HomeMy WebLinkAbout1966-07-18 MinutesThe Board of Directors of the City of Fayetteville, Arkansas, met in regular session on Monday, July 18, 1966s at 7:30 P. M. in the Directors Room in the City Administration Building. Present: City Manager Gerald Fox, City Clerk George J. Davie, City'Attorney Hugh Kincaid, and Directors: Kerlin, Swartz, McFerran, Melton, Christie, Trumbo, and Dunn. ' Absent: None. The minutes of the regular meeting on Tuesday, July 5, 1966, a copy of which had previously been mailed ' each of the Directors, were approved as written. Approve Water & Saxer Budget for Director Kerlin moved to approve the Water & Sewer Budget'for the Fiscal Year 1966-1967 as presented by 1966- 1967 the City Manager. The motion was seconded by Director McFerran and passed unanimously. The City Attorney presented the petition of Wayne Bayley to rezone certain property located South of Ordinance No. Poplar Street and East of Leverett Avenue from R -1B to O-1 Open Land District, (R=1B Single Family Resi- dential District) which had been approved by the PlAhning Commission. The City Attorney introduced and, at the request of the Directora, read a proposed ordinance in its entirety entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1239, AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKANSAS, APPROVED MAY 28, 1962, TO REZONE CERTAIN REAL ESTATE FROM R -1B SINGLE FAMILY RESIDENTIAL'DISTRICT'AND R-2 TWO FAMILY RESIDENTIAL DISTRICT TO 04 OPEN LAND DISTRICT". Director Christie moved that the Ordinance pass. The motion was seconded by Director Kerlin and upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Christie,'Trumbo, and Dunn. "Nay" Melton. There being Six "Ayes" and One "Nay", the Mayor reported that the Ordinance failed to pass for lack of a unanimous vote of all the Directors. Director Kerlin then moved that the rule be suspended and that the Ordinance be placed on its second reading. The motion was seconded by Director Swartz and upon roll call the foll6iing vote was recorded, "Aye" Kerlin, Swartz, McFerran,%XEBM Christie, Trumbov and'Dunn. "Nay" Meltoh.and Dunn. The Mayor then declared the Ordinance open for discussion. There being no further discussion, Director Kerlin moved that the rule be further suspended and the Ordinane§ plac4 on the third and final reading. The motion was seconded by Director Christie and upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Christie, and Trumbo. "Nay" Melton and Dunn. There being five "Ayes" and two "Nays", the Mayor declared the rule suspended and the Ordinance placed o the third and final reading. The Ordinance was then read for'the third and last time. The Mayor then asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Chriatie, and Trumbo. "Nay" Melton and Dunn. There being five "Ayes" and only two "Nays", the Mayor declared the Ordinance passed. '' ORDINANCE N0. 405 vi ORDINANCE AMENDING ZMNING ORDINANCE NO. 1239, AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ANSAS, APPROVED NAY.281 1962, TO REZONE CERTAIN REAL ESTATE FROM R -1B SINGLE FAMILY RESIDENTIAL TRICT AND R-2 TWO FAMILY RESIDENTIAL DISTRICT TO 0-1 OPEN LAND DISTRICT. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, Arkansas, on.Tuesday, June 14, 1966, on the petition of Wayne Bayley, requesting that said Planning Commission recommend to the Board of Directors of the City of Fayetteville, Arkansas, that the Board ' �of Directors enact an ordinance rezoning the following described property, presently zoned R -IB Single amily Residential District and R4 Two Family Residential District, to -wit: Lots Number 2, 3, 4, 5, 6, 7, 8, 9, and 10 in Block 9 in Parker's Plat of Valley View Acres, as same are designated upon the recorded Plat of said Subdivision, the same being a �part of tTie Feet Half of the Southwest Quarter and the West Half of the Southeast Quarter of Section 4, in Township 16 North, Range 30 West, situated in Washington County, Arkansas, R -1B Single Family Residential District and R-2 Two family Residential District to 0-1 Open District, and WHEREAS, notice of said public hearing, setting forth the date, tine, place and purposes of d hearing and location of property was published in the Northwest Arkansas Times, a newspaper general circulation in said City, more than 15 days prior to said public hearing, and WHEREAS, following said public hearing, said Planning Commission certified to the Board of Directors the City of Fayette villa, Arkansas, its recommendation that an ordinance be adopted rezoning the ve-described property, presently zoned R -1B Single Family Residential District and R-2 Two Family idential District to 0-1 Open Land District. , THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the above-described property, which is presently zoned R -IB Single Family idential District and R4 Two Family Residential.District, be and the same hereby is rezoned 0-1 Open Land District. