The Board of Directors of the City of Fayetteville, Arkansas, met in apgalat session on Thursday,
November 30, 1967, in the Directors Room in the City Administration Building at 7:90 P. M. CST.
Presbnt: City Manager Gerald G. Fox,.City Clerk George J. -Davis, City Attorney Hugh Kincaid, and Board
Members: James T.Kerlin, Sylvia Swartz, Joe McFerran, Garland Melton, Jr., Arnold Christie, Don Trumbo(MayOr),
anddDale Dunn.
Absent: None.
The Mayor reported that the purpose of the meeting was to consider a resolution levying a motor vehicle
and calling a special elections to vote on such levy; to discuss with utilities the possible increase in
franchise taxes for 1968; to discuss and consider an occupation tax; and for other purposesg and that al
of the Directors had been notified by U. S. Mail and by telephone.
A long discussion was held with representatives of the Southwestern Electric Power Co. relative to incre
the franchise rates of the utilities companies but no action was taken at this time.
The City Manager introduced and,at the request of the Mayor, read a proposed resolution in its entirety
entitled, "A RESOLUTION LEVYING A MUNICIPAL MOTOR VEHICLE TAX FOR THE YEAR 1968 UNDER AUTHORITY OF ACT
446 OF 1965 AS AMENDED; PROVIDING FOR THE PROCEDURE FOR THE COLLECTION OF SUCH TAX; AND FOR OTHER PURP061
After a long discussion, Director Christie moved that the Resolution be adopted.
The motion.was seconded by Director Kerlin and upon roll call the following vote was recorded, "Aye"
Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn.
"Nay" None(
There being Seven "Ayes" and No "Nays", the Mayor declared the Resolution adopted.
RESOLUTION NO. 18-67
A RESOLUTION LEVYING A MUNICIPAL MOTOR VEHICLE TAX FOR THE YEAR 1968 UNDER AUTHORITY OF ACT 446 OF 1965
AS AMENDED: PROVIDING FOR THE PROCEDURE FOR -THE COLLECTION OF SUCH TAX; AND FOR OTHER.PURPOSES.
BE IT RESOLVED BY THE BOARD OF_.DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. A Municipal Motor Vehicle Tax is hereby levied fdr the year 1968 upon the owners of all
motor vehicles within the corporate limits of the ity of Fayetteville, Arkansas, -for the privilege of
using and operating said motor vehicles upon the public roads, streets and other public ways of the
city. That such tax shall become effective upon approval by the qualified electors of the City of
Fayetteville at an election to be called on December 21, 1967.
SECTION 2. The amount of such tax of such motor vehicles shall be as follows:
For allmotor vehicles with four (4) or more wheels (including but not limited to automoblies, busses,
trucks taxicabs, ambulances, etc.) $2.00 per year
for all motor vehicles with three (3) or less wheels (including but not limited to motorcycles, motor
scooters, motor bikes, etc.) $2.00 per year.
SECTION 3. The vehicle tax shall be due and payable, without penalty, during the month of January of
1968. Penalty for delinquent payment of the tax shall be One Dollar ($1.00) per vehicle per month for
each month's delinquency; and any owner of any such vehicle, delinquent in the payment of the vehicle
tax for more than five (5) months, who thereafter shall use and operate anyy such vehicle upon the
public roads, streets and other public ways within this municipality or who shall knowingly permit the
same to be so used or operated by another, shall be guilty of a misdemeanor and upon confivtion, shall
be fined andy sum not less than Twenty-five collars ($25.00) and not more than ifty Dollars ($50.00)
for each violation; and the fine so assessed shall be in addition to the aforementioned tax and penalty.
SECTION 4. The owner of any such vehicle, first acquired of first used in this municipality after July
1 shall be required to pay.only one-half () of the annual rate of the vehicle tax for the remainder of
the calendar year, and such tax may be paid without penalty, during the thirtIr(30) day period next fol
owing the date of such first acquisition or first use. Provided that no such tax shall be required of
the qwner if the vehicle tax (under Act 446 of 1965 as amended) for 1968 has been paid by a former
owner, in any county or municipality in the state.
SECTION.5. The owner of a.vehicle having paid the vehicular tax in any county or minicipality in th$frs
state (under Act 446 of 1965 as amended) for the year 1968, shall mot be required to pay the vehicle tax
for use of the same vehicle in this minicipality for the year 1968.
SECTION 6. The City Controller is hereby designated as the Collector of this tax. Consecutively number
receipts.printed in duplicate shall be used by the Collector in acknowledging payment of the tax. Each
receipt shall have printed on it the name of the minicipality, the name of thettax, the year of the tax
and space indicating the name and address of the taxpayer, the date of payment, the amount of tax, the
amount of penalty, and the total amount collected, the make and year model of the vehicle, the state mo
vehicle license number for the year 1968, and the space for the signature of the collector.
At the time of issuing his receipt, the collector shall also deliver to the taxpayer a windshield stick
a metal tag or othertype of indentification to be attached to the vehicle by the owner. A separate
receipt aha11.4be4*9ued for each vehicle, the original of which shall be given to the taxpayer at the
time of the payment of the tax, The duplicate receipt shall be retained by the Collector for accounting
and auditing .purposes.
SECTION 7. For the purpose of sugregating and keeping apart the revenues derived from the vehicle tax
from the other revynues of the municipality, there shall be establiched a separate account styled
"Fayetteville Minicipality Vehicle Tax Account", in a bakk that is an authorized depository of the
minicipal funds and all revenues derived from the tad shall be deposited in said separate account.
Whithdrawals shall be made from said separate account only for the purpose of paying the cost of
duplicate receipts, windshield stichers, or other types of identification to be attached to vehible as
required hereunder, payment of the "ollector's Uommission if any, and thereafter transmitted to the
Treasurer of this minicipality. The Treasure shall credit such funds received by him from the vehicle
Tax Account to the General rued, there to be used for tlmbulance,Operations; Public Works �und to be
used for street purposes.

