Regular The Board of Directors of the City of Fayetteville; Arkansas, met in regular session in the Directors
Meeting Room in -the City Administration Building on Monday, January 16,-1967, at 7:30 P. M.
Present: City Manager Gerald G. Fox; City Clerk George J. Davis, City Attorney Hugh Kincaid, and
Directors: Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn.
Absent: None.
' The minutes of the regular meeting on Tuesday, January 3, 1967, a copy of which had previously been mail
to each of the Directors, were approved as written.

The City Attorney introduced,and, at the.request of the Mayor, read a proposed resolution in its entiret3
Resolution entitled, "A RESOLUTION EXPRESSING THE INTENTION OF THE BOARD OF DIRECTORS TO PROCURE TREATED WATER FROM
No. 1-67 THE BEAVER WATER DISTRICT RESERVOIR"•
Director Dunn moved that the Resolution be adopted.
The motion was seconded by Director McFerran and'upon roll call the following vote was recorded,
"Aye" Kerlin; Swartz, McFerran, Melton; Christie, Trumbo; and Dunn. "Nay" None.
There being seven "Ayres" and no "Nays", the Mayor declared the Resolution adopted.
RESOLUTTON 1-67
A RESOLUTION EXPRESSING THE.'INTENTION OF THE BOARD OF DIRECTORS TO PROCURE TREATED WATER FROM THE BEAVER
WATER DISTRICT RESERVOIR.
WHEREAS; by reason of the rapid growth,of population, businesses and industries in the City of
Fayetteville; Arkansas, the City is presently consuming water at an ever increasing rate, with the result
that the City will require a greatly expanded supply of treated water within the near future, and
WHEREAS, the City of Fayetteville, Arkansas, presently has contractual rights to receive 11,000,000
gallons of water per day from the Beaver Water District Reservoir, with assigned rights of an additional
9,000,000 gallons of water per day when needed, and the potential for further increases in water capicit
as additional allotments are made from unalloted surpluses by the Beaver Water District.
WHEREAS, it is the desire of the Board of Directors of.the City of Fayetteville, Arkansas, to apprai
the Commissioners of the Beaver Water District of the City's intention to purchase treated water from the
District's facilities and of the City's intention to enter into negotiations for a memorandum of under-
standing concerning the terms for purchase, in order that the District may proceed with necessary steep
preliminary to the issuance of bonds and the investment in facilities required'to provide'the City with
the needed water.
NOW, THEREFORE, BE IT RESOLVED BY THE POARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That in order to assure the City of Fayetteville, Arkansas, of sufficient amounts of
treated water to accommodate the•growth of the City, it is in the best interest of the City of Fayettevi]
Arkansas, to procure treated water from the Beaver'Water District Reservoir.
SECTION 2. That the Commissioners of the Beaver Water District be and they are hereby advised of t
intention of the Board of Directors of the City of Fayetteville, Arkansas, to procuretreated water from
the Beaver Water District at an early date, and of the intention of the Board of Directors to enter int
negotiations for a memorandum of understanding, between the interested cities and the Beaver Water
District,.esbablishing the terms and conditions under which said water shall be purchased.

Engineers, McGoodwin, Willaims, and Yates and John E. Mehaffey and Associates, to be received and opened
on Tuesday," March jk . 1967, at 2:00 p.m.
The motion was seconded by Director Swartz and passed unanimously.
The City Manager reported that bids had been received and tabulated for five Police Sedans and he
Purchase of recommended the purchase from the low bid, which was the one by Lewis Ford Sales, Fayetteville, Arkansas
five cars for Director Melton then moved to purchase five Police Sedans from the low bidder, which was the bid by
Police Dept. Lewis Ford Sales Co., Fayetteville, Arkansas, for a total sum of $14,567.25 less trade-in.$7,699.35
making a net cost t6 the City of $6,887.90.

The City Manager further reported that bids had been received and tabulated for the purchase of four
Purchase of 45,000 GVW Truck Chassis as per Specifications, three 23,000 Truck Chassis, and one one-half ton Puckup
seven trucks & as per specifications,'and he recommended that they be purchased from the low bidder, which was the bid

Director Melton moved to accept the recommendation of the City Manager and purchase four 45,000 GVW Truck
Chassis at a net cost to the City of $34,691.72, three 23,000 Truck Chassis, abda net cost of $9,944.28,
and one one-half ton Pickup at a net cost bo the City of $1,978.86, all from Lewis Ford Sales Company,
Fayetteville, Arkansas,addording to specifications furnished by the City Manager.

The City Manager reported that bids had been received and tabulated for six Mobile Radios, "Buatmees
Dispatcher" or equal as per specifications, to be mounted on Sanitation Vehicles, but only one bid
had been received which was from Motorola Communications & Electronics in the amount of $482.00 plus
$25.00 for installation and he recommended the purchase on this bid.
Director Kerlin then moved to accept the recommendation by the City Manager and purchase six Mobile
Raftios, "Business Dispatcher" or equal as per specifications, to be mounted on Sanitation Vehicles from
Motorola Communications &. Electronics for $482.00 plus $25.00 for installation.
The motion was seconded by Director McFerran and passed unanimously.
The City Attorney introduced and, at the request of the Directors, read a proposed ordinance in its
entirety entitled, "AN ORDINANCE MAKING IT UNLAWFUL TO INJURE OR TO FAIL TO RETURN ANY BOOK, PERIODICAL
OR PROPERTY BELONGING TO THE PUBLIC LIBRARY OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND PRESCRIBING
PENALTIES FOR VIOLATIONSTHEREOF."
Director Dunn moved that the ordinance pass.
The motion was seconded by Director Swartz, and upon roll call the following vote was recorded: "AYE"
Kerlin, Swartz, McFerran, Melton, Christie, Trumbo!; and Dunn. "NAY" None.
There being seven "AYES" and no "NAYS", the Mayor declared the Ordinance passed.
ORDINANCE N0. 1527
AN ORDINANCE MAKING IT UNLAWFUL TO INJURE OR TO FAIL TO RETURN ANY BOOK, PERIODICAL OR PROPERTY BELO'
TO THE PUBLIC LIBRARY OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND PRESCRIBING PENALTIES FOR VIOLATION
WHEREAS, the Public Library of the City of Fayetteville, Arkansas, has in recent months repeatedly
encountered difficulty in securing return of books and other publications loaned to certai-n users of the
Library, who thereafter refused or failed to return said publications to the Library, despite repeated
requests Andddemands therefore, and
WHEREAS, it is the desire of the Board of Directors to see that all persons borrowing books from said
Library return them as required by the Library, and -to further prevent injury to the publications of
said Library.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE) ARKANSAS:
SECTION 1. It shall be unlawful forrany person or persons to injure, or to fail to return to the Public
Library of the City of Fayetteville, Arkansas, after writtendsmand therefor mailed t6 the last known addr
Df such person or persons, any.book, periodical or Tr6perty belonging to said Library. Said written
demand shall state that demaind is -being made pursuant to the authority contained in this ordinance, and
that failure to return the book, periodical or property specified within 10 days from the date shown on
said written dsmand shall be 'considered a violation of this ordinance resulting in prosecution therefor.

bids on stye t specifications for street improvement projects on that pertiof Sang Avenue and Hartman Avenue leading to
project near Ramay and adjacent to the new Ramay Junior High School, and the .City Manager recommended that the project be
JR. High School. advertised for bids to be received and opened on February 24, 1967, at 2:00 P.M. CST.
Director Melton then moved that -the City Manager be and he is hereby authorized to advertise for bids to
be opened on Friday, February 24, 1967, at 2:00 P. M. CST, on the Street Improvement Projedt on Sang and
HartmannAvenues leading to and adjacent to the new Ramay Junior High School according to plans and
specifications as furnished by the Consulting Engineer, J. E. McClelland.
The motion was seconded by Director Swartz and passed unanimously.'

ORDINANCE N0. 1528
AN ORDINANCE DISSOLVING STREET IMPROVEIXENT DISTRICT NO. 56 OF THE CITY OF FAYETTETILLE,IIRKANSAS, AND
TERMINATING THE BENEFIT ASSESSMENT'S PRESENTLY BEING LEVIED IN ASID DISTRICT.
WHEREAS, by Ordinance No. 951, the City Council of the City of Fayetteville, Arkansas, established Street
Improvement District No. 56, and b Ordinances No. 973 and 981, the City Council levied assessment for
benefits in the Street Improvement District No. 56 and provided for annual assessment and collection
thereafter until the whole of said local assessment was paid in full, and
vNIMEAS, a petition was filed with the Board of Directors of the City of Fayetteville, Arkansas, on
January 25, 19670 by the Commissioners of Street Improvement District No. 56, reporting that the bonded
indettedness of said District had been retired and that all refunds of surplus assessments had been sub-
stantially completed, and that the only funds remaining to the credit of the District are those necessary
to wind up the affairs of the District, and
WHEREAS, said petition requests that the Board of Directors of the City of Fayetteville, Arkansas, enact
an ordinance didsolving Street Improvement District No. 56, of Fayetteville, Arkansas, and removing and
terminating the benefit assessment presently levied against the real property in sAid District.
NOW,THEREFORE, BE IT ORDAINED B` THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
' SECTION 1. Street Improvement District No. 56 of the City of Fayetteville, Arkansas, is herel,y didsolved
and the benefit assessments presently being levied against the real property in said District for the
purpose of retiring the bonded indebtedness of sAid District are hereby terminated and removed.
SECTION 2. A copy of this Ordinance duly certified by the City Clerk shall be filed in the Office of the
County Collector of Washington County, Arkansas,
ON 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed, and this

for the Tomlyn Valley View Addition described as follows, to -wit:
