate zoning for a church according to the zoning code. (In fact, a quick review of the zoning map shows that most churches in Fayetteville are on P- 1 zoned property. Although some churches have been built on A- 1 with a conditional use permit, we could find'no occasion when a church was denied a P- 1 request and required to retain an A- 1 zoning.) b. A- 1 is designed to "protect" agricultural land until such time as "an ord.nrly transition to urban development has been accomplished." Since this parcel will not be used for agricultural purposes it does not need such protection. Should not A- 1 zoning be used to safe guard truly agricultural land rather than as a means to control nonagricultural usage? 10. We are aware that we are required to submit our plans as a Large Scale Development. This should satisfy anyone's concerns that the city will somehow lose control of the property. 11 . Two of the owners of adjourning land have expressed their concerns that if this property is rezoned P- 1 (or R- 1 ) we might suddenly decide to build a detention home, golf course, zoo, or some such thing. Of course, the large scale development review should preclude any of these concerns. Although we realize that we should not be required to do this, we will gladly make appropriate performance guarantees with the city that we will, in fact, use this property to build our church facility. 7 B.
