DAVIS, CITY CLERK The Board of Directors of the City of Fayetteville, Arkansas, met in special session on Monday, June 13, , 1966, at 7:30 P. M. in the Directors Room in the City Administration Building. Special Present: City Manager Gerald Fox, Mayor Don Trumbo, City Clerk George J. Davis, City Attorney Hugh Kincaid, Meeting and the other Board Members: James T.Kerlin, Sylvia Swartz, Joe McFerran, Garland Melton, Jr., Arnold Christie, and Dale Dunn. Absent: None. The Mayor reported that the purpose of the meeting was to discuss the status of the Highway No. 16 Bypas rpose of project in light of recent developments and to take any action deemed necessary as a result of such Meeting discussions, and that all members of the Board of Directors had been notified by U. S. Mail and by The City Manager reported that, according to the plans of the Arkansas State Highway Department, more ution right-of-way would be needed for the Arkansas State Highway No. 16 Bypass than we now have (45ft) and that the City Land Agent was getting estimates of the cost for the additional right-of-way. 14-66 He further reported that most of the extra cost would be along 15th Street west of U. S. highway No. 71. After a long discussion, the City Manager introduced and, at the request*of the Directors, read a propos resolution in its entirety entitled, " A RESOLUTION BY THE CITY BOARD OF DIRECTORS OF THE CITY OF FAYETT ARKANSAS, MAKING CERTAIN REQUESTS A1'1D ASSURANCES TO THE ARKANSAS 11IGH'V1AY DEPARTMENT CONCERNING HICH14AY I BYPASS FROJECT." Director Melton moved that the Resolution be adopted. The motion was seconded by Director Swartz and passed unanimously whereupon the mayor declared the Resol adopted. RESOLUTION NO. 14-66 A RESOLUTION BY THE CITY BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, MAKING CERTAIN REQUESTS AND ASSURANCES TO THE AWNSAS HIGMPIAY DEPARTMENT CONCERNING HIGHL•!AY 16 BYPASS PROJECT. ' WHEREAS, the Arkansas Highway Department has programed and authorized funds for the construction of ighway 16 Bypass in Fayetteville, Arkansas, and I 4HEREAS, the City of Fayetteville is desirous of having such project under construction at an early because of traffic congestion now present, BE IT RESOLVED BY THE ECARD OF DIRECTORS OF THE CITY OF FAvETTEVILLE, ARKANSAS: SECTICN 1. That the Highway Commission and Department be requested to change the alignment of the proposed bypass route to begin at the intersection of Crossover Road (State Highway 265) and Huntsville Road (State Highw�y 16); and, SECTION 2. That the City of Fayetteville will assure the highway department that right-of-way in the' amount of 60 feet width through developed sections and 80 feet width through undeveloped sections will be obtained 1.17 the City and turned over Lo the higlnrdy department; and, SECTION 3. That water and sewer lines beneath or on the side of the present roadway be allowed inthy�ir present locations unless grade changes would require moving or encasing; and, SECTION A. That the entire project from east toast ends by placed under contract (s) at an early date and constructed as expeditiously as possible. PASSED AND APPROVED this �-day of June , 1966. M. in the Directors Room in the City Administration Building. Present: City Manager Gerald Fox, City Clerk George J. Davis, City Attorney hugh Kincaid, and Directors: Swartz, Melton, Christie, Trumbo, and Dunn. Absent: Directors:Kerlin and McFerran. The minutes of the regular meeting on Monday, June 6, 1966, and of the special meeting on Monday, June 13 1966, copies of which had previously been mailed to each of the Directofs, were approved as written. The City Attorney introduced and, at the request of the Directors, read a proposed ordinance in its entirety entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 1239, PASSED AND APPROVED JUNE 13, 1960, AS AMIMNE BY ORDINANCES N0. 1284 and NO. 1425, TO PERMIT MORTUARIES AND MEMORIAL GARDENS(CEMETERIES) iITHIN A-1 ANNEXED TERRITORY DISTRICT AND 0-1 OPEN LAND DISTRICT". Director Christie moved that the rule be suspended and that the ordinance be placed on its second reading The motion was seconded by Director Dunn and passed unanimously. The Ordinance was then read for the second time. The Mayor then declared the Ordinance open for discussion. There being no discussion, Director Christie moved}.,ghat the rule`be further suspended and the Ordinance placed on the third and final reading. ' The'motion was seconded by Director Swartz and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded, "Aye" Swartz, Melton, Christie, Trumbo, and Dunn. "Nay" None. There being five "Ayes" and No "Nays", the Mayor declared the Ordinance passed. ORDINANCE NO. 1501 Ordinance No. 1501 AN ORDINANCE AMENDING ORDINANCE NO, 1239, PASSED AND APPROVED JUNE 13, 1960, AS AMENDED BY ORDINANCES NO. 1284 and NO. 1425, TO PERMIT MORTUARIES AND MEMORIAL GARDENS (CEMETERIES) WITHIN A-1 ANNEDED TERRITORY DISTRICT AND O-1 OPEN LAND DISTRICT. WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, aArkansas, on June 1, 1966, for the purpose of considering amendment of Zoning Ordinance No. 1239, passed nd approved June 13, 1960, as amended by Ordinance No. 1284, passed and approved January 22, 1962, and Ordinance No. 1425, passed and a�proved November 23, 1964, in order to permit establishment of,mortuaries and memorial gardens (cemeteries within A-1 Annexed Territory District and 0-1 Open Land District, and WHEREAS, notice of said public hearing, setting forth the date, time, place and purposes of said hearing was published in the Northwest Arkansas Times, a newspaper of general circulation in said City, I than 15 days prior to said public hearing, and WHEREAS, following said public hearing, and further consideration and study of said proposed amendmen on June 14, 19660 said Planning Commission certified to the Board of Directors of the City of Fayetteville Arkansas, its recommendation that an ordinance be adopted, amending as hereinafter set out Article IV, and aSection 5 of Ordinance 1239, as amended by Ordinance No. 1425, and Article V, Section 14 of Ordinance 1239 s amended by Ordinance No. 1284. ' NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYFTTEVILLE, ARKANSAS: SECTION 1. That Article IV, Section 5 of Ordinance No. 1239, as amended by Ordinance No. 1425, be amt by adding subparagraph "i." to paragraphs 1, as follows: 1. Uses Permitted X )� i.
