The Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Monday, August 5, 1968, in the Directors Room in the City Administration Building at 7:30 P. M. CDST. Present: City Manager Gerald G. Fox, City Clerk George U.1 Davis, City Attorney Hugh Kincaid and Directors T.J.Keith, News Swartz; McFerran, Melton, Christie, and Trumbo. Reporter N.W. Absent: Directors James Kerlin and Dale Dunn. 'Times, also present.) The minutes of the regular meeting on Monday, July 15, 1968, and of the special meeting on Monday, July 29, 1968, copies of which had previously been mailed to each of the Directors, were approved as written. Public Hearing to vacateKnox Dr. The Mayor reported that this was the date, time, and place set for public hearing on the petition of th First United Presbyterian Church to vacate and abandon that portion of Knox Drive,south of Birwin Street, Ordinance No.1616 which had never been opened, graded, or utilized. Vacating and Abandon- The City Clerk reported that he had caused a notice of the public hearing to be published in the Northwes ing part of Knox Arkansas Times, a daily newspaper published in Washington Counby Arkansas and having a general circulatioi Drive. in the City of Fayetteville, Arkansas, once a week for two consecutive weeks and that an Abstractor's Certificate of Title, showing the Owners of Record, had been attached to the petition prior to the time set for the public hearing; also that a letter from each of the utility companies had been received stating they had no objection to the vacating and abandoning -o£ said street. There being no objection to the vacating and abandoning of said street, the City Attorney introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE VACATING AND ABANDONING A PORTION OF KNOX.DRIVE IN A. M. IRWIN ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS." Director Christie moved that the rule be suspended and that the Ordinance be placed on the second reading The motion was seconded by Director McFerran and passed unanimouAly. The Ordinance was then read for the second time. Director Christie then moved that the rule be further suspended and that the Ordinance be placed on the third and final reading. The motion was seconded by Director McFerran and passed unanimously. The Ordinance was.then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being no discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded, -"Aye" Swartz, McFerran, Melton, Christie, and Trumbo. "Nay" None. There being Five "Ayes" and No "Nays", the Mayor declared the Ordinance passed. ORDINANCE N0, 1616 AN ORDINANCE VACATING AND ABANDONING A PORTION OF KNOX DRIVE IN A.M. IRWIN ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Fayetteville, Arkansas, on the 15th day of July, 1968, asking the Board of Directors to vacate and abandon the following portion of Knox Drive, located in A.M. Irwin Addition to the City of Fayetteville, Arkansas, to -wit: A Parcel of land situated in the Ni of the NWi of Section 10 T -16-N R-30 W, being more particularly described as follows: Beginning at the SEScorner NES, Nw � Sec. 10 T-16=NSR-30-W,; thence W 50 feet; thence N 225 feet;.thence E 50 feet; thence S uih '225,feet_to_ the point of beginning) 0 andf'�ituated in the City of Fayetteville, Washington County, Arkansas. WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place set forth in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of Rhe street hereinabove described has heretofore beed dedicated to the public use as a street; has not actually been used by the public subsequent to the filing of the plat; that all the owners of the property adjoining and abutting upon the street to be vacated have consented to the abondonment, and that public interest and welfare will not be adversely affected by the.abondonment of such street. NOW9 THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally in and to the above descriped portion of Knox Drive in the A.M. Irwin Addition to the City of Fayetteville, Arkansas, without reservation. As as condition, however, to the closing ofthe above described portion of Knox Drive, the City shall be held free and harmless from liability as to any claims of the abutting owners ,by reason of this closing, vacation and abandonment, ore any claims by any utilities. SECTION 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of thi Recorder of the the County and recorded in the Deed Records 6f the County. SECTION 3. This Ordinance shall be in full force and effect from and after its passage, approval and publication. There being five "Ayes"$nd no "Nays", the-Mayor.declared the Ordinance passed. 294 # 115 ORDINANCE N0, 1617 N ORDINANCE AMENDING ZONING ORDINANCE N0, 1239, AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARK, PPROVED MAY 283 19622 TO REZONE CERTAIN REAL ESTATE FROM 0-1 OPEN LAND DISTRICT, TO C4 , THOROUGHFARE DISTRICT. