HomeMy WebLinkAbout1969-09-15 Minutes1 MINUTES OF A REGULAR MEETING OF THE BOARD OF DIRECTORS September 15, 1969 The Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Monday, September 15, 1969, in the Directors Room in the City Admini- stration Building at 7:30 P.M. Present: City Manager Wesley M. Howe, City Clerk Marilyn Moore, City Attorney Richard Wells, and Directors Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. Absent: None. Representatives of the press were present. The minutes of the regular meeting on Tuesday, September 2, 1969, a copy of which had rreviously peen mailed to each of the Directors, were approved as written. Judge Maupin Cummings administered the Oath of Office to Director Joe Fred Starr. 1-47 Mayor Melton reported that nominations were in order for the election of a new Vice -Mawr. Director Dunn moved to nominate Director Joe McFerran as Vice -Mawr. The motion was seconded by Director Jones. Director Swartz moved that nominations be closed. The motion was seconded by Director Lancaster and passed unanimously. The following vote was recorded on the motion to elect Firector McFerran Vice Magor: "Aye" Jones; Swartz, Melton, Lancaster, Starr, and Dunn. "Nay" none. Abstain: McFerran. There being six "Ayes" and no "Nays", the Mayor declared Director McFerran Vice I4ayor. The City Attorney introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE TO AMEND SECTION 9-27 OF THE FAYETTEVILLE CODE OF ORDINANCES TO PERMIT USE OF FIREWORKS ON CERTAIN DAYS." Director Dunn moved that the Ordinance be placed on second reading at the next regular meeting. The motion was seconded b?r Director McFerran and passed unanimously. No further action was taken and the Ordinance was left on first reading. The City Attornev introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE TO REGU- LATE ANP CONTROL THE RETAIL SALE OF FIREWORKS WITHIN THE CORDORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS." A discussion was held and the City Attorney was instructed to revise the Ordinance. No further action was taken and the Ordinance was left on first reading. The City Attorney introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE REGULAT- ING VEHICULAR ACTIVITIES AT DRIVE-IN RESTAURANTS IN THE CITY OF FAYETTEVILLE, ARKANSAS." A discussion was held and the City Attorney was instructed to revise the Ordinance. Cirector Lancaster moved that, the Lo.arr of ^irectors reconsider the rezoning renuest of Vernon Wilscn. The motion was seconded b*r Cirector Dunn, and upon roll call the following vote was recorded: "Ave" Jones, Melton, Lancaster, Ftarr, arc' Dunn. "Nair° YcFerran and Swartz. LS 3 The City Manager introduced, and at the request of the Mayor, read a proposed 1-49 resolution in its entirety urging voters of the City of Fal-etteville to vote in favor of the Northwest Arkansas Regional Airport on Septemrer 23, 1969. Director McFerran moved that the Resolution be adopted. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nay" none. There being seven "Ayes" and no "Na? -s", the Magor declared the Resolution adopted. Resolution No. 24-69 is on page 11 of Ordinance and Resolution Book 1. Attorney David Malone appeared before the Board of Directors on the petition of Thomas M. Liles and Ola telae Liles to rezone property located on the north side of Cleveland Street between Hall Avenue and Sunset Avenue to permit a fraternity house which was tabled at the August 18, 1969 meeting. A resolu- tion was presented to the Board of Directors which the City Attorne,r read in its entirety entitled, "A RESOLUTION AUTHORIZING AND DIRECTING THE PLANNING COMMISSION TO STUDY THE FEASIBILITY OF ESTABLISHING AN F -L, FRi%TERNITY AND SORORITY DISTRICT; AND TO STUP.Y A PROPOSED ORDINANCE ESTABLISHING SUCH A DISTRICT." Director Swartz moved that the Resolution be adopted. 'The motion was seconded by Director .Starr, and upon roll call the follow- ing vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nay" none. There being seven "Ayes" and no "Nairs", the Mayor declared the Resolution adopted. Resolution No. 25-69 is on page 12 of Ordinance and Resolution Book 1. Director Dunn moved that City Manager Howe be, and he is hereby, authorized to attend the International Cite Manager's Association meeting to be held in New York Cit 'v on October 10 through 17, 1969. The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Dunn. "Nay" none. There being seven "A*res" and no "Naps", the Mayor declared the motion passed. The Citv Manager reported that a meeting was to be held with the Countv Hospital Board, the 'County Judge, and other interested parties concerning ambulance service. Director Starr moved that the Board of Directors give City Manager Howe and Mayor Melton complete authority to do whatever is necessary in their minds to resolve the ambulance problem; they need no furth@reconfirmation from this Board to do so. The motion was seconded by Director Dunn, and upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Melton, Lancaster, Starr, and Ddnn. "Nav" none. There being seven "Ayes" and no "Nays", the Mayor declared the motion passed. There being no further business, Director McFerran moved to adjourn.
