HomeMy WebLinkAbout1970-06-15 Minutes1 MINUTES OF A REGULAR MEETING OF THE BOARD OF DIRECTORS June 15, 1970 ' The Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Monday, June 15, 1970, in the Directors Room in the City Administration Building at 7:30 p.m. Present: City Clerk Marilyn Moore, City Attorney David Malone, and Directors Jones, Swartz, Melton, Lancaster, and Dunn. Absent: City Manager Wesley M. Howe, and Directors McFerran and Starr. Representatives of the Press were present. The meeting was conducted by Mayor Melton. The minutes of the regular meeting on Monday, June 1, 1970, a copy of which had previously been mailed to each of the Directors, were approved as written. 1-112 The City Attorney introduced, and at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, AN ORDINANCE AMENDING ZOVING ORDINANCE NO. 1239 AND THE REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, THROUGH MAY 282 1962, AS AMENDED, TO REZONE CERTAIN REAL ESTATE FROM R-21 TWO FAMILY RESIDENTIAL DISTRICT TO C-2, THOROUGHFARE COMMERCIAL DISTRICT. The Mayor reported that this was a petition by TAM Inc., and Cy Carney, Jr. to rezone Lot 4, Block 2 of A. L. Trent's Subdivision in Oak Grove Addition. Director Dunn moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Lancaster and passed unanimously. The Ordinance was then read for the second time. Director Dunn moved that the rule be further suspended and that the Ordinance be placed on third and final reading. ' The motion was seconded by Director Swartz and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. After a discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Ordinance passed. * Ordinance No. 1743 is on page 120 of Ordinance and Resolution Book 1. 2-112 The City Attorney introduced, and at the request of the Mayor, read a proposed resolution in its entirety declaring THE SIGNERS OF THE PETITION REQUESTING IMPROVEMENT OF CRESTWOOD DRIVE FROM EAST RIDGEWAY TO WEST RIDGEWAY TO BE SUFFICIENT. Director Jones moved that the Resolution be adopted. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Resolution adopted. * Resolution No. 26-70 is on page 61 of Ordinance and Resolution Book 1. 3-112 The City Attorney introduced, and at the request of the Mayor, read a proposed resolution in its entirety declaring THE SIGNERS OF THE PETITION REQUESTING IMPROVEMENT OF HOLLY STREET FROM SANG AVENUE TO PORTER ROAD TO BE SUFFICIENT. Director Swartz moved that the Resolution be adopted. The motion was seconded by Director Lancaster, and upon roll call the following ' vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Resolution adopted. * Resolution No. 27-70 is on page 62 of Ordinance and Resolution Book 1. 112 3 Mayor Melton reported that a Special Meeting of the Board of Directors would be 1-113 ' held at 7:30 p.m. June 22, 1970 in the Directors Room in the City Administration Building. The City Attorney introduced, and at the request of the Mayor, read a proposed 2-113 Ordinance in its entirety for the first time entitled, "AN ORDINANCE TO DESIGNATE AREAS WHERE PARKING IS PROHIBITED." Director Lancaster moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Jones and passed unanimously. The Ordinance was then read for the second time. Director Swartz moved that the rule be further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director Lancaster and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being five "Ayes" and no "Nays", the Mayor declared the Ordinance passed. * Ordinance No. 1744 is on page 121 of Ordinance and Resolution Book 1. The City Attorney introduced, and at the request of the Mayor, read a proposed 3-113 ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING SECTION 15-25 OF THE FAYETTEVILLE CODE OF ORDINANCES TO UPDATE THE BUILDING SEWER YARD LINE INSTALLATION REQUIREMENTS OF THE CITY PLUMBING CODE." ' Mayor Melton appointed a committee of plumbers to work with City officials to try to solve the problem of surface water infiltration into the City sewers. No further action was taken, and the Ordinance was left on first reading. The City Attorney introduced, and at the request of the Mayor, read a proposed 4-113 resolution in its entirety setting A PUBLIC HEARING TO VACATE AND ABANDON A CERTAIN ALLEY as requested by the petition of the Board of Trustees of the University of Arkansas. Director Jones moved that the Resolution be adopted. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Resolution adopted. * Resolution No. 28-70 is on page 63 of Ordinance and Resolution Book 1. The City Attorney introduced, and at the request of the Mayor, read a proposed 5-113 resolution in its entirety setting A PUBLIC HEARING TO VACATE AND ABANDON A PORTION OF 7th STREET as requested by the petition of Farm Service Cooperative and the Estate of Nora B. Adams. Director Jones moved that the Resolution be adopted. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Resolution adopted. * Resolution No. 29-70 is on page 64 of Ordinance and Resolution Book 1. ' The City Attorney introduced, and at the request of the Mayor, read a proposed 6-113 resolution in its entirety resolving that the City shall sponsor one Master of Public Administration graduate fellowship in the amount of $2,400.00. Director Swartz moved that the Resolution be adopted. 113 3 The motion was seconded by Director Dunn, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. ' "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Resolution adopted. * Resolution No. 30-70 is on page 65 of Ordinance and Resolution Book 1. 1-114 The Mayor reported that bids had been received and tabulated for the purchase of premium tires and tubes for a one (1) year period and recommended that the bids be awarded to the low bidder meeting specifications except in the case of some tube bids which will be awarded to the bidder with the matching tire. Director Dunn moved to accept the recommendation and award the bid for the purchase of premium tires and tubes for a one year period to the low bidder meeting specifications for each particular tire except in the case of some tube bids which will be awarded to the bidder with the matching tire. There being five "Ayes" and no "Nays", the Mayor declared the motion passed. 2-114 The Mayor reported that bids had been received and tabulated for the purchase of oils and greases for a one (1) year period and recommended that the bids be awarded to the low bidder. Director Lancaster moved to accept the recommendation and award the bid for the purchase of oils and greases for a one year period to the low bidder. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the , motion passed. 3-114 Director Jones moved that the Mayor and City Clerk be, and they are hereby, authorized to execute an Agreement with the Fayetteville School District No. 1 concerning the construction and pro -rata payment of utilities, maintenance, and custodial services of a building to be constructed at the Asbell Elementary School site and to be used as a recreational facility by the School District and the City. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the motion passed. 4-114 Director Lancaster moved that the Mayor and City Clerk be, and they are hereby, authorized to execute an Agreement with the Washington General Emergency Medical Services, Inc. and the Washington General Hospital whereby the Washington General Emergency Medical Services, Inc. and the Washington General Hospital would manage and operate afnbulance service for a two year period. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Dunn. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the motion passed. 5-114 Director Dunn stated that Mayor Melton was due special commendation for his effort in reaching this Agreement. I 114 4 Mayor Melton requested that a street improvement progress report be prepared and 1-115 presented to the Board of Directors at the special meeting scheduled for June 22, 1970. There being no further business, Director Jones moved to adjourn. The motion was seconded by Director Dunn and passed unanimously, whereupon the Mayor declared the Meeting adjourned. APPROVED:C. G.
