24'7 RESOLUTION 6-68 Resolution A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF CERTAIN LANDS IN WASHINGTON COUNTY, ARKANSAS, No. 6 68 FOR USE AS EASEMENTS FOR RELOCATION OFWATER AND SEWER LINES NECESSARY FOR HIGHWAY 71 LOOP CONSTRUCTION. ' BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City Attorney is hereby authorized and directed to institute condemnation proceedings to acquire the necessary lands for easements for relocation of water and sewer lines as described in the final construction plans of J. E. McClelland, Consulting Engineer, as fouhd necessary for U.S. 71 Loop Job /9447, named property owners: C. Lorain Barnes and Dena Barnes, husband and wife Frank S. and Martha Leach, husband and wife; Martha Shipley.Leach, in her own right; Frank S. Leach Jr., a single man; and Emily Grace Leach, a single woman. SECTION 2. That as the questions in controversy in said condemnation proceedings are likely to retard the progress of the proposed construction of said water and sewer relocations and consequently the 71 Loop, the City Attorney is further authorized and directed to petition the Court for permission for the City to provide appropriate deposits in court for making comnensations and payment of damages, in order that immediate possession of the said lands may be secured and in order that construction may be commencedand proceed prior to assessment and payment of damages. WHEREAS, A public hearing was held before the Planning Commission of the City of Fayetteville, Arkansas, on Tuesday, February 201 1968, on the petition of McGoodwin, Williams and Yates, Inc., requesti, that said Planning Commission recommend to the Board of Directors of the City of Fayetteville, Arkansas, that the Board of Directors enact an orcinance rezoning the following described property, presently zoned R -lb, Single Family Residential District,and C-2, Thoroughfare Commercial District, to all C=13 Neighborhi I District, to=wit: 14 Lot One (1) and Two(2), Block Six (6), Oakland Hills Addition to the City of Fayetteville, Arkansas, Ordinance No. 1587 Cont. The minutes of the regular meeting on Monday, February 19, 1968, a copy of which had previously been mailed to each of the Directors, were approved as written. The City MAfiagerypresented the petition of McGoodwin, Williams, and Yates, Inc. to rezone certain property an the Oakland Hills Addition, which had been approved by the Planning Commission. Petition by Several Citizens of that area together with their attorney, John E. Butt, appeared before the Directors McGoodwin & Co. in opposition to the rezoning and requested more time (two weeks) in which to prepare their arguments for to rezone certain their opposition to this rezoning. property in I Mr. L. M. McGoodwin presented maps showing the location of the property in question and the preliminary Oakland Hills plans for the building to be located on the property. Compang) After a ver�ylong discussion, the City Attorney introduced and, at the request of the Mayor, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE NC 12391 AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, APPROVED MAY 289 19621 TO REZONE CERTAIN REAL ESTATE FROM R -1B, SINGLE FAMILY RESIDENTIAL DISTRICT AND C-20 THOROUGHFARE COMMERCIAL DISTRICT, TO AI C-1NEIGHBORHOOD COiOIERCIAL DISTRICT". Director Christie moved that the rule be suspended and that the Ordinance be placed on the second reading. The motion was seconded by Director Kerlin and upon roll call the following vote was recorded, "Aye" ; Ordinance No. Kerlin, McFerran, Melton, Christie, Trumbo, and Dunn. 1587 1"Nay" None.' There being Six "Ayes" and No "Nays", the Mayor declared the motion passed. The Ordinance was then read for the second time. Director Christie then moved that the rule be further suspended and the Ordinance placed on the third and final reading. The motion was seconded by Director Melton and upon roll call the following vote was recorded, "Aye" Kerlin, McFerran, Melton, Christie, and Trumbo. "Nay" Dunn. There being Five "Ayes" and only One "Nay", the Mayor declared the motion passed. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. After another long discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call th following vote was recorded, "Aye" Kerlin, McFerran, Melton, Christie, and*Trumbo. Director Swartz gave a Report On Growth Cities Seminar which was spread on the minutes and reads as follows: REPORT ON GROWTH CFffiE8 SEMINAR Report o l Director Swartz, on Growth Tulsa, Oklahoma - March 3 and l„ 1968 of Cities. In the present overwhelming trend toward urbanization, some of the great needs of cities are greater involvement of citizens in government and increased concern in the needs of people. City governments must learn to be more efficient in their use of revenues. Sources of revenues for cities need to be re-examined and increased. Sources of revenues were explored and these suggestions were made: A city income tax was suggested as a desirable and valuable source for additional income. Only eight states permit its use at the present. It is usually one percent of, monies earned (with very, few, exemptions or deductions). It is levied against in- come earned within the city and therefore reaches people who use the facilities and benefit from the advantages of the city. It ,yields about 1/2 to 1/3 of the amount produced by the property tax. It is used by 141 cities in Ohio and Fennsylania, where it is most widely used. A city sales tax is permitted in 18 states. It is usually collected with the state sales tax and refunded to the city. There is not as much dissatisfaction with a sales tax as with other taxes. It is relatively simple to collect. People pay a little at a time, they are accustomed to pay on the installment method and do not resent it as much as other forms of taxation. Property taxes yield about 57% of tax monies. It was suggested that the assessments of land be increased and assessments on buildings be decreased. Buildings depreciate rapidly in value, land values are more stable and are easier to assess equitably. This would tend to discourage urban sprawl which has become a problem in U. S. cities.. It would help alleviate some other city problems. There is constant need however for equalization of assessments. It was brought out that private capital should accept more responsibility in government and should be more concerned about the needs of people. Many crises have arisen in our cities because of the indifference of business toward the needs of people. There is a definite trend toward urbanization caused by the growth of.business::>Business and capital therefore need to accept their share of responsibility toward a-l-lev'iating or solving some of these problems of the cities which are of their creation. '4e can no longer be indifferent toward the government of cities and the cultural development of their citizens. If GROWTH CITIES continue to grow, they must face some of these problems realistically.
