HomeMy WebLinkAbout1970-02-16 Minutes1 MINUTES OF A REGULAR MEETING OF THE BOARD OF DIRECTORS ' February 16, 1970 The Board of Directors of the Citr of Fayetteville, Arkansas, met in regular session on Monday, February 16, 1970, in the Directors Room in the City Admini- stration Building at 7:30 P.M. Present: Citv Manager Weslev M. Howe, City Clerk Karilim Moore, Citi+ Attorney David Malone, and Directors Jones, Swartz, McFerran, Melton, Lancaster, and Dunn. Absent at Roll Call but later entering: Director Starr. Absent: None. Representatives of the press were present. The minutes of the regular meeting on iw:ondnv, February 2, 1970, and of the special meeting on Monday, February 9, 1970, a copy of which had previously teen mailed to each of the Directors, were annroved as written. Director Starr entered. City Manager Howe reported that consideration should be given to a contract 1-85 with the City of Greenland and Suburban Water District No. 1 (Greenland Water District) providing for the dissolution of the Water District and continuation of water service in the City of Greenland b� the Cite of Fayetteville after the present water contract expires. Director Starr moved that the Mayor and Citv Clerk be, and they are hereby, authorized to execute a contract with the Cit7r of Greenland, Arkansas, and ' Suburban Water District No. 1 of Washington County, Arkansas, relating to water. The motion was seconded by Director McFerran, and upon roll call the follow- ing vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Ptarr, and Dunn. "Nay" none. There being seven "Ayes" and no "Naps", the Mayor declared the motion passed. The City Attorney introduced, and at the request of the Maror, read a proposed 2-85 ordinance in its entirety for the first time entitled, "AN ORDIYAIICE TO AMEND SECTION 1C-29.1, CODE OF ORDINANCES, CITY OF FAYETTEVILLE, ARKANSAS, 1n REFLECT AN INCREAIE IN FATES FOR LOPAT, TYnE CONTAINER. SERVICE." Director Dunn moved that the rule be suspended and that the Ordinance he placed on second reading. The motion was seconded Ir Director Starr and passed unanimously. The Ordi- nance was then read for the second tune. Director Dunn moved that the rule be further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director McFerran and passed unanimously. The Ordi- nance was then read for the third and last time. The Idayor then declared the Ordinance open for discussion. After a discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Swartz, le:cFerran, Melton, Lancaster, Starr, and Dunn. "Nay" Jones. There being six "Ages" and only one "Nay", the Mayor declared the Ordinance passed. ' * Ordinance No. 1733 is on page 97 of Ordinance and Resolution Book 1. The City Attorney introduced, and at the request of the Mayor, read a proposed 3-85 ordinance in its entirety for the first time relating to "AN ORDINANCE ATTTHnRI- ZING A CONTRACT WITH THE ARKANSAS STATE HIGHWAY COMMIS5ION TO STRVEY CITY .STREETS TO DETERMINE WINTER WEATHER DAMAGES." 2 2 Director Starr moved that the rule be suspended and that the Ordinance he placed on second Reading. The motion was seconded by Director Swartz and passed unanimously. The Ordi- nance was then read for the second time. Director Starr moved that the rule he further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director Jones and passed unanimously. The Ordi- nance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. After•a discussion, the Mavor asked the question, "Shall the Ordinance pass9" Upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nay" none. There being seven "Ayes" and no "Nays", the Mayor declared the Ordinance passed. Ordinance No. 1734 is on page 98 of Ordinance and Resolution Book 1. 1-86 The City Attorney introduced, and at the request, of the Favor, read a proposed ordinance in its entirety for the first time entitled, "AN ORPINANCE TO AMEND CHATTER 20, ARTICLE 2, SECTION 20-20, 9PB °ECTION (A) OF THE CODE OF ORDINANCES FOR THE CITY OF FAYETTEVILLE, ARKANSAS." Director Lancaster moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Starr and passed unanimously. The Ordinance was then read for the second time. A long discussion followed. No further action was taken, and the Ordinance was left on second reading. Information concerning taxi cab rates of Cities the size of Fayetteville and in this area will be presented at the next meeting. 2-86 Director McFerran moved that the City Manager be, and he is hereby, authorized to establish the position of draftsman at a starting salary of $550 per month, and to employ a full time draftsman. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nap" none. There being seven "Ayes" and no "Nava", the Favor declared the motion passed. 3-86 The City Attorneypreserted an application from the Loyal Order of Moose request- ing the issuance of a license for the sale of alcoholic beverages as authorized under Ordinance No. 1671 of the City of Fayetteville. Pirector Starr moved to approve the application of the Loyal Order of Moose and authorize the issuance of a license for the sale of alcoholic beverages. The motion was seconded by Director Dunn, and upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nav" none. There being sever. "Apes" and no "Naps", the Mayor declared the motion passed. There being no further business, Director Swartz moved to adjourn.