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, Arkansas esday, July 16 , 1968, on the petition of Julian L. Watts and Edwardene Watts, requesting that said Pla mmission recommend to the Board of Directors of the City of Fayetteville. Arkansas, that the Board of rectors enact ordinance rezoning the following described property, presently zoned O-1 Open Land Distri C-2 Thoroughfare Commercial District, to -wit: A part of the Northwest Quarter of the Northeast Quarter of Section 28 in Township 16 North Range 30 West. Beginning at a point which is 250 feet South 140 West of a point which is 29 5/6 Rods East of the Northwest corner of said 40 acre tract. The present agreement under its first option expires on December 21, 1968 terms of this agreement the Licensee has the right to use the airport and all facilities, " in ized so to do, " for: 1. Operation of a transportation system 2. Landing, parking, servicing, testing, and leading of aircraft of licensee and 'of others. 3. Provide training flights. 4. Install, maintain use, and operate radio equipment and navigation equipment necessary for operation 5. Any other activity related to air transportation or training. addition, the licensee is leased the large hangar and two shop buildings and surrounding area including ,on. Further, the licensee has "the exclusive right to make sales of aviation gasoline.... from the gasi ips located" near'the large hangar. The licensee also has the right to conduct a rent -a -car service if perly licensed by the City. ' consideration of the above, the licensee shall 1. Act as Airport Manager 2. Keep all grass mowed west of the runway to U. S. 719 500 feet beyond the ands of the runway, and feet east of the runway. 3. Make the following payments to City: a. $100 per month for buildings and grounds b. $0.30 per daily scheduled trip of Scheduled Skyways c. $0.01 per gallon of gasoline sold except to commercial carriers. This new license agreement could include sale and servicing radios, charter service, sale of gasoline, etc. Such a request for lease and license has been made by Noark Commander Aviation owned by John Mahaffey and Associates, Inc. of Fayetteville. bark Commander Aviation wishes to lease about four (4) acres of property from the City, located to the f the Flight Service Station Building in order to establish a fixed base operation to (a) sell aircraft arts; (b) repair aircraft and radios; (c) demonstrate and instruct in aviation; (d) provide charter ser e) sell aviation fuel and (f) operate a snack bar. Lease four (4) acres of property for $1 per year. 2. Term of lease to be twenty (20) years with options to renew at renegotiated terms. 3. Firm to construct at least forty thousand dollars ($40,000) of improvements on property commenc within ninety (90) days after lease executed and completing within six months after execution. 4. Plans for all improvements approved by City prior to construction. 5. Firm to construct necessary access roads, ramp area, taxi strip and parking area. 6. All land improvements shall be property of the City. All buildings shall become property of the City upon expiration of the lease, with the firm having rights to remove the buildings prior to expiration of twenty years from the premises. 7. Lessee shall make following payments to the City: a. 8% of all revenue received from aircraft storage, tie -downs and parking fees. b. 4% of revenues received from operation of snack bar or restaurant. c. 80% of all landing or take -off fees charged by the City and collected by lessee. d. $0.01 per gallon of gasoline sold which may be adjusted from time to time. 8. Proper liability, fire and casualty insurance carried by the lessee. These terms are similar to those between lessees and lessors in Little Rock. If the City Board believes) that such a fixed base operator's lease would be in the best interest of the City, then I would recommem that you authorize the City Attorney and City Manager to prepare a lease or license agreement based upon the terms and conditions as contained in this memorandum to be considered and executed by the City and Noark Commander Aviation. Representatives of this firm and others will probably be in attendance in order to discuss this matter. A long discussion was held, during which the Directors requested more time to study this, action was postponed until a later date. Manager reported that bids had been received and tabulated for the purchase of a tractor -mower and he recommended the purchase of the one by Huenefield Equipment Company for the total cost of $3,567.1 Director Melton moved to accept the recommendation of the City Manager and purchase the tractor -mower from Huenefield Equipment Company at a cost of $3067.11. The Motion was seconded by Director McFerran and passed unanimously. Memo No. 116 The Administrative Memo No. 116 was spread on the Minutes and reads as follows: Budget Changes You have received.the six months financial report of the City including all funds except Water and Sewer As a result of this report, I am recommending the following changes in the several fund and department budgets. I. GENERAL FUND A. Revenues - Generally revenues are in excess of budget estimates for the first six months.
