Davis, City Attorney Hugh Kincaid, and Dire Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn. Absent: None. The minutes of the regular meeting on Monday, May 1, 1967, a copy of which had previously been mailed to each of the Directors, were approved as written. The City Attorney introduced and, at the request of the Mayor, read a proposed ordinance in its entirety entitled, "AN ORDINANCE AMENDING SECTIONS 6-75 AND 6-76 OF THE FAYETTEVILLE, CODE OF ORDINANCES, TO PERMI MOVEMENT OF CERTAIN METAL STRUCTURES INTO THE FIRE LIMITS, AND TO PERMIT ERECTION OF „OR ADDITIONS TO, CERTAIN WOOD FRAME OR MASONRY VENEERED RESIDENCES AND THE USE OF CERTAIN NON-COMBUSTIBLE WALLS OR PANELS WITHIN THE FIRE LIMITS, AND TO DELETE AND MODIFY CERTAIN EXCEPTIONS TO RESTRICTIONS ON MOVEMENT OF STRUCTURES INTO AND USE OF CERTAIN STRUCTURES IN THE FIRE LIMITS". ORDINANCE N0, 1544 ORDINANCE AMENDING SECTIONS 645 AND 6-76 OF THE FAYETTEVILLE CODE OF ORDINANCES, TO PERMIT MOVEMENT RTAIN METAL STRUCTURES INTO THE FIRE LIMITS, AND TO PERMIT ERECTION OF, 08 ADDITIONS T0, CERTAIN WOOD AME OR MASONTY VENEERED RESIDENCES AND THE USE OF CERTAIN NONoCOMBUSTIBLE WALLS OR PANELS WITHIN THE ] MITS, AND TO DELETE AND MODIFY CERTAIN EXCEPTIONS TO RESTRICTIONS ON MOVEMENT OF STRUCTURES INTO, AND , CERTAIN STRUCTURES IN THE FIRE LIMITS. WHEREAS, by Ordinance No. 1120 of December 17, 19660 the 1955 Edition of the National Building Code adopted by reference, subject to certain amendments to said Code also contained in Ordinance No. 1120 t Ordinance 1120, including the amendments to said Code, now appear in codified form as Sections 6 -34 - the Fayetteville Code of Ordinances, and'. WHEREAS, it now appears that said Building Code, as amended, is unduly restrictive as it relates to movement of certain metal structures into the fire limits, the erection of addition to certain wood me and masonry veneered residences within the fire limits, and the use of certain non-combustible wall panels within the fire limits; and it now appears that certain amendments to said Code pertaining to t'. ementsof residential:garages into the fire limits and the construction of certain structures in the fi its are no longer desirable and should be deleted; and the Building Inspector has recommended the ndment of the Building Code to affect theseschanges. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTCRS OF THE CITY OF'FAYETTEVILLE, ARKANSAS: SECTION 1. That Section 6-75 of the Fayetteville Code of Ordinances be amended by deleting the age of said Section and substituting the following: Sec. 6-75. Section 400.3 amended. Section 400.3 is amended to read as follows: 11400.3. Moving bisdldings. "(1:) No'building or structure of wood frame construction or unprotected rioncumbustible construction shall be moved from withogt to within the fire limits or from one lot to another lot within the fire limits or from one location on the same lot within the fire limits except$ (1) That moveable metal buildings with metal frames and coverings may be moved with the fire limits when used for cafe purposes. (2) That metal house trailers may be moved within the fire limits provided they are located in an established trailer court or mobile home park." each 1 lJ Ordinance Nd. 1544 1 (Cont.). 1 Ordinance . 1545 1451 SECTION 2. That Section 6-76 of the Fayetteville Code of Ordinances be amended by deleting the ent language of said Section and substituting the following: Sec. 6-75, Section 400.5 amended. Paragraphs (m) and (n) are hereby added to Section 400.5, entitled " Exceptions to restrictions within fire limits-", to read as follows: "(m) Single family and duplex family dwellings of wood frame or masonry veneered constructton not exceeding two stevies in height may be erected or additions made thereto when located in the fire limits provided inside partitions, walls, and ceilings have a fire resistance, rati, of not less than one -(I) hour. (n) Noncombtstible walls or panels may be permitted in exterior non-bearing walls in the limits under the following conditions: (1) Provided such walls are of non-combustible material. (2) Provided such walls face a street or permanent open space of thirty (30) feet or in width. ' (3) Provided all other such walls that do not face a permanent open space of thirty(30) feet or more in width meeet the non-bearing wall requirements of ordinancy type constru as set out in the City Building Code." SECTION 3.' That nothing contained in this ordinance whlll be construededs affecting, repealing or amending any provision of the ordinances of the City of Fayetteville, save for the Sections of the Fayetteville Code of Ordinances specifically amended herein. SECTION 4. That this ordinance shall be in full force and effect from and after its passage , approval and publication. After a lef*thy discussion, Director Melton moved that the City Manager be authorized to employ a collec service for the collection of delinquent ambulance accounts as outlined in Administrative Memo #55. The motion was seconded by Director Swartz and upon roll call, the following vote was recorded: °Aye", Ker1ln,Swartz, McFerran, Melton,Trumbo, and Dunn. "Nay" Christie, hre being six "Ayes" and only one "Nay", the Mayor declared the motion passed. y Administrative Memo #55 was spread on the minutes and reads as follows: COLLECTION PROCEDURE FOR DELINQUENT AMBULANCE ACCOUNTS Attached to t1Ms memo you will find a detailed summary of ambulance aservice billings aid collections April of 1967. We will present to you each month such a breakdown so that you might be apprised of the I ondition of the operations. ordinanI delinquent L� You will note the first three months of our operation (October through December) has resulted in an 82% collection, refore, there is remaining just under $900 in accounts receivable which are 120 days or over old. The urer.