The Board of ,Directors of TheC City of Fayetteville, Arkansas, met in regular session on Monday, June 6,I
1966, at 7:30 P.M. in the Directors Room in the City Administration Building,
Present: City Manager Gerald Fox, Mayor Don Trumbo, City Clerk George J. Davis, Cidly2Attorney Hugh Kincaid,
and Directors: Kerlin, Swartz, McFerran; Melton, And Dunn.
Absent at roll call but later entering: Director Christie.

of the special
session on
Thursday, May 26,
1966, copies
of
which had
previously
been mailed to each of
the
Directors, were
approved
as written.
The City Manager reported that the Airport Improvement Project of 1966, would cost the sum of $65,000.00
of which $60,000.00 would have to be borrowed on a short term loan to be paid back with•the one mill tax
levy as set out in the Budget for 1966.
He further reported that this amount could be borrowed from the two banks in the City at an Interest Rate
of four and one-half (40) per cent per annum or it could be borrowed from theiiWater and Sewer Monthly
Debt transfers ($32,450.00 in June and $27,550.00 in July) at an Interest Rate of four (4%) per cent per
annum either of which would be paid back over a 31 month period.
After a brief discussion, Director McFerran moved that the City Manager be and he is hereby authorized to
borrow the sum of $60,000.00 from the Water and Sewer Refunding Revenue Bond Fund June and July, 1966
transfers, and that this loan be repaid between June 1, 1966, and December 31, 1968, afr Phe rate of 4% pe
annum interest from the revenues received in four yearly installments from the one mill capital improveme:
tax levy.
The motion was seconded by Director Swartz'and passed unanimously.
Director Christie entered at this time and was noted by the Clerk.

The City Attorney introduced and, at the request of the Directors, read a proposed ordinance in its entiret
nance entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 1038 OF NOVEMPER 24, 1952, TO RELEASE AN EASEMENT RESERVED ,
No. 1499 TO THE CITY".
Director Christie moved that the Ordinance pass.
The motion was seconded by Director Kerlin and passed unanimously, whereupon the Mayor declared the
Ordinance passed.

AN ORDINANCE AMENDING ORDINANCE N0, 1038 OF NOVEMBER 24, 1952, TO RELEASE AM EASEMENT RESERVED TO THE CI
I190iEA.
WHEREAS, by Ordinance No. 1038, enacted November 24, 1-952, the City Council of the City of Fayetteville,
arkansas, vacated and abandoned the following described alley in the City of Fayetteville, Arkansas:
All that portion of a twenty (20) foot alley running north from Hazel Street to Holly Street in
Block Two (2) of the corrected plat of South 680 feet, College Addition to the City of Fayetteville,
Arkansas, as designated on the plat of said addition now appearing of record in the Plat Rood at
page 218 thereof in the office of the Circuit Clerk and ExOfficio Recorder for eovashington County
and
WHEREAS) by Ordinance No. 1038, the City Council reserved an easement over and accross the above described
alleyway for construction and maintenance of public utility lines, including the right to tunnel under any
structures built on and across said alleyway, without liability in damages to the abutting property owners, and
WHEREAS, it now appears that neitherrthecCity nor any public utility has ever utilized said reserved easement, and
that no need for it is contemplated, and that the public interest will riot be adversely affected by termi ating said
easement so as to permit full use of the property for construction purposes,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE. ARKANSAS: I SECTION I. THA11
SECTION �. THAT Ordinance No. 1038:of November 24, 1952, is hereby amended by deleting in its entirety the reserve
ation of an easement contained in Section 1 of said ordinance.
SECTION 2. That while it is believed that no utility lines now exist in said alley, as a condition I the

WHEREAS, THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, did on March 23, 1964, enact Ordinance No. 1386,

College Addition to the City of Fayetteville, Arkansas, as designated on the corrected

The Mayor reported that the purpose of the meeting was to discuss the status of the Highway No. 16
project in light of recent developments and to take any action deemed necessary as a result of such
discussions, and that all members of the Board of Directors had been notified by U. S. Mail and by
Telephone.
The City Manager reported that, according to the plans of the Arkansas State Highway Department, more
