HomeMy WebLinkAbout1967-01-03 Minutes1.05 The Boarddof Directors of the City of Fayetteville, Arkansas, met in regular session on'Tuesday, January 3, 1967, at 7:30 P.M. in the Directors Room in the City Administration Building. Present: City Manager Gerald G. Fox, City Attorney Hugh Kincaid, City Clerk George J. Davis, and Diredto: Kerlin, McFerran, Melton, Christie,.Trumbo, and Dunn, ' Absent: Director Sylvia Swartz. The minutes of the regular meeting on Monday, December 19, 1966, a copy of which had previously been mai. to each of the Directors, were approved as written. The City Manager reported that bids had been received and tabulated for the purchase of Gas and Oil Bids on Gas & Oil Prmducts for the year of 1967, but two bids had been received fifteen minutes later than the time Rejected. specified in the addertising for bids had called for which was caused by a delay in 'the mail. After a brief .discussion, Director Melton moved the all bids be rejected and. that the City Manager be authorised to readvertise for bids on Gas and Oil Products for the year of 1967 and that the City contin to purchase the Gas and Oil under the present contract until a new contract was executed. The motion was seconded by Director Dunn and passed unanimously. The City Manager reported that bids had been received and tabulated for the purchase pf NYLON TIRES and Approved bids on TUBES and tie recommended thattthey be purchased from the Central Tire Co., Fayetteville, Arkansas, which Tires & Tubes was the low bidder with two exceptions, viz 3.25x20 Tubes 6$3.83 and 9.00x20 Tubes @ $4.54, both from for 1967 Gilbow Tire Co., Fayetteville, Arkansas. Director Dunn moved that the Nylon Tires and Tubes be purchased at recommended by ttie- City Manager for the year of 107. The motion was seconded by Director Kerlin and passed unanimously. THIS AGREEMENT,,made this day of. , 19_, by 6hdbetween the°City,,Water Dept. of the City of Fayetteville, Arkansas, through their agent, Superintends hereinafter called the Party of the First Part, and Party of the Second Part. U That the Parties therto, for andiin consideration hereinafter set'forth, agree as follows: ARTICLE 1. The Party of the Second Part proposes to construct and/or install water mains, valves and fire hydrants and join the water mains now servedwith water from the Water Department of the City of Fayetteville, for the purpose of distributing water to the following area or areas, ARTICLE 2. That the Party of the Second Part will construct and'/or install these water mains, valves and fire hydrants in accordance with the requirements of the City Water Department of Fayetteville, Arkansas, and the Arkansas State Board of Health. The written approval of the plans and specifications will be secured from both bf these two agencies before any contract is let and,�or construction is commenced. ARTICLE 3. That the plans and'specifications for the proposed water mains, valves and fire hydrants are First Part attached to this agreement and shall become a part hereof. That no changes or alterations will be made in to existing the plans or specifications without written consent of the Party of the First Part, and that the work will following basis: be done in strict accordance with the plans and specifications as furnished and attached to this aggeement. That the Party of the Second Part agrees to permit the Party of the First Part to make inspections of the work as it is being executed and that any failure to construct the mains, valves and fire hydrants in accordance with the attached plans and specifications will constitute sufficient reasen for the Party of the First Part to refuse 6sater service to be turned into any or all of proposed mains. ARTICLE 5. That the Party of the Second Part :Lill pay all costs for the valves and fire hydrants and other costs incidental to said construction. said mains, valves and fire hydrants installed will.be $_ $ for engineering costs, making a total cost construction of said mains, That the total actual cost ddr for construction costs, mid ARTICLE 6. That the Party of the Second Part will maintain all the mains, valves and fire hydrants for one year, at his own experise,.fvom the date of this agreement, after which the title to said mains, val and fire hydrants shall be vested in the City Water Department of Fayetteville, Arkansas, for and in consideration of the perpetual maintenance of said mains, valves and fire hydrants. ARTICLE 7• The Warty of the First Part will reih:burse the Party of the Second Part as service are actually made to existing buildings or buildings under*construction on the following basis: (a) Two hundred dollars ($200.00) for each service connection madeiinto a six-inch water main or larger to serve single residences and commercial buildings. For multi -family buildings and/or complexes which are metered for water through one master,meter, the reimbursement note shall be one hundred 'dollars ($10 for each family unit. . - ' (b) One hundred dollars ($1'00.00) for each service *connection made into a water main of Jess than six ifasheinside diameter to serve single-family residences and*commercial buildings. For multi=family buildings and/or complexes which are -metered for 'water through one master meter, the reimbursement note shall be fifty*dollars ($50.00) for each family unit. (c) Three hundred dollars ($300.00) for each fire hydrant 'after four buildings connected with water service are located within 500 feet of a fire dydrant. Out -buildings are not to be counted. Any