Present: City I•:anager Wesley iv;. Howe, City Clerk Marilyn Moore, Cite Attorney David Malone, and Directors Jones, Swartz, Melton, Lancaster, and Starr. Absent: Directors McFerran and Dunn. Representatives of the press were present. The minutes of the regular meeting on :Monday, January 19, 1970, a copy of which had previously teen mailed to each of the Directors, were approved as written. 140 The City Manager reported that this was the time and the place set for a public hearing on the adoption of the 1968 edition of the National Electric Code to replace the 1965 edition. The City Attorney introduced, and at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE ANO;Dll',G SECTION 8-1 OF THL FAYETTEVILLE CODE OF ORDINANCES, T^ ADOPT BY REFERENCE THE 1968 EDITION OF Ta NATIONAL ELECTRICAL CODE TO UPDATE TFL REQUIRSI•;ENTS Oil THE CITI ELECTRICAL CODE." Director Swartz moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Lancaster and passed unanimously. The Ordi- nance was then read for the second time. Lirector Lancaster moved that the rule be further suspenc.ec anc that the Ordi- nance to placed on third ana final reading. The motion was seconded by Director Swartz and passed unanimously. The Ordi- nance was then read for the third and last time. The tw:ayor then declared the Ordinance open for discussion. After a discussion, the Mayor asked the question, "Shall the Crdinance pass?" Upon roll call the following vote was recorded: "A,ye" Jones, Swartz, Melton, Lancaster, and Starr. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the Ordi- nance passed. Ordinance No. 1730 is on page 88 of Ordinance and Resolution book 1. 2-80 The board of Directors instructed the City Attorney to prepare an ordinance increasing sanitation service rates for containerized service. 3-80 The City Manager recommended that the City not participate in the proposed Sun- rise hountain Water Improvement District as proposed in the engineering report submitted by the proponents of the improvement district. A long discussion followed durinE which residents of the Sunrise Mountain area presented their view of the project and the reason for wanting water. Director Swartz moved that the proposal of creating a Water improvement District on Sunrise Mountain be tahled for further consideration, and that City Manager riowe discuss the situation witn the residents of the area. The motion was seconded by Director Jones, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, i+ielton, and Lancaster. "Nay" Starr. There being four "Ayes" and only one "Play", the :Aayor declared the motion passed. 4-80 The City Attorney introduced, and at the request of the Mayor, read a proposed resolution in its entirety regarding the transfer of 875,000 from the Water- works and Sewer Contingency Reserve Fund. Director Starr moved that the Resolution be adopted. There being five 11A.3res" and no "Nays", the Mayor declared the Resolution adopted. u Resolution No. 2-70 is on page 21 of Ordinance and Resolution book 1. The City Attorney introduced, and at the request of the i-iayor, read a proposed 1-81 ordinance in its entirety for the first time entitled, "AN ORDINANCE TO EXFRESR THE POLICIES OF THE CITY OF FAYETTEVILLE, ARKANSAS, REGARDING AND CnNCERNING THE OPER/TION OF A viATER DISTRIBUTION SYSTEM WITHIN SAID CITY." Director Swartz moved that Section 1, Fart A, Number 9 and 9a he amended to change the word additional to increased. Tne motion was seconded by Director Lancaster, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Starr. "Nay" none. There being five "Ayes" and no "Nays", the Mayor declared the motion passed. Director Jones moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Swartz and passed unanimously. The Ordi- nance was then read for the second time. Director Jones moved that the rule be further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director Swartz and passed unanimously. The Ordi- nance was then read for the third and last time. The Kavror then declared the Ordinance open for discussion. After a discussion, the Mavor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: ' "Ave" Jones, Swartz, Melton, Lancaster, and Starr. "Nay" none. There being five "Ayes" and no "Nays", the ivialror declared the Ordinance passed. * Ordinance No. 1731 is on page 89 of Ordinance and Resolution Look 1. The bia7ror stated that consideration should be given to an ordinance authorizing 2-81 the execution of a Second Supplemental Contract between the City and Beaver nater District. Director Starr, seconded by Director Swartz, moved that the rule requiring the reading of an ordinance or resolution in full on three different days be sus- pended and that the ordinance to placed on its second reading. The Mayor put the question on the adoption of the motion and the roll being called, the follow- ing voted "Ave" Jones, Swartz, Melton, Lancaster, and Starr, and the following voted "Nay" none. Thereupon the payor declared that at least two-thirds of all members of the Board having voted in favor of the motion to suspend the rule, the motion was carried and the rule suspended. The ordinance was then read by the City Attorney. Director Starr, seconded by Director Lancaster, then moved that the rule re- quiring the reading of an ordinance in full on three different days be further suspended and that the ordinance be placed on its third reading. The Mayor put the question on the adoption of the motion and the roll being called the following voted "Aye" Jones, Swartz, iielton, Lancaster, and Starr, and the following voted "Nay" none. The Mayor declared that at least two-thirds of all members elected to the Board having voted in favor of the motion to suspend m 3 the rule, the motion was carried and the rule suspended. The ordinance was then read by the City Attorney. ' The Ordinance was then declared open for discussion. Director Starr, seconded 17 Director Lancaster, moved that the ordinance be adopted. The question was put by the Mayor on the adoption of the motion and the roll being called, the following voted "Ave" Jones, Swartz, iielton, Lancaster, and Starr, and the following voted "Nay" none. Lirector Lancaster, seconded by Director Swartz, moved that Section 5, the emergency clause, be adopted, and on roil tali the following voted "Aye" Jones, Swartz, Kelton, Lancaster, and Starr, and the following voted "Na:r" none. The ivayor thereupon declares: the ordinance and the emergency clause adopted . Ordinance No. 1732 is on page 92 of Ordinance and Resolution Book 1. 1-82 Director Swartz moved that the Ka�lror and City Clerk Le, and they are hereby, authorized to execute a contract with McClelland Engineers for engineering work necessary for water and sewer relocation on iiighwa!r 71 South. The motion was seconded by Director Lancaster, ant, upon roll call the following vote was r^corded: "Aye" Jones, Swartz., Melton, Lancaster, and Starr. "Nay" none. The motion was seconded by Director Jones, and upon roil call the following vote was recorded: "Aye" Jones, Swartz, Melton, Lancaster, and Starr. Nay" none. The motion was seconded by Lirector Swartz, and upon roll call the following rote was recorded: "Aye" Jones, :wartz, 1k.eiton, Lancaster, and Starr. "Nay" none. The motion was seconded by Lirector Swartz, and upon roll tali the following vote was recorded: "Aye" Jones, Swartz, rielton, Lancaster, and Starr. "Nay" none. There being five "Ayes" and no °Nays", the Mayor declared the motion passed. ' Aayor rielton announced a special meeting to be held in the Directors Room of 1-83 the City Administration Building at 7:30 P.Pi. February 9, 1970 for the purpose of approving the Center Square Urban Renewal Froject application prepared by Urban Frogramming Corporation of America for Lice Housing Authority of the City of Fayetteviiie. Director Jones moved that the iiayor and City Clerk be, and they are hereby, 2_83 authorized to execute a Release Deed as follows: Lots 10 through 25 inclusive in Block 2, and Lots 10 through 18 inclusive in Block 3, in Red Arrow No. 2 Suhdivision. The motion was seconded by Director Starr, and upon roll call the following vote was recorded: "Ave" Jones, Swartz, Lelton, Lancaster, and Starr. "Nay" none. There being five 'IAyes" and no "Nays", the Mayor declared the motion passed. There being no further business, Director Lancaster moved to adjourn.
