Regular me ting. The Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Monday,
January 15, 1968, at 7:30 P. M. '
Present: City Manager Gerald G. Fox, City Clerk George J. Davis, City Attorney Hugh Kincaid, and
T.J.Keith, Rep. of. Directors: Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn.

The minutes of the regular meeting on Tuesday, January 2,.1968, a copy of which had previously been m
to each of the Directors, were approved as written.
Plaque presented
to Carl Smith. The Mayor at this time, on behalf of bhe Board of Directors and the City of Fayetteville, presented a
Plaque to W. C. (Carl) Smith as appreciation for his long and faithful service as City Engineer and
Water & Sewer Superintendent for the City of Fayetteville, Arkansas.
The City Manager introduced and, at the request of the Mayor, read a proposed resolution entitled,
"A RESOLUTION AUTHORIZING THE FAYETTEVILLE, ARKANSAS, MAYOR AND CITY CLERK TO EXECUTE AN EASEMENT DEED T,
LANDS WHEREIN THE CITY OF FAYETTEVILLE, ARKANSAS, IS THE GRANTOR AND THE ARKANSAS STATE HIGHWAY COMMISSD
IS THE GRANTEE!'.
Director McFerran moved that the Resolution be adopted. The.motion was seconded by Director Christie and
upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Melton, Christie, Trumbo
and Dunn.

NOW, THEREFORE, BE IT RESOLVED BY THE MEMBERS OF THE CITY BOARD OF DIRECTORS OF THE CITY OF FA
ARKANSAS:
The Mayor is hereby authorized and directed to execute for and on the behalf of the City of F,
Arkansas, and the City Clerk is authorized and directed to attest the recited.Easement Deed to the
Arkansas State Highway Commission.
Upon the execution of the Easement Deed referred to, the City Clerk of Fayetteville, Arkansas, is
hereby authorized and directed to deliver the same to the Arkansas State Highway Commission.
This Resolution shall be in full force and effect from and after its adoption.

A RESOLUTION AUTHORIZING AND DIRECTING THE CONDEMNATION OF EASEMENTS IN CERTAIN LANDS IN WASHINGTON COUNTY,
ARKANSAS, FOR USE IN CONSTRUCTION, INSTALLATION AND MAINTENANCE OF A 30 INCH, SANITARY SEWER TRUNK LINE,
WPC -ARK 2160 AND APPURTENANCES THERETO.
WHEREAS, the City of Fayetteville,.Arkansas is in the process of constructing Sanitary Sewer Improv
Project, WPC-ARK•2160 necessitating rights of way and easementslover certain lands in Washington County
Arkansas, for construction, installation and maintenance of a 30'inch sanitary sewer trunk•line, being
constructed under said project.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF•FAYETTEVILLE, ARKANSAS:
SECTION 1. That for the purpose of constructing, installing and maintaining (and as more fully set
ofrth in the contract documents) a 30 inch.sanitary sewer trunk line and all appurtenances thereto, purs
to Sanitary Sewer Improvement Project WPC -ARK 216, the necessary easements and rights of way in the land
of Fannie Walker be entered upon and taken by eminent domain and the City Attorney is hereby authorized
directed to institute condemnation proceedings to acquire said easements and rights of wap in the manner
required by law.
SECTION 2. That as the questions in controversy in such proceedings are likely•to retard the progr
of •said construction, the City Attorney is fdrther authorized and directed to•Detition the Court for
permission to provide an appropriate deposit with the registry of the Court for making compensation and
payment of damages, in order that immediate possession of said easements and rights of way may be secure
and construction proceed prior to assessment and payment of damages.

The City -Manager presented Administrative Memeo #91 in regard to UTILITY RELOCATIONS -HIGHWAY 71 LOOP
which was spread on the minutes and reads as follows:

Utility Locltions UTILITY RELOCATIONS - HIGHWAY 71 LOOP
on Highway No. 71
Loop Several months ago, the City Board authorized J.E. McClelland, Consulting Engineer, to proceed with
preparation of plans for relocation of water and sewer utilities to permit construction of Highway
71 Loop. These plans were completed and submitted to the Arkansas Highway Department in early
December. In late December, I executed a relocation agreement with the Highway Department establishing
terms and conditions for relocation of utilities and also for reimbursement of costs. The City
is eligible to receive back as reimbursement total construction, engineering and land costs for all
lines or parts of lines which presently lie outside highway right of way but have to be replaced
because the construction would interfere with them, The City will have to ,remove and relocate, at its
expense, all utility lines which lie presently within highway rights-of-way.
Total estimated costs for engineering, inspection, construction and land for rights of way is $139,976.
of which $9,450.00 is for engineering and inspection, $117,226 for construction, and $13,300 for
land. Of this amount, approximately $122,253 would be reimbursable from the state Highway Department -
and $1,086 from Suburban Water District $5. The City's net cost in this utility relocation would
therefore..be in the vicinity of $16,600. Much of this cost to the City is involved in (1) placing
utilies across right of way for future use with oonsiderable cost saving and (2) increasing the size
of mains across right of way -,for 'future growth. • •
Although final approval of the Relocation Agreement 'has not been received from the State Highway
Department, we are expecting this momentarily along with authorization to call for bids on the
project. As the next meeting of the Board is not for three (3) weeks, I would request ,your
authority to set a bid opening date on this project immediately upon receipt of authorization to do
so from the State Highway Department,

Appointments to The City Manager reported that the terms of William Brandon, Dr. Rodney Ryan .and Benny Winborn on the
Parks & Recreation Parks and Recreation Advisory Committee would 'expire on February 1, 1968, and he recommended they be
Advisory Committee, reappointed for two year terms.
Director Melton moved to accept the recommendation of the City Manager and reappoint William Brandon,
Dr. Rodney Rggn and Benny Winborn as members of the Park and Recreation Advisory Committee for two
year terms expiring February 1, 1970.
The motion was seconded by Director McFerran'and passed unanimously.
The City Manager requested authority to advertise for bids for the following equipment:
Authorize City Motor Grader, Tandem Roller, Loader -Diggers, Heavy Duty Trailer, and Paint Striper to be received