�xc.; ide city limits and outside city limits breakdown is also quite interesting. This breakdown is by the originati.cA the ambulance trip either outside or inside and not by where the person resides. Our collection procedure has been as follows: (1) Original statement for ambulance service sent out about seven to ten days after the incident. (2) After accounts are at least thirty. (30) days old, letters are sent out under my signature re or notification if insurance is being processed. This letter indicates that other action might ting payment) required. This procedure has proved to be quite effective, but of course there will always be a few who will makelno effort pay the charges. It is for the 20% or so who will not pay (as the averages look right now) that I would like you consider adding a step to our collection procedure. This would be the employment of a collection service to .tact and hake efforts to collect all accounts receivable over one hundred twenty (120) days old which apparently not being processed for insurance.. I have asked and received.proposals from Banks Creditor Service and Northwest ansas Collection Service, both of Fayetteville to handle collection of 120 day old accounts. Both present about same proposal: (1) A fee of 33 1/3% will be charged for all accounts collected which are $10 and over. (2) A fee of 50% will be charged for all accounts collected which (A) Are under $10. (b) Are over 180 days old. (c) Must be forwarded to agents in other cities for collection. (E) A Yee of $2.50 will be charged if account is found to be under insurance claim. (4) If suit is filed for judgment, city to advance court costs. . Ambulance After a lengthy discussion, Mayor Trumbo moved to appoint Bill Morton to the Regional Airport Steering G Biils The motion was seconded by Director Christie and passed unanimously. Administrative Memo #56 was spread on the minutes and reads as follows: Morton ttee APPOINTMENT TO REGIONAL AIRPORT STEERING COMMITTEE per prior authorization of the City Board of Directors, a meeting of City, County, Chamber and other int ties on Regional Airport development was held on May 9. About twenty-five (25) people attended this mem discuss alternate methods of organizing a regional airport authority and to discuss Agreement terms for hority under Act 430 of 1967 (Interlocal.Cooperation Act). [r.r Lttee. g primarily I Airport 14'7 After much discussion, it was unanimously decided that this meeting would recommend to the governing bo land county judges that appointments be made to a steering committee composed of eight members with a ni member to be selected by theeight. This nine member steering committee would prepare and recommend to five cities and two counties .an Agreement to create, fund and designate powers to a Northwest Arkansas ' Regional Airport Authority. •It was anticipated by those at this meeting that the nine member steering committee would become the first regional airport authority with the same representation as now designs lAppointments to the steeling committee would be as follows: one each by the governing bodies of Bentonvi. Airport Steering Fayetteville, Rogers, Siloam Springs and Springdale for five members; one by the Benton County Judge and ' Committee I by the Washington County Judge for three and a total of eight.- This would be.divided four from each coup (Continued) These eight would then select a ninth member. City Manager•Gerald Fox was also asked to act as temporary chairman of the steering committee until it can organize and select its own presiding officers. t would be myrecommendation•that the City Board of Directors proceed with appointment of one person to egional Steering Committee. Because the initial stages of this Regional Airport Authority are going to ' he most impobtant, that is, formulation of the agreement, site selection, financing of construction, etc t would seem to me that someone directly connected with the city ought to be appointed. This could be omeone from the City Board•itself or someone from the administrative staff. Your action on this matter 311 be appreciated. Workable Program & . for Community Difector Melton moved that the Workable Program for Community Improvements Recertification be approved fo: *Improvement s ' submission to the Department of Housing and Urban Development. (Recertification) The notion was seconded by Director Swartz and passed unanimously. There being no further business, Director McFerran moved to adjourn. Rezoning Deferred (Cleveland Street) The City Manager presented the petitions from the Delta Nu House Corporation of Kappa Alpha Theta and of the Phi Mu Alumi Chapter for rezoning certain property on West Cleveland Street from R -IA to R-4, which had been approved by the Planning Commission. A large grown of citizens living in that area appeared before the Directors in opposition to the rezoning and after a brief discussion, Mrs. Fowler and Mrs. Broyles, representing the Sororities, requested that the petitions be tabled until a later date. Director Christie then moved that both petitions be tabled and that a notice of two ireeksbbe given in the Northwest Arkansas Times before being brought before the Directors again, as requested by Mrs. Fowler and Mrs. Broyles. The motion was seconded by Director Kerlin and passed unanimously. Director Melton then, with the unanimous approval of the other Directors, requested that President Mullis Select Commmttee on Planning be contacted and that a written statement be obtained from them as to where they visualize the proper location of new Sororities and Fraternities for.the fpture development are ' supposed to be located.