one building shall hot be used to count for more than one fire'hydrant. (d) Upon completion of construction and final acceptance of the work, the Party of the First Part will pay the engineering costs only on the 'work actually constructed. • (e) The total'of all reimbiirsements for the Party of the First Part to'the Party of.the Second Part sh not exceed the'total costs for the work --as set out in Artidle 5 above. (f) No reimbursements shall be made to the Party of the Second Part for service connections made to water'mains extended from the mains constructed under this'contract or for fire hydrants not installed under this contract. ' (g) In the event any water'amin in the plans had to be greater than six inches inside diaiaeter in size to meet the requirements of a master plan for the City water distribution system, the Party'of the First Part will reimburse the Party of the Second Fart the difference in cost of six-inch pipe and the cost of the required larger pipe, upon completion and acceiptance of the works and as evidenced by the pipe suppliers incoices showing the costs of the respective sized of pipe. ARTICLE 8. That the Party of the First Fart shall be the only authorized to tap said mains'for the purpose of making service connections'and that the Party of the First Part will not make a tap for servi until all plumbing to which said service will be connected has been installed in accordance'with the Cit of Fayetteville, Arkansas, Plumbing Code in effect at the date and time of making such connection. ARTICLE 9. That the charges and method of payment for water service to consumers shall be as now establ or as may hereinafter be established and that all parties connected. to and receiving water service shall abide by any and all ordinances, and/or Rules and Regulations of the City of Fayetteville, Arkansas, as are then in effect or which may be thereafter adppted governing the Water Department of the City of Fayetteville, Arkandas. ARTICLE 10. That the Party of the Second Part grants to the Party of the First Part an easement or easements of sufficient width on each side of each main for the rurpose of inspecting, connecting services, installing meters, and repairing And maintaining all mains, valves, fire hydrants and meter - installations and such other purpose necessary for the proper operation of these mains, valves, fire hydrants and meter installations. Five feet on each side of the center line of a crater pipe and/or fire hydrant shall be considered a minimum easement width. ARTICLE 111 That failure to comply with any of the provisions of this agreement by any or all parties connected to said mains, or the Party of the Second Fart, shall be full justification for discontinuance of service to any or all parties connected to said mains, by the Party of the First Part and any.suck discontinuance of service will in rio way make the City of Fayetteville, Arkansas, and/or the Party of th First Part liable for damage or damages which may be occasioned by reas©n of the discontinuance of such service. That this agreement shall expire and be voided ten years from the date hereof, or when the cy total sum of all reimbursements made by the Party of the First Part to the Party of t1le Second Part equa n the total cost of the work, as stated in Article 5 above, whichever date occurs first, at which time r the mains, valves and fire hydrants small become the sole property of the Party of the First Fart, with limits. all provisions concerning easements to be retained by the Party.of the First Part. The Party of the Fir Part, after the expiration of this agreement, shall have the right to make service connections to said mains without any reimbursement or payment to the Party of the Second.Part fov any such connections. ARTICLE 13. That other parties not a part of this agreement may connect to any extend any of said mains to other properties and areas without any payment to the.Party of the Second Part for such purposes. ICLE 14. That the Party of the First Part shall have the right to connect and tie in other water main order to complete grids, circuits and extend mains to other areas without cost to the Party of the Fir t, and that Ehrty of the First Fart will have the right to make taps into the mains constructed under s contract for serving any of the preperties which may be owned by the City of Fayetteville, Arkansas, hout cost to said City of Fayetteville (example: to City Fire Stations). ARTICLE 15. For and in consideration of the covenants and agreements by the Party of the Second Fart, an upon completion and acceptance of said water mains, valves and fire hydrants, the Party of the First Part agrees to permit the Party of the Second Part to receive water service upon the aforesaid terms and conditions, and upon no other conditions. 16. The Parties -hereto for themselves, their successors, executors, administrators and assigns, hereby kgree fh&''.full covenants herein contained. The City Manager introduced and -at the request of the Couhcil, read a proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE CREATING A. DEPARTMENT OF PARKS AND RECREATION OF THE CITY OF Ordinance No. FAYETTEVILLE, ARKANSAS, AMENDING THE FAYETTEVILLE CODE OF ORDI A1� AND FOR OTHER PURPOSES." 