A special meeting of the Fayetteville Board of Directors was held
on Tuesday, February 25; 1986 at 1:30 P.M. in Room 326, City Hall,
113 W. Mountain Street, Fayetteville, Arkansas.
PRESENT:I'Mayor Noland; Directors Bumpass, Hess, Johnson, Lancaster,
Martin and Orton, Acting City Manager Murphy', City
Attorney McCord, City Clerk Kennedy, members of the
press and others
Mayor Noland called the meeting to order, with seven Directors present.
The Mayor stated the purpose of the meeting was to discuss the Public
Works Director. The Mayor stated that, if the Board wishes to discuss
this matter in Executive Session, a motion would be in order to meet'
in Executive Session.
Director Lancaster, seconded by Orton, made a motion that the Board
meet in Executive Session.
Director Martin asked what would be revealed in Executive Session
that has not already been revealed in the newspaper. Mayor Noland
stated he thought the Board would be able to exchange their thoughts
more freely, specifically with respect to whether or not the person
appointed as Director of Public Works meets the requirements of the
job description.
Acting City Manager Murphy asked that, if there is going to be discussion
of any other candidates, in fairness to these people it should be
done in confidential conversation, as some persons who applied for
the positions had not notified their employers. Mayor Noland stated
that, at this point, he did not anticipate discussion of any other
candidates
Upon roll call, the motion passed, 5-2, with Hess and Martin voting
in the minority.
The Board met in executive session beginning at about 1:40 p.m.
The Board reconvened at about 2:30 p.m., with Director Martin absent.
Mayor Noland stated the Board had made a decision to meet tomorrow,
on February 26, at 5:00 P.M., with City Manager Don Grimes and Acting
City Manager Jim Murphy, to review the procedures used to interview
and hire the three department heads.

62.1 In answer to a question from the press, the Mayor responded that there
was no . dissension,. on the decision, and Director Orton commented ;that.,
it had. been the.consensus. of the Board..

In answer to a question from the press, Acting City Manager Murphy
stated that the same procedures were used.for hiring of all three
department heads..
In answer to a question from the press, City Attorney:McC,ord stated
he found no statute requiring that the Director of Public Works be
a registered engineer, although there is a statute which requires
that any public works project having a cost in excess of $25,000 shall
be engineered by a registered engineer.

about 2:40 P.M.
