MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL
A special meeting of the Fayetteville City Council was held on
Tuesday, January 9, 1996, at 4:30 p.m., in room 326 of the City
Administration Building, 113 W. Mountain, Fayetteville, Arkansas.
PRESENT: Mayor Fred Hanna; Aldermen Woody Bassett, Steve Parker,
Len Schaper, Kit Williams, Heather Daniel, and Cyrus
Young (arrived late), City Clerk/Treasurer Traci Paul;
City Attorney Jerry Rose; members of the staff, press,
and audience.
ABSENT: Aldermen Jimmy Hill and Stephen Miller
CALL TO ORDER
Mayor Hanna called the meeting to order with five aldermen
present.
INCINERATOR SETTLEMENT BUDGET ADJUSTMENT
Mayor Hanna reminded the Council that the City Attorney was
authorized to enter into an agreement to settle the attorney's
fees and the return of the funds that were collected for the
incinerator.
Alderman Young arrived.
The Budget Adjustment was not submitted earlier because we did
not know if the judge would accept the settlement proposal. The
judge accepted the proposal and a budget adjustment must be
approved so that we can do what we agreed to do.
Mayor Hanna stated he was informed that refund checks were in the
process of being printed. Citizens should receive a refund of 50
cents on the dollar.
Administrative Services Director Ben Mayes stated this is just a
formality of recognizing what the Council approved as a
settlement agreement and what the judge ordered. The amount of
$1,956,000 needs to be transferred to the General Fund to make up
the difference for the money that was not available in the Solid
Waste Fund to come up to the total of $4.7 million to satisfy all
of the orders of the settlement.
In answer to a question from Alderman Bassett, Mayes stated the
refund checks are scheduled to be mailed on January 15, 1996.
Since January 15 is a Federal holiday, checks will be mailed on
January 16. The City has current addresses for the people
receiving 77% of the potential refund. The remaining 23% will
have to be filed as a claim. There are 21,640 checks to be
mailed.

Mayor Hanna stated there will be notices published in the.
newspapers to inform people of how to file fora refund. Claims
can be submitted until March 1, 1996.
In answer to a question from Alderman Schaper, Mayes stated the
money comes out of the General Fund, Unreserved Fund Balance.
Alderman Bassett stated the City has been preparing for the
possibility of this day for years.
Alderman Young, seconded by Alderman
approve the budget adjustment. .Upon
by a vote of 6 to 0.
