No 123 The Board of Directors of the City of Fayetteville, Arkansas, met in -regular session on Monday, March 20, 1967, at 7:30 P. M. in the Directors Room in the City Administraibn Puilding. Present: City Manager Gerald G. Fox, City Clerk George J. Davis, City.Attorney Hugh Kincaid, and Directors: Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn. The minutes of the regular meeting on Monday,March 6, 1967, and of the special meeting on Tuesday, March 1967, copies of which had previously been mailed to each of the Directors, were approved as written. The City Attorney presented a Court Order from the County Court of Washington County, Arkansas, certain territory to the City of Fayetteville, Arkansas. After a brief discussion, the City Attorney introduced and, at the request of the Mayor, read a ordinance in its entirety entitled, "AN ORDINANCE ACCEPTING TERRITORY TO THE CITY OF FAYETTEVIL ASSIGNING SAID TERRITORY TO WARDS, AND FOR OTHER PURPOSES". Director Christie moved that the Ordinance pass. The motion was seconded by Director Melton and gponseollacall the following vote was recorded, Kerlin, Swartz, McFerran, Melton, Christie, Prumbo, and Dunn. "Nayty None. There being Seven "Ayes" and No "Nays", the Mayor declared the Ordinance passed. annexing "Aye" 1532 ORDINANCE NO, 1532 AN ORDINANCE ACCEPTING TERRITORY TO THE CITY OF FAYETTEVILLE, ARKANSAS, ASSIGNING SAID TERRITORY TO IdARDS, AND FOR OTHER PURPOSES, 1 WHEREAS, on January 30, 1967, the County Court of Washington County, Arkansas, entered an order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: Lots Seven (7) through Twelve (12) inclusive, in Block Three (3) of Parker's Plat of Valley View Acres Addition, as per plat on file in the office of the Circuit Clerk and Ex -Officio Recorder for Washington County Ar4ansas. i ALSO, Lots One (1) through Ten (10) inclusive, in Block Two (2) and Lots One (1) through Six (6) inclusive, ' in Block Three (3), of Parker's Plat of•Valley View Acres Addition, as per plat on file in the office of the Circuit Clerk and Ex -Officio Recorder for Washington County, Arkansas. ALSO, Lots Three (3) and the North half (N 1/2) of Lot Six (6) in Evins Farm Addition, and Addition to the City of Fayetteville, Arkansas. Containing in aggregate 39.2 acres. and, WHEREAS, more than thirty (30) days have elapsed since the date of said order of annexation and no proceedings have been instituted in the Circuit Court to prevent said annexation, and no notice of appeal has been filed; and, !^!HEREAS, on March 6, 1967, the County Court of 'Washington County, Arkansas, entered an order confirming such annexation proceedings-. WHEREAS, A -public hearing was held before the--Flanning.Commission of the City of Fayetteville, Arkansas, on February 28, 1967, on the petition of G. C. Thomas and W. 0. WHEREAS, Johnny James of Springdale, Arkansas, has submitted the low bid for construction of the 969, ter Treatment Plant, in the sum of $1,850,848.69, and WHEREAS, Southard Engineering Company of Springfield, Missouri, has submitted the low bid for constr of the 36" Outfall Sewer and Plant Water Line, in the sum of $1,005,000.00, and WHEREAS, both of said bidders appear to be responsible, well qualified and capable of constructing t: facilities planned, anddit is in the best interest of the City of Fayetteville, Arkansas, to accept said bids. Said lease agreement between the City of Fayetteville, Arkansas, and Washington County, Arkansas, to extend for a term of five years. After a brief discussion, Director Dunn moved to approve the lease agreement for the parking lot and that the Mayor and City Clerk be authorized to execute the lease•agreement. The motion was seconded by Director Kerlin and•passed unanimously. A copy of the lease agreement was spread on the Minutes and reads as follows: LEASE AGREE1v5ENT THIS LEASE AGREEMENT, made and entered into on this the 22nd day of March, 1967 by and between the County of Washington, herein called Lessor, and the -City of Fayetteville, a municipal corporation, herein called Lessee, WITNESSETH: 1. Lessors have agreed and do hereby agree to the lease and let to the Lessee 'the following described real estate situated in the City of Fayetteville, Washington County, Arkansas, and more particularly described as follows, to -wit: All the existing parking area lying between the existing Washington County Courthouse (now situated on the east side of Coliege Avenue at the intersection of Center Street) and the Arkansas National Guard Armory Building on the east and between Center Street and the Arkansas National Guard .Building on the south, said lot being approximately rectangular in shape with an east -west dimension of aprroximately 48 feet and a north -south dimension of approximately 14A feet. for a term of five (5) #ears, beginning the 22nd day of March, 1967, and ending on the 22nd day of Narch,1972.1 126 IA IA e F.
