MINUTES OF A REGULAR MEETING OF THE BOARD OF DIRECTORS
May 18, 1970
The Board of Directors of the City of Fayetteville, Arkansas met in regular session
on Gonday, May 18, 1970, in the Directors Room in the City Administration Building
at 7:30 p.m.
Present: City Manager Wesley M. Howe, City Clerk Marilyn Moore, City Attorney David
Malone, and Directors Jones, Swartz, McFerran, Melton, Lancaster, and Dunn.
Absent at Roll Call but later entering: Director Starr.
Absent: None.
Representatives of the Press were present.
The minutes of the regular meeting on Monday, May 4, 1970, a copy of which had
previously been mailed to each of the Directors, were approved as written.
The City Manager presented the petition of J. W. and Marie Eoff to rezone a track of 1-103
land east of Highway 71 North and south Millsap Road from R -1B, Single Family Residential
District to C-2, Thoroughfare Commercial District which was approved by the Planning
Comibi s s ion .
The City Attorney introduced, and at the request of the Mayor, read a proposed ordinance
in Its entirety for the first time entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE
NO. 1239 AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS THROUGH MAY 28,
1962, AS AMENDED, TO REZONE CERTAIN REAL ESTATE FROM R -1B, SINGLE FAMILY RESIDENTIAL
DISTRICT TO C-2, THOROUGHFARE COMMERCIAL DISTRICT."
Director Jones moved that the rule be suspended and that the Ordinance be placed
on second reading.
The motion was seconded by Director McFerran and passed unanimously. The Ordinance
was then read for the second time.
Director McFerran moved that the rule be further suspended and that the Ordinance
be placed on third and final reading.
The motion was seconded by Director Jones and passed unanimously. The Ordinance
was then read for the third and last time. The Mayor then declared the Ordinance
open for discussion. After a discussion, the Mayor asked the question, "Shall the
Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Jones,
Swartz, McFerran, Melton, Lancaster, and Dunn.
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Ordinance
passed.

The City Manager presented the petition of Mr. and Mrs. A. J. Head to rezone a 1.7 2-103
acre triangular shape tract of land at the southwest corner of Old Farmington Road
and Root Avenue from A-1, Annexed Territory District to C-2, Thoroughfare Commercial
District which was approved by the Planning Commission.
The City Attorney introduced, and at the request of the Mayor, read a proposed ordi-
nance in its entirety for the first time entitled, "AN ORDINANCE AMENDING ZONING
ORDINANCE NO. 1239 AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, THROUGH
MAY 285 19625 AS AMENDED, TO REZONE CERTAIN REAL ESTATE FROM A-1, ANNEXED TERRITORY
DISTRICT TO C-2, THOROUGHFARE COMMERCIAL DISTRICT."
Director McFerran moved that the rule be suspended and that the Ordinance be placed
on Second reading.
The motion was seconded by Director Swartz and passed unanimously. The Ordinance
was then read for the second time.
Director Swartz moved that the rule be further suspended and that the Ordinance be
placed on third and final reading.
The motion was seconded by Director McFerran and passed unanimously. The Ordinance
was then read for the third and last time. The Mayor then declared the Ordinance
open for discussion. After a discussion, the Mayor asked the question, "Shall the

"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Ordi-

1-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
Ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING
SECTION 6-34 OF THE FAYETTEVILLE CODE OF ORDINANCES TO ADOPT BY REFERENCE THE 1969
EDITION OF THE SOUTHERN STANDARD BUILDING CODE; TO ADD, MODIFY, OR DELETE CERTAIN
OTHER SECTIONS OF THE FAYETTEVILLE CODE OF ORDINANCES; TO REVISE SAID CODE TO UPDATE
THE REQUIREMENTS OF THE CITY BUILDING CODE; AND TO FROVIDE PENALTIES FOR THE VIO-
LATION OF SAID CODE."
No further action was taken and the Ordinance was left on first reading.
2-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
resolution in its entirety entitled, "A RESOLUTION SETTING A HEARING ON THE ADOPTION
OF THE 1969 EDITION OF THE SOUTHERN STANDARD BUILDING CODE."
Director Jones moved that the Resolution be adopted.
The motion was seconded by Director Swartz, and upon roll call the following vote
was recorded: "Aye" Janes, Swartz, McFerran, Melton, Lancaster, and Dunn.
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Resolution
adopted.

3-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING SECTION
15-61 OF THE FAYETTEVILLE CODE OF ORDINANCES AND TO ADOPT BY REFERENCE THE 1969
EDITION OF THE SOUTHERN STANDARD GAS CODE AND ADDING, MODIFYING, OR DELETING
CERTAIN OTHER SECTIONS OF THE FAYETTEVILLE CODE OF ORDINANCES TO REVISE SAID CODE
AND TO UPDATE THE REQUIREMENTS OF THE CITY GAS CODE."
No further action was taken and the Ordinance was left on first reading.
4-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
resolution in its entirety entitled, "A RESOLUTION SETTING A HEARING ON THE ADOPTION
OF THE 1969 EDITION OF THE SOUTHERN STANDARD GAS CODE."
Director McFerran moved that the Resolution be adopted.
The motion was seconded by Director Swartz, and upon roll call the following vote
was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, and Dunn.
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Resolution
adopted.

5-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
ordinance in its entirety for the first time entitled, " AN ORDINANCE AUTHORIZING
THE WATER AND SEWER SUPERINTENDENT TO REQUIRE SEWER CONNECTIONS; AND PROVIDING
PENALTIES FOR THE VIOLATION OF ITS PROVISIONS."
No further action was taken and the Ordinance was left on first reading.
6-104 The City Attorney introduced, and at the request of the Mayor, read a proposed
resolution in its entirety regarding a REPORT ON IMPROVEMENT OF HOLLY STREET
FROM SANG AVENUE TO PORTER ROAD.
Director Dunn moved that the Resolution be adopted.
The motion was seconded by Director Lancaster, and upon roll call the following
vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, and Dunn.
"Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Resolution
adopted.

Dirictor Starr entered.
The City Attorney introduced, and at the request of the Mayor, read a proposed 1-105
resolution in its entirety regarding a REPORT ON IMPROVEMENT OF CRESTWOOD DRIVE
FROM EAST RIDGEWAY TO WEST RIDGEWAY.
Director Dunn moved that the Resolution be adopted.
The motion was seconded by Director Lancaster, and upon roll call the following
vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and
Dunn.
"Nay" none. There being seven "Ayes" and no "Nays", the Mayor declared the Reso-
lution adopted.

The City Attorney introduced, and at the request of the Mayor, read a proposed 2-105
resolution in its entirety regarding a REPORT ON IMPROVEMENT OF CEDAR STREET FROM
LEWIS AVENUE TO NORTH OAK AVENUE.
Director Jones moved that the Resolution be adopted.
The motion was seconded by Director McFerran, and upon roll call the following
vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and
Dunn.
"Nay" none. There being seven "Ayes" and no "Nays", the Mayor declared the Reso-
lution adopted.

The City Attorney introduced, and at the request of the Mayor, read a proposed 3-105
resolution in its entirety regarding a REPORT ON IMPROVEMENT OF STORER AVENUE FROM
HOLY STREET TO NORTH STREET; HOLLY STREET FROM OAKLAND AVENUE TO LEVERETT AVENUE;
AND HAZEL STREET FROM OAKLAND AVENUE TO LEVERETT AVENUE,
Director Starr moved that the Resolution be adopted.
The motion was seconded by Director Swartz, and upon roll call the following vote
was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn.
"Nay" none. There being seven "Ayes" and no "Nays", the Mayor declared the Reso-
lution adopted.
* Resolution No. 19-70 is on page 46 of Ordinance and Resolution Book 1,
Mayor Melton requested Directors Starr and Jones check the different makes of air 4-105
conditioning and heating units and report to the Board their suggestions as the most
pradtical units to use as an airconditioning replacement for the Police Building, the
Airport Building, and the FAA Building; and to replace the heating unit and addition
of air conditioning in the City Shop,
The City Manager reported that bids had been received and tabulated for the purchase 5-105
of tires and tubes. Director Lancaster asked the City Manager if the tires bid were
first line or premium. The City Manager reported that the tires and tubes were premium.
It was reported that the intent of the Board was to purchase premium tires. POn this
basis a vote was taken to award the purchase of the tires and tubes to the low bidder.
When a tire bid was low, the matching tube bid was awarded to the same bidder even
though it was not low for the purpose of convenience and to save man-hours.
Director McFerran moved that the purchase of premium tires and matching tubes be
awaitded to the low tire bidders.
The motion was seconded by Director Starr, and upon roll call the following vote
was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn.
"Nay" none. There being seven "Ayes" and no "Nays", the Mayor declared the motion
passed.

1-106 Mayor Melton reported that Mr.
Ed
Clement had resigned from the
Board
of Adjustment
and requested that suggestions
for
a replacement be presented to
City
Manager Howe,
2-106 The Board of Directors decided to have an appraiser determine the true value of
Lake Fayetteville, However, Director Starr suggested that only a fee of from $60
to $100 be paid for this service.
3-106 City Manager Howe presented the Audit for the City of Fayetteville General Government
ending December 31, 1969.
4-106 The City Manager reported that Sturman Mackey, Administrative Assistant, was resign-
ing to take the position of City Manager in Fulton, Kentucky.
There being no further business, Director Jones moved to adjourn. The motion
was seconded by Director Starr and passed unanimously, whereupon the Mayor declared
the meeting adjourned.