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed, ' and this ordinance shall be in full force and effect from and after its passage, approval and publication. WHEREAS, the,County Court,of Washington County, Arkansas, did on June -7s 1966, enter an order % 7 annexing the following described territory to the City of Fayetteville, Arkansas, Eo -wit: All that part of the South half (S 1/2) of the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section Eighteen (18) in Township Sixteen (16) North, Range Thirty (30) West, lying East of the Branch, and containing Thirteen (13) acres, more or less. WHEREAS, the County Clerk of Washington County, Arkansas, has forwarded a transcript of said iedingb to the Board of Directors of the City of Fayetteville, Arkansas, and, WHEREAS, more than thirty days have elapsed since the date of said order, and no proceeding has n instituted in the Circuit Court to prevent said annexation, and no notice therof has been given required by law. Fox, City Manager of the City of Fayetteville, Arkansas is hereby authorized directed to make applications and to otherwise be the official representative of the City of etteville for a federal grant under Public Law 660, as amended which grant is to be applied to cost of constructing sanitary sewer facilities. The City of Fayetteville hereby also agrees that the federal grant is approved persuant to the Federal Water Pollution Control Act, the City will the remaining costs between the $3,931,000 estimated total cost and the approved grant of $1,103,940. The City Manager read a proposed resolution in its entirety superseding RESOLUTION N0. 1545. Director Melton moved that the resolution be adopted. , The motion was seconded by Director Kerlin and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION 2046 WHEREAS, on4October 11, 1965, Resolution No. 15-65 was adopted by the'City Council of the City �p of Fayetteville, Arkansas moving.Guy Brown as official representative to make application for federal grant under Public Law 660; and WHEREAS, this grant was made and was'approved on December 6, 1%5 and designated Project WPC - ARK -261, such grant being in the amount of $1,103,940; and ,WHEREAS, Guy Brown is no longer the Mayor of the City of Fayetteville and it is the desire to appoint another official representative to sign all documents under Project WPC -ARK -261: NOW, THEREFORE BE IT RESOLVED BY THE CITY BOARD OF DIRECTORS OF FAYETTEVILLE, ARKANSAS: , 45 THAT, Gerald G. Bissett ase of for The City Manager reported that the City now owned 400 acres at the new Sewage Plant Site but the e Plant Engineers had recommended that the City own a total of 600 acres at this site. He further reported that 102 acres could be purchased at this time from a Mrs. D.H. Willard for the sum of $18,000.00 and he recommended the purchase of this real estate provided the Abstract of Title was approved. After a brief discussion, Director Helton moved that the City Manager be authorized to purchase the 102 acres of real estate from Mrs. D.E. Willard for the sum of $18,000.00 upon the approval of the Abstract of Title by the City Attorney. The motion was seconded by Director McFerran and passed unanimously. , Tib City Manager read the proposed resolution kn its entirety entitled, "A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT FOR JOINT PLANNING COOPERATION BETWEEN WASHINGTON AND BENTON COUNTIES AND ALL INCORPORATED CITIES AND TOWNS WHICH MIGHT WISH TO BECOME A PART OF THE REGIONAL PIAN AREA AND SUPERCEDING RESOLUTION 1946". Director Dunn moved that the resolution be adopted. The motion.was seconded by.Director Swartz and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION NO. 2146 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENTFORJOINT PLANNING COOPERATION BETWEEN WASHINGTON AND BENTON COUNTIES AND ALL INCORPORATED CITIES AND TOWNS WHICH MIGHT WISH TO BECOME A PART OF THE REGIONAL PLAN AREA AND SUPERSEDING RESOLUTION 1946. WHEREAS, Act 26, 1965 Acts of Arkansas (Arkansas Stats. Ann.19 19-282D, et seq). authorizes any two or more cities or counties or other civil.subdivisions having ,adjoining planning jurisdictions, or any county and city or cities within or adjacent to the county, to jointly cooperate in the exercise and performance of planning powers, duties and functions as provided by state law for cities and counties, and to establish a joint planning commission for the metropolitan area or region comprising the area coterminous withthe areas of planning jurisdiction of the cities and counties jointly coopera and t I_ WHEREAS, it is the desire of the Board of Directors of the City of Fayetteville, Arkansas to enter into andagreement for joint planning cooperation with Benton and Washington Counties, the Cities of Springdale, Rogers, Bentonville and Sileam Springs, and all ineorpora"d towns and cities which might wish to become a part of the Regional Area Plan, and WHEREAS, an Agreement to accomplish this propose has been prepared and read in full before the Board of Directors of the City of Fayetteville,'Arkansas, and WHEREAS, it is the desire that this resolution shall supersede Resolution 1946 as approved on July 5, 19669 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. 