TING OF THE BOARD ^F ^IRECTORF September 2, 1969 , The Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Tuesday, September 2, 1969, in the Directors Room in the Cit -r Admini- stration Building at 7:30 P.M. Present: City A:anager ;Jeslev ?`.. Howe, City Clerk N.ari17rn PMocre, City Attorney Richard 'ells, and Directors Jones, Swartz, McFerran, Melton, Lancaster, and Dunn. Absent: Director Joe Fred Starr. Representatives of the press were present. The minutes of the regular meeting on M.onda«, August 18, 1969, a Cor« of which had previouslir been mailed to each of the Directors, were approved as writ/ en. The seating of Mr. Joe Fred Starr as a member of the Board of Directors of the Cite of Favet+eville was deferred. i-44 The petition of Thomas Y. Liles and Ola Mae Liles to rezone certain nrorert7• located on the north side of Cleveland Street between Hall Avenue and Sunset Avenue from R -LA, Sirgle Family Residential District which was tabled at the August 18, 1969, meeting was continued until the next meeting. 2-44 The City Manager presented the petition of Wheeler Motor Company, Inc. to rezone certain property located just north of Highwair 45 and northeast of Fairview Ce*nete ry from A-1, Annexed Territor^r District to R -IA, Single Fareil=- Residen- tial District which had been recommended bi- the Planning Com:ission. , The City Attornev introduced and, at the request of the N.ayor, read a rroposed ordinance in its entiret+> for the first time entitled, "AN ORPINA.NCE AMENDING ZONING CRPINANCE NO. 1239, AND REVISED ZONING DISTRICT Muir OF FAYETTEVILLE. ARW7^ A.S, APPROVED MAY 282 19623 AS AMENDED, TO REZONE CERTAIN REAL ESTATE FROM A-13 ANNEXED TERRITORY DISTRICT Tn R -1A, SINGLE FAMILY RESIDENTIAL DISTRICT." Director Dunn moved that the rule be suspended ar.d that the Ordinance be placed on second reading. The motion was seconded by Director Swartz and passed unanimously. The Crdi- nar.ce was then, read for the second time. Director Dunn moved that the rule be further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by h Director ,cFerran and passed unanimously. The Ordinance was ther, read for the third and last time. The Mavor they. declared the Ordinance open for discussion. There being ro discussion, the Mal -or asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Yelton, Lancaster, and Dunn. "Nav" none. There being six "Ayes" and no "Nays", the Mayor declared the Ordinance passed. Ordinance No. 1695 is on page 40 of Ordinance and Resolution Book 1. 3-44 The City Marager presented the petition of Thomas C. Comlev to rezone certain property located at the northwest, corner of the int.erection of Hazel Street and Storer Avenue from R-2, Two -Family Residential District to R-3, :•ulti- Farril.e Residential which had been recommended by the Planning Commission. The City Attornev introduced and, at the request of the Mairor, read a nroposed , ordinance in its entirety for the first time entitled "AN OR INANCE AMENDING ZONING ORDINANCE NO. 1239, AND R VIFED YNING P.ISTRICT MAr PF FAYE'^TEVITI.EH, ARKANSAS) ATTROVED :Av 28, 19623 AS Ai:ENPED, TY) REZ^TE CERTAIf REAL �TA.TE 44 E FROM R-22 TWO FAMILY RESIDENTIAL DISTRICT TO R-3, MULTI -FAMILY RESIDENTIAL Director Lancaster moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Jones and passed unanimously. The Ordi- nance was then read for the second time. Director Lancaster moved that the rule be further suspended and that the Ordi- nance be placed on third and final reading. The motion was seconded by Director McFerran and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being no discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Jones, Swartz, McFerran, Melton, Lancaster, and Dunn. "Nay" none. There being six "Ayes" and no "Nays", the Mayor declared the Ordinance passed. * Ordinance No. 1696 is on page 41 of Ordinance and Resolution Book 1. The City Manager presented the petition of McIlroy Bank and Industrial Finance 1-45 Company to close and vacate two alleys located in Block 16, Original Torn of Fayetteville; the north -south alley and the easterly