That as the questions in controversy in said condemnation proceedings are likely to retard the progress of the proposed construction of said.By-Pass, the City Attorney is further authorized and directed to petition the Court for permission -for the City to provide appropriate deposits in Court for making compensations and payment of damages, in order that immediate possession of the said lands may be secured and in order that construction may be commenced and prodeed prior to assessment and payment of damages. Davis,,and Board Members:Kerlin, Swartz, McFerran, Melton, Christie, and Dunn. Absent: City Manager Gerald G. Fox, and Mayor Lyon Trumbo. In the absence of Mayor Don Trumbo, Ashhstand Mayor Sylvia Swartz acted as Mayor. Of The Acting Mayor reported that the purpose of the meeting was to consider the Amendment of Ordinance No. 1517, dated October 3, 1966, to correct certain errors appearing in the description of the properties to be annexed, and that all members of the Board of Directors had been notified by U.S. Mail and by telbphone, but Mayor Don Trumbo was out of the City and could not attend, however he had signed a Waiver Of Notice of the special meeting. ver of WAIVER OF NOTICE OF SPECIAL MEETING OF ce I FAYETTEVILLE CITY BOARD OF DIRECTORS Comes now the undersigned, being a duly elected, qualified, and acting member of the Board of Directors of the City of Fayetteville, Arkansas, and specifically waives notice of a special meeting of the Fayetteville Board of Directors to be held in the Directors Room of the City Administration Building, Fayetteville, Arkansas, at 10:30 o'clock a.m., on October 26, 1966. Dated this 25th day of October, 1966: Director rusncd - , 1519 The City Attorney introduced and,at the request of the Directors,read a proposed ordinance in its entir entitled,"AN ORDINANCE AMENDING ORDINANCE NO. 1517 OF OCTOBER 3, 19662. TO CORRECT THE D=MTfTIONS OF T PROPERTY PROPOSED FOR ANNEXATION BY ORDINANCE N0, 1517.". Director McFerran moved that the rule be suspended and that the ordinance be placed on the second readi The motion was seconded by Director Kerlin.and upon roll call, the following vote was recorded: "AYE" Kerlin, Swart, McFerran, Melton, Christie, and Dunn. "NAY" None. There being six "AYES" and No "NAYS", the Acting Mayor declared the motion passed. The Ordinance was then read for the second time. The Acting Mayor then declared the Ordinance open for discussion. After a long discussion, Director Melton moved that the rule be further suspended and that the Ordinance be placed on the third and final reading. The motion was seconded by Director McFerran and upon roll call the following vote was recorded, "AYE" Kerlin, Swartz, McFerran, Melton, Christie, and Dunn. "NAY" None. There being six !'AYES" and No "NAYS", the Acting Mayor declared the Ordinance passed, ORDINANCE N0, 1519 AN ORDINANCE AMENDING ORDINANCE N0..1517 OF DCTOBER 3, 1966s TO CORRECT THE DESCRIPTIONS OF THE PROPERTY ;FOR ANNEXATION BY ORDINANCE N0. 1$17. from the Finance I Comm AS, through oversight certain of the descriptions of the properties shown on the annexation map, ved by the Planning Commission and the Board of Directors of the City of Fayetteville, Arkansas, inadvertently omitted from Ordinance No. 15170 submitting the question of annexation to the Voters, EREAS, it was the intention of the Board of Directors of the City of Fayetteville, Arkansas, to include 1 property shown on said map in the proposed annexation, and to that end the -Board of Directors has van wide circulation and publicity to reproductions of said map, and , it is the desire f the Board of Directors to amend Ordinance No. 1517 so as to conform the Lions of the propert therein contained to the aforesaid map, in order to confirm the Board's on that all of the proper3ries shown on said map be included in the proposed annexation area. , THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYEPTEVILLE, ARKANSAS: 1. That Section 1 of Ordinance No. 1517 of October 3, 1966, be amended by adding thereto the g paragraphs and descriptions: 1116. That Section 1 of Ordinance No. 1517 should be further amendAd and corrected by deleting from raph 119:' the word "30" between "Range" and "West" and adding "3114 and deleting "Half(NE1/2)" after beast" and adding "Quarter (NE 1/4)", so as to read: "9. All of the Southeast Quarter (SE 1/4), the South Half (S 1/2)6f the Northeast Quarter (NE J), the rter,..(SE ik-)of the Northwest Quarter (NW �),".:and the -East Half (EI). of. the.Sowthwest Quarter (SW 4) of S m Ict[ 16 North, Range 31 Wests of the 5gh Principal Meridian, except that portion of said lands presently within the corporate limits of Farmington, Arkansas." That Section 1 of Ordinance No. 1517 should be further amended and corrected by deleting "Southwest er (SW 1/4) following the word "Northwest Quarter (NW 1/4)"efntparagraph 15 and adding "Southeast er (SE 1/4)", so as to read: 1115. All of the Northwest Quarter (NW 1/4), the West Half (W 1/2) of the Northeast Quarter (NE 1/4), the Northwest Quarter (NW 1/4) of the Southeast Quarter (SE 1/4) and the North Half (N 1/2) of the Southwest Quarter (SW 1/4) of Section 349 Township 16 North, Range 30 West, of the 5th Principal Meridian." SECTION 2. That this Ordinance shall be in full force and effect from and after its passage, a publication, and the City Clerk is directed to publish this ordinance in the Northwest Arkansas each day of regular publication following the date of adoption until the date of election. M. Present: City Manager Gerald G. Fox,'City Clerk George J. Davis, City Attorney Hugh Kincaid, and Kerlin, Swabtz, McFerran, Melton, Christie, Trumbo, and Dunn. Absent: None. W i The minutes of the regular meeting on Monday, October 17, 1966, and of the special meeting on Wednesday, October 26, 1966; copies of which had previously been mailed to each of the Directors, were approved as written. Mr. James N. Moore, of the Monicipal Finance Advisory Committee , appeared before the Board of Directors and reported that the Municipal Finance Advisory Committee had, after a long study, recommended additions'. Municipal Revenues from the following sources: 1. A levy of $3.00 Court Cost on each case in Municipal Court, 2. A Municipal Vehicle Tax of $5.00 on each motor vehicle in the City. 3. A City Occupation Tax. I . 4. An update of Utility Franchise Tax(provided this is permissible by the Public Service Commission. 5. Updating of tax assessments by employing professional Tax Appraisors. No further action was taken at this time. eta