The minutes of the regular meeting on Monday, November 20, 1967, and of the special session on Thursday,
November 30, 1967, copies of which had previously been mailed to each of the Directors, were approved
as written.
The City Attorney introduced and, at the request of the Mawr, read a proposed ordinance in its entirety
for the first time,.entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL EASEMENTS IN

HARRIS ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS".'
Director Christie moved that the rule be suspended and that the Ordinance be placed on the second readini
The motion was seconded by Director Kerlin and passed unanimously.
The Ordinance was then read for the second time.
The Mayor then declared the Ordinance open for discussion. Etter a brief discussion, Director Christie
moved that the rule be further suspended and the Ordinance placed on the third and final reading.
The motion was seconded by Director Berlin and passed unanimously.
The Ordinance was then read for the third and last time.
The.Mawr then asked the Question, "Shall the Ordinance pass?"
Upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Christie, and Trumbo.
"Nay" None. .
There being Five "Ayes" and No "Nave"!F the Mawr declared the Ordinance passed.
ORDINANCE N0. 1577
N ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL EASEMENTS IN HARRIS ADDITION TO THE CITY OF
AYETTEVILLE, ARKANSAS.'
WHEREAS, there has been duly presented to the Board of Directors of the City of Fayetteville,
ansas, a plat dated November 30, 1967, known as the Harris Addition to the City of Fayetteville,
which the owners have dedicated for the public use easements as shown upon said plat; and
WHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has.recommended the
stance of said plat.
NOW, THEREFORE, BE IT ORDAINED.BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the plat and the
cation of all easements in the Harris Addition to the City of Fayetteville, Arkansas, and hereby
ares said easements to be public easements and the Board of Directors hereby assumes care, control,
jurisdiction of the same. .
SECTION 2. That this ordinance shall be in full force and effect from and after.its passage, approva',
nd publication.

TERRITORY DISTRICT, TO R-3 MULTI -FAMILY RESIDENTIAL DISTRICT".
Director Christie moved that the rule be suspended and the Ordinance placed on the second reading.
The motion was seconded by Director Swartz and passed unanimously.

moved that the rule be further suspended and the Ordinance placed on the third and final reading.
The motion was seconded by Director McFerran and passed unanimously.

APPROVED MAY 28, 10'62, TO REZONE CERTAIN REAL ESTATE FROM A-1 ANNEXED TERRITORY DISTRICT, TO R-3 MULTI-

WHEREAS,�a public hearing was held before the Planning Commission of•the City of Fayetteville,
Arkansas, on Tuesday, November 28J 1967, on the petition of B. A. Shamblin, Agent for the Owners, and
Hare Associated, Limited, requesting that said Planning Commission recommend to the Board of Directors of
the City of Fayetteville, Arkansas, that the Board of Directors enact an ordinance rezoning the following
described property, presently zoned A-1 Anexed Territory District, to R-3 Mulit-Family 8esidential gistrict,
