A special meeting of the Fayetteville City Council was held on
Tuesday, August 9, 1994, at 4:35 p.m. in the Room 326 of the City
Administration Building, 113 W. Mountain, Fayetteville, Arkansas.
PRESENT: Mayor Fred Hanna; Aldermen Len Edens, Fred Vorsanger,f
Heather Daniel, Stephen Miller, Kit Williams, Conrad
Odom, and Woody Bassett; City Attorney Jerry Rose; City
Clerk Traci Paul; City Treasurer Glyndon. Bunton;
Administrative Services Director Ben Mayes; Planning'
Director Alett Little; members of staff, press, and
audience.
ABSENT: Alderman Joe Box
CALL TO ORDER

Mayor Hanna called the meeting to order with seven aldermen
present.
PROPERTY EXEMPTION
Mayor Hanna stated the proposed ordinance had been redrafted by -
City Attorney Jerry Rose. The original ordinance, left on third
reading at the August 2 Council meeting, must be acted upon.
City Attorney Rose read the ordinance for the third time.
Upon roll call, the ordinance failed by a vote of 1 to 6, with
Miller, Williams, Odom, Bassett, Vorsanger and Edens voting nol'-.„
Rose reviewed the six sections of the redrafted ordinance.
Attached to the proposed ordinance were bills of assurance,
protective covenants and restrictive covenants applicable to the
properties requesting exemption.
Alderman Williams stated the owners of both CMN and Point West
Subdivisions have given the City rights to enforce the restrictive
covenants of their subdivisions. Neither North Point nor The
Steele Addition has offered such rights.
City Attorney Rose read --the ordinance for the :first; time. Edens,
seconded by Vorsanger, made a.motion to suspend..the.rules and place
the ordinance on its second'reading. Upon roll call,the motion
passed by a vote of.7 to 0. The City Attorney read the ordinance
for the second time. _Odom, seconded by Edens, made a motion to
further suspend the rules and place the ordinance on its third and
final reading. Upon roll call, the motion passed'by a vote of 7 to
0, and the City Attorney read the ordinance'for the third time.

Alderman Williams stated he was concerned that the owners of North
Point and Steele Addition - Tract 1 have, not given the City rights
to enforce.their.restrictive covenants.
George Faucette, owner of Tract 1 in the Steele Addition, stated he
was offering those rights in his proposed bill of assurance.
Danny Lewis,} representing North Point, stated he was in favor of
giving the City the right to enforce the restrictive covenants of
North Point.

Alderman Bassett stated he felt this ordinance was the right thing
to do. It is not a retreat from Overlay Ordinance or our
commitment to protect the environment and better manage our growth.
Mayor Hanna stated taking this step is in the best interest of all.

Alderman Miller stated he was concerned about the restrictions on
signs but felt the existing Sign Ordinance for Fayetteville should
be adequate.
Upon roll call, the ordinance passed by a vote. of 7 to 0.
