N PRESENT: Administrative Assistant David McWethy, City Attorney Jim McCord, City CO Clerk Darlene Westbrook; and Directors Ernest Lancaster, John Todd, LO Paul Noland, Al Hughes, Philip Colwell, and Ann Henry. 0 ABSENT: City Manager Don Grimes and Director David Malone Q a OTHERS PRESENT: Members of the audience and representatives of the news media. 1 CALL TO ORDER The Mayor called the special session to order which was called for the pur- 67.1 pose of considering rezoning items acted upon by the Planning Commission at its August 15, 1977 meeting. ORDINANCE REZONING PROPERTY - R77-22 / Old Missouri Road / Ken Lazenby, petitioner The petitioner had requested rezoning a .51 acre tract, located on the west 67.2 side of Old Missouri Road approximately one-quarter mile south of Zion Road, from R-1 Low Density Residential to R-2 Medium Density Residential. The City Attorney read for the first time an ordinance to rezone the property as requested. The City Attorney advised the Directors that the petitioner had executed a bill of assurance declaring that not more than one single-family dwelling shall be con- structed on the property with septic tank sewer system. Mr. Bill Lazenby spoke in behalf of the petition and stated that he felt it 67.3 should be rezoned R-2 since surrounding property is zoned R-2 and since that classification would allow the best use of the property. Director Todd felt the City might be contributing to a traffic problem by providing for higher density on a narrow, hilly road. Director Hughes noted that surrounding property is zoned R-2 and that the density of development would be determined by setback requirements. Director Noland felt that an R-1 classification would not be useful and that the character of the area had surpassed the A-1 classification. He recognized Todd's concern but felt the realistic approach would be to grant the rezoning. Director Hughes, seconded by Colwell, moved rules be suspended and the ordi- 67.4 mance placed on second reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the second time. Director Hughes, seconded by Colwell, moved rules be further suspended and 67.5 the ordinance placed on third reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the final time. 67 68 68.1 There being no further discussion nor opposition expressed, the Mayor asked if the ordinance should pass. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Noland Nays: Todd Absent: Malone The Mayor declared the ordinance passed. ORDINANCE NO. 2370 APPEARS ON PAGE 304 OF ORDINANCE & RESOLUTION BOOK V ORDINANCE REZONING PROPERTY - R77-28 / Joyce Street / Enoch Bailey, petitioner 68.2 The City Attorney read for the first time an ordinance to rezone a 12 acre tract, located on the north side of Joyce Street, east of Old Missouri Road, from A-1 Agricultural to R-1 Low Density Residential. 68.3 Director Hughes, seconded by Colwell, moved rules be suspended and the ordi- nance placed on second reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the second time. 68.4 Director Hughes, seconded by Todd, moved rules be further suspended and the ordinance placed on third and final reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the third and final time. 68.5 lir. Bob Blackston spoke in behalf of the petition explaining that the pros- pective purchaser, Glen Fincher, wished to build his home on the lot but had no intention of subdividing. Mr. Fincher informed the Board that developments which would be necessary to subdivide the property would result in prohibitive lot costs. He assured the Board that he would not want septic tanks in a density that would create pollution problems. Fincher told the Board he would like per- mission to build his home on six of the twelve acres, reserving the remaining six until such time as sewer facilities are available. He stated he would be satisfied if only one additional home were built on the remaining six acres. 68.6 There being no further discussion nor opposition expressed, the Mayor asked if the ordinance should pass. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The Mayor declared the ordinance passed. ORDINANCE NO. 2371 APPEARS ON PAGE 305 OF ORDINANCE & RESOLUTION BOOK V ORDINANCE REZONING PROPERTY - R77-29 / Poplar Street / Jim Lindsey, petitioner 68.7 The City Attorney read for the first time an ordinance to rezone a 2.4 acre tract, located on the east side of Skull Creek and the north side of Poplar Street, from R-2 Medium Density Residential to I-1 Heavy Commercial -Light Industrial. 68.8 Director Colwell, seconded by Henry, moved rules be suspended and the ordinance placed on second reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the second time. 1 1 1 69 Director Todd, seconded by Noland, moved rules'be further suspended and the ordinance placed on third and final reading. The recorded vote was: Ayes: Hughes, Lancaster, Colwell, Henry, Todd, Noland Nays: None Absent: Malone The motion was declared passed and the ordinance was read the third and final time. Mr. J. W. Gabel was present to represent the petitioner. Gabel stated that Mr. Lindsey was aware that the property was located in a flood zone and had taken measures to increase the drainage capaoility of Skull Creek at that location. There being no further comments nor opposition expressed, the Mayor asked if the ordinance should pass.
