That said building or structure is located at 701 North College Avenue in the City of .) Fayetteville, Arkansas, upon real estate more fully described as -Lot 1. Block 19 of the City Park Addition to the City of Fayetteville, Arkansas, and same is declared to be a structural, fire and health hazard, and unsightly, obnoxious and detrimental to the public welfare. All persons, firms and/or corporations violating the terms and provisions of this ordinance upon conviction thereof be fined in any sum not less than Twenty-five Dollars ($25.00) nor more Three Hundred ($300.00) Dollars. TION 5. The City Atborney is hereby directed to institute such legal proceedings as may be necessary i order to enforce the provisions of this ordinance, and to remedy the dangerous, unsanitary, and ightly conditions brought about.as a result of the failure of the owner to properly keep up said CTION 6. Said legal proceedings shall provide that unless the building or structure is razed within certain period, to be determindd by the Court, the City of Fayetteville be authorized to raze said operty and have a lien upon the real estate for the cost of removing said building or structure. M. Present: City Manager Gerald G. Fox, City Attorney Hugh Kincaid, City Clerk George J. Davis, and Directors: Kerlin, Swartz, McFerran, Christie, Trumbo, and Dunn. Absent: Director Garland Melton, Jr. The minutes of the regular meeting on Monday; November 21, 1966, a copy of which had previously been mailed to each of the Directors, were approved as written. Manager Police The City Manager reported that the Chairman of the Police Committee,under the Mayor Form of Government, Relief also served as Chairman of the Police Pension and Relief Fund. He further reported that the City Attorney had ruled thabe was no specific provisions allowing a Board Member to serve in this capacity but he had also ruled that -the City Manager could legally serve in this capacity. Therefore the City Manager recommended that the City Manager be appointed to serve as Chairman of the Police Pension and Relief Fund. . Director Kerlin moved that the. City Manager be appointed to -serve as Chairman of the Police Pension and Relief Fund. After a brief discussion, Director Dunn moved to accept the recommendations of the Water & Sewer Superintlendent and adopt the proposed changes in the charges for water and sewer connections as presented. The motion was seconded•by Director Swartz and passed unanimously. The letter and the Cost Schedules For Water and,Sewer Connections were spread on the minutes as a permanent record and reads as follows: November 30,1966 Mr. Gerald G. Toa City Manager Fayetteville, Arkansas Dear Mr. Fox: Attached are drafts of proposed changes in the charges for water and sewer connections. A copy of the charge schedule we are now operating under is also attached. Since the present schedule was adopted in January, 1952s prices of materials have adcanced 35 to a00 per cent and labor has advanced at least 30 per cent. Briefly the increases per connection are increased approximately $10 each and the pavement cuts and repai are increased to more nearly equal the costs for the work. I have included some special conditions which have developed since.the•'present schedule was adopted. In some of these it will reduce the charges. Under the authority of Ordinance No. 953 date August 15, 1949, the following schedule of charges for water sertrice connections shall be made and become effective upon approval of the Governing Body of the City of Fayetteville, Arkansas. 2. This schedule supersedes any and all previously approved schedules. It shall become effective on January 1, 1967. 3. The schedule is based upon an average of 30 feet of pipe required to bring the service Gonnection to a meter location within 3 or 4 feet of the inside of the property line of the premise to be served, and shall not exceed a total of 60 feet. For distances in excess of 60 feet, charges for each additional foot shall be as set out in this schedule. ' 4. The charge as set out includes all labor, material, and equipment necessary to make the water connection. It also includes the costs for the cutting and repairing of pavements and future main of the service. The charge et out in "Special Sewer Connection Charges" shall be reduced by the amount of $10.00 (in this case the ity will dig the 10 feet of trench adjoining the main or manhole in order to prevent damage to either the sins or manhole. . No person or persons shall be permitted to do any excavating and/or trenching in City Streets or alle r within five feet of sewer mains and manholes on private properties for the purpose of installing sewer onnections. *Streets and alleys begin at the property line and not at the edge of pavements. City Manager reported that in the past, the City had provided a Christmas Bonus for each employee r the holiday season. The Bonus was established at $25 for each employee hired prior to January 1 of s year and $10 for each employee hired after January 1. For the 175 City employees, this would amount about $3,500 in bonuses. , recommended that this practice be continued this•year at the same rates •as in the•pasi. Park and Recreat— ion Discussion Director Swartz reported that the Parks and Recreation Citizens' Advisory Committee had recommended that the City initiate a parks and recreation program for the 1967 fiscal year with the following recommendati (1) The present Youth Center Director to be employed also as the Parks and Recreation Director for the City: (2) That an assistant youth center director be employed to handle most of the day to day functions o the Youth Center; (3) That the Parks and Recreation Director be assigned the following tasks during the first year: (a) Develop and coordinate all°recreation activities of the City, Youth Center, and School District. (b) Prepare development plans for present parks and for future park areas. (c) Investigate all federal programs -for park and recreation development and prepare necessary forms. (d) Supervise swimming pool operation. (e) Develop and supervise a park maintenance program. (4) Create and make appointments to a permanent Parks and Recreation Advisory Committee made up of several members of the Youth Center Board and others to be selected by the City Board. 'Approval of IThe City Manager reported that it would cost the City a total of $44,000.00 for this program, however Budget for the sum of $35,200.00 had been discussed for this in the 1967 budget. 1967 Fhijs would mean an additional sum of $8,800.00 needed in the budget for 1967. Fublib The Mayor reported that this was the date, time, and place set for a public hearing on the petition of Hearing to Paul D. Lewis and Pauling G. Lewis, husband and wife, to vacate and abandon an alley in the Mountain View Vacate Alley Addition to the City of Fayetteville, Arkansas, which had been approved by the Planning Commission. in MtViewIThe City Clerk reported that he had caused notice of the public hearing to be published in the Northwest Addn, Arkansas Times, a daily newspaper published in Washington County, Arkansas, and having a general circulati in the City of Fayetteville, Arkansas, once a week for two consecutive weeks and had caused an Abstractor' Certificate of Title showing the owners of Record to be attached to the Petition prior to the date set for the pu11c hearing. He further re ted that he had letters from all the Utility Companies except the Water and Sewer Dept. stating they d no objection to the alley being vacated and abandoned and that the Water Superintendent ,had stated to the Planning Commission at its hearing on the Petition that he had no objection to the alley being closed. ' The City Attorney introduced and at the request of the Directors,read a proposed ordinance in its entiret ' entitled, "AN ORDINANCE VACATING A CERTAIN ALLEY IN N.OUNTAIN VIEW ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS." In the proposed ordinance the City Attorney had written a clause whereby the City would retain utility easements in the alley.