1526 Director Kerlin moved that the rule be suspended and that th�be placed on the second reading. The motion was seconded by Director"Melton and upon roll call the following vote*%ms recorded: "AYE" Kerlin, McFerran, Felton, Christie, Trumbo, and Dunn. "NAY" None. There being six "AYES" and no "NAYS", the Mayor declared the metion passed.Thd. Ord. was read the second t The Mayor then declared the Ordinance open for discussion. There being no discussion, Director Melton moved that the rule be further suspended and that the Ordinance hie placed on its third and finAl reading. The motion was seconded by'Director Kerlin and upon roll call the following vote was recorded: "AYE" Kerlin, McFerran, Melton, Christie,. Trumbo, and.Dunn. "NAYi' None.,. _ .. . - __, . There being•six•PAYES" and no."NAYS", the Mayor declared the:motion passed. The 6rdinance was then read for.the thirdand last time. The Mayor then asked the question, "Shall the Ordinance pass?" Upon roll call the following vote wqs recorddd: "AYE" Kerlin, McFerran, Melton, Christie, Trumbo, and Dun "NAY" None. There being six "AYES" and no 11NAYS11 the Mayor declared the Ordinance passed. Director Christie moved that the emergency clause be adopted. The motion was seconded by Director McFerr and upon roll call the following vote was recorded: "AYE" Kerlin, McFerran, Melton, Christie, Trumbo, and Dunn. "NAY" None. There being six "AYES" and no "NAYS", the Mayor declared the Emergency Clause adopted. ORDINANCE NO. 1526 r AN ORDINANCE CREATING A DEPARTMENT OF PARKS AND RECREATION OF THE CITY OF FAYETTEVILLE, ARKANSAS, AMENDIN ' THE FAYETTEVILLE CODE OF ORDINANCES, AND FOR OTHER PURPOSES. WHEREAS, it appears to the Board of Directors of the City of Fayetteville, Arkansas, that it is in the public interest for the City of Fayetteville, Arkansas, to initiate a comprehensive program for parks and recreation in the City of Fayetteville, Arkansas, and WHEREAS, the Board of Directors desires to establishaa department of the City to administer said program. iOWJ THEREFORE; PE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. There is hereby established the Department of narks and Recreation of the City of Fayettevill Arkansas. SECTION 2. That the Department of Parks and Recreation shall be administered and directed by a person No! 1526 bids of pal J Mayor Ci7;ly Elerk of Greenlan by the City Manager, who shall be.known as the Director of Parks and Recreation., That said shall have one or more assistants and such staff as the Board of Directors from time to time e. ECTICN 3. It shall be the duties of the Department of Parks and Recreation to: 1) Develop and coordinate all recreation activities of the City; 2) Prepare development plans for present parks and for future park areas; 3) Investigate all federal programs for park and recreation development and prepare necessapy forms; 4) Supervise swimming pool operation; 5) Develop and supervise a Park Maintenance Program; 6) Coordinate city wide beautification efforts; 7) Perform such other duties and conduct such other activities in connection with the park, recreation nd cultural needs of the inhabitants of the City of Fayetteville, Arkansas, as the Board of Directors hall from time to time provide. CTION 4. There is hereby created a Parks & Recreation Advisory Board to be composed of seven (7) mbers, no less than three (3) of which shall also be on the Fayetteville Youth Center Board of Directors e Youth Center Board members on the Advisory Board shall be recommended by the Youth Center Board of rectors and confirmed by the City Board of Directors. The other members of the Advisory Board shall be commended by the pity Manager and approved by the City Board of Directors. Terms for the members of the visory Board shall be for a period of 2 years commencing on January 1. Three (3) of the initial pointees shall serve for a term of one (1) year and four (4) of the initial appointees shall serve for term of two (2) years. Thereafter, all appointees shall be for a period of two (2) years. Vacancies all be filled for the unexpired term in the same manner as provided above. The expiration or terminatic a member from the Youth Center Board of Directors of his term on the Youth Center Board, without con- rrent re-election or reappointment to said Board, shall also operate as a termination of his membership the Advisory Board and shall create a vacancy in his position. 1 members of the Parks and Recreation Advisory Board shall serve without compensation. CTIO14 5. The Parks and Recreation Advisory Board shall meet monthly with the Director of Parks and creation. The Advisory -Board shall•-advise-and•recommend-to.-the-Director of -Parks and Recreation, City nager and City Board of Directors on all aspects of parks and recreation activities.. Annually, the visory Board shall develop a suggested work program and operating budget to be submitted to the City and of Directors by November 1 of each year for the subsequent year. The Advisory Board shall also commend priorities for capital improvements and means for financing same, and shall prepare an annual ogress report on Parks and Recreation activities. TION 6. That the Fayetteville Code of Ordinances shall be amended by adding to Chapter 2 an article itled "Article VI, Parks and Recreation", which article shall be divided by the codifier of the Code Ordinances into numbered sections following the format of the Code of Ordinances. TICffi 7. This Ordinance being necessary for the preservation of the public peace, health and safety emergency is hereby declared to existaiid this Ordinance shall be in full force and effect from and er its passage and approval. Director Melton moved that the salary of the Municipal Judge be increased to $7,500.00 Per Annum or an increase of $300.00 Per Annum.