portion of the east - west alley, and reported that this was the date, time and place set for a public hearing on the closing and vacating of the two alleys. The City Attornev introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE VACATING CERTAIN ALLEYS IN THE CITY OF FAYETTEVILLE, ARKANSAS." Director Jones moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director McFerran and passed unanimously. The Ordi- nance was then read for the second time. Director Jones moved that the rule be further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director McFerran and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion.. There being six "Ayes" and no "Na7rs", the Mayor declared the Ordinance passed. * Ordinance No. 1697 is on page 42 of Ordinance and Resolution Book 1. The City Attorney introduced and, at the request of the Mayor, read a proposed 2-45 ordinance in its entirety for the first time entitled, "AN ORDINANCE TO NAME A STREET 14ITHIN THE CORPORATE LIMITS OF THE CIT`_' OF FAYETTEVILLE, ARKANSAS." Director McFerran moved that the rule he suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Swartz and passed unanimously. The Ordi- nance was then read for the second time. Director McFerran moved that the rule he further suspended and that the Ordinance be placed on third and final reading. The motion was seconded by Director Jones and passed unanimously. The Ordi- nance was then read for the third and last time. -The Mayor then declared the Ordinance open for discussion. Director Dunn moved that the rule be suspended and that the Ordinance be placed on second reading. The motion was seconded by Director Lancaster and upon roll call the following vote was recorded: "Ave" Melton, Lancaster, and Dunn. "Nair" Swartz and McFerran. Abstain: Jones. There being three "A'•es" and two "Nays", the Malror declared the motion to susnend the rules requiring an ordinance to he read on three separate days and place the ordinance on second reading failed. The Citv Att.orn.ev introduced and, at the reouest of the Mai -or, read a pronosed ordnance in its Pnt:rety for the first time entitled, "AN ORDIFA.NCE TO A71END CHATTER 3, ARTICLE II, OF THE CODE OF ^RFI"T4FCES, CITY r1F FAYE"'TE+'ILTE, ARKANSAC " Director Jones moved that the rule be susrended and that the Ordinance be placed on second read:nE. The motion was seconded by Director Swartz and passed unanimousl.-. Read second time. Director Lancaster moved that the rule be further susnended and that, the Ordinance be placed on third and final reading. The motion was seconded by Director McFerran and passed unan.imousl7r. There being six "Ayes" and no "Nave", the Mayor declared the Ordinance passed. a' Ordinance No. 1699 is on page 44 of Ordinance and Resolution Book 1. Director Swartz moved that City Manager Howe be, and he is hereby, authorized to execute an agreement between the City of Fa-retteville and 1{r. C. E. Wages regarding services as custodian of the Wilson Lake rronert•r and supervision of the use and operation of the City Dump located on said property. The motion w.as seconded by Director Lancaster and upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Melton, Lancaster, and Dunn. "Nov'' none. There being six "Aires" and no "Nays", tFe Mawr declared the motion passed. 4-46 The Citv Manager introduced, and at the request of the Ma.ror, read a rroposed resolution in its ent.1rety regarding the construction of a 24 inch water distri- bution main crossing the St. Louis -San Francisco Railwa.r tracks. Director McFerran moved that the Resolution he adopted. The motion was seconded by Director Swartz,and upon roll call the following vote was recorded: "Ave" Jones, Swartz, McFerran, Melton, Lancaster, and Dunn. "Nav" none. There being six "Ayes" and no "Nays", the Mayor declared the Resolution adonted. * Resolution No. 23-69 is on page 10 of Ordinance and Resolution Book 1. There tieing no further business, Director McFerran moved to adjourn. The motion was seconded b.r Director Jones and passed unanimously, whereupon the Mayor declared the meeting adjourned.
