MINUTES OF A SPECIAL MEETING OF THE BOARD OF DIRECTORS
A special meeting of the Fayetteville City Board of Directors was held on
Wednesday, February 3, 1988 at 4:00 p.m. in Room 326 of City Hall, 113 West
Mountain Street, Fayetteville, Arkansas.
PRESENT.: Mayor Johnson.;. Directors Lancaster, Kelley, Marinoni, Hess
and Bumpass; City Manager Pennington, City Clerk McWethy;
members of the press and audience
The meeting was called to order with five Directors present. Director
Bumpass arrived at about 4:10 p.m. Director Martin was absent.
The meeting was called by the Mayor for the purpose of reconsidering the
wording of .Ordinance No. 3324, passed on February 2, calling a special
election on the question of constructing an incinerator.
The Mayor said that today she and city staff read the wording. of the
ordinance passed at the February 2nd Board meeting, and the part which was
added (about including the additional $3.88 million) did not make sense in
that it did not fit into the first sentence of the explanatory paragraph.
The Mayor said it was proposed to move that part to the end of the
paragraph She explained. that the $10.58 per month rate does include the
$3.88 million. Johnson pointed out that the $7.90 per month does not
include the $3.88 million. Hess said the way it was phrased at the February
2nd meeting implies that the $3.88 million was included in both sanitation
rates, which he commented was not accurate.
Kelley said that the $3.88 million had been approved by the Authority and'is
a given. He said to him the $3.88 million has the potential to create an
assumption that is not accurate. He suggested deleting the whole sentence.
Johnson said if that is deleted the wording would then not reflect that the
actual amount of the bonds is $25 million rather than $22 million.
Johnson suggested, and it was agreed, that the following sentence be added:
"This rate includes original bond payments and an additional $3.88 million
for project delays and additional environmental safeguards."
Kelley suggested, and it was agreed, to separate the second and third
sentences in the explanatory paragraph into subparagraphs
Pennington read the ordinance as amended for the first time. Director
Lancaster, seconded by Marinoni, made a motion to suspend the rules and
place the ordinance on its second reading. Upon roll call, the motion
passed, 6-0. The ordinance was read for the second time. Director
Lancaster, seconded by Marinoni, made a motion to further suspend the rules
and place the ordinance on its third and final reading. Upon roll call,
the motion passed, 6-0.

Director Hess left at this point in the meeting.
The City Clerk prepared the ordinance as amended and provided copies to the
Directors.
It was decided to add "to be issued" after "$3.88 million". It was decided
to add "(principal and interest)" after "This rate includes original bond
payments".
Bumpass moved to amend the last sentence of the explanatory language to read
"This rate includes original bond payments (principal and interest) and an
additional $3,880,000 in bonds to be issued for project delays and
additional environmental safeguards." The motion was seconded by Marinoni
and, upon roll call, passed, 5-0, Hess and Martin absent.
The ordinance was read for the third time. Upon roll call, the ordinance
passed, 5-0, Hess and Martin absent.
Director Lancaster, seconded by Bumpass, moved to pass an emergency clause.
Upon roll call, the motion passed, 5-0, Hess and Martin absent.