'DAVIS, CITY CLERK 4'7 Approved budget for Regional Planning The City Manager reported that the Regional Planning Commission had adopted a budget for the remainder Commission of the fiscal year of 1966, and that Fayetteville's share would be $3,650.00 and he recommended this be for 1966 approved. ' Director Melton moved to approve the budget for the Regional Planning Commission as recommended and to authorize the payment of $3,650.00 by the City of Fayetteville for the remainder of 1966..$Dec. 31, 1966) The motion was seconded by Director Kerlin and passed unanimously. The City Manager reported that the FAA had requested a Supplemental Agreement in lieu of the original' Authorized Agreement dated March 22, 1962. Supplemental Director McFerran moved that the City Manager and:City Clerk be and they are hereby authorized to Agreement with execute a Supplemental Agreement with the Federal Aviation Agency modifjitng the original lease Agreement FBAI dated March 22, 1962. The motion was seconded by Director Melton and passed unanimously. Authorized' The City Manager reported that some of the optionatfor right-of-way for Highway No. 16 Bypass would of real estate for expire soon unless the City exercised the options and purchased this real estate. Highway 16 Bypass Director Melton moved that the City Manager be and he is hereby authorized to exercise the options obtained andtpurrhase the real estate for the right-of-way for Arkansas State Highway No. 16 Bypass upon the approval of the Abstract of Title by the City Attorney. The motion was seconded by director McFerran and passed unanimously. Discussion I Attorneys Md Davis appeared before the Board of Directors in behalf of Duane Nelson, who had made an for new cemetery. application for a Permit.fbommthe Arkansas State Cemetery Board for a cemetery to be located on the North side of the City of Fayetteville. Attorney Davie stated that he and Mr. Nelson had tried in every way to follow the Arkansas Statute in making this application. He read the Statute with teference to this and explained thdr'•">procedure. Attorney Tom Pearson appeared beforetthe Board of Directors, representing the Fairview Memorial Gardens Inc., and apposed a new cemetery. Director.Christie moved that the Mayor be requested to write a letter to the State Cemetery Board stating that he wished to withdraw his signature from the letter of recommendation dated June 21, 1966s and bearing the signatures of Gerald Fox, City Manager and Don Trumbo, Mayor, because it was an,. Administrative Function and the City Manager, only; would sign the letter,. The motion was seconded by Director Melton and passed unanimously. There being Six "Ayes", No "Nays", with only one abstaining, the Mayor declared the motion passed. Ordinance left on The City Manager introduced and, at the request of the Directors, read a proposed Oridnance in its entire' First Reading entitled, "AN ORDINANCE DECLARING THE'BUSINESS OF TRANSPORTING PERSONS WITHIN THE CITY OF FAYETTEVILLE BY (Ambulance) MOTOR AMBULANCE FOR COMPENSATION TO BE A NECESSARY PUBLIC SERVICE UTILITY SUBJECT TO REGULATION BY THE CITY; PROVIDING FOR THE LICENSING OF AMBULANCE SERVICE OPERATORS AND DRIVERS; PROVIDING FOR REGULATIONS ON OPERATING AMBULANCES; PROVIDING FOR APPROVAL OF RATE SCHEDULES; PROVIDING PENALTIEB FOR VIOLATIONS; AND FOR OTHERFBURROSES. MINIMUM STANDARDS GOVERNING THE CONSTRUCTION AND MAINTENANCE OF MOBILE HOME PARKS; ESTABLISHING MINIMUM STANDARDS GOVERNING THE PROVIDED UTILITIES AND•FACILITIES, AND OTHER PHYSICAL THINGS AND CONDITIONS TO MAKE MOBILE HOME PARKS SAFE, SANITARY, AND FIT FOR HAMAN HABITATION; FIXING THE RESPOSSIBILITIES AND DUTIES OF OWNERS AND OPERATORS OF MOBILE HOME PARKS; AUTHORIZING INSPECTION OF MOBILE HOME PARKS; AND FIXING PENALTIES FOR VIOLATIONS; AS AMENDED," which was left on the first reading at the last regular ' meeting of the Directors on Monday, July 18, 1966, again came up for discussion. Several amendments had been added to the proposed ofdinance and after a long discussion Director Christie moved that the ordinance be placed on the second reading. The motion was seconded by Director Swartz and passed unanimously. The ordinance was then read for the second time. Another long discussion followed but no further action was taken at this time and the ordinance was left on the second reading.
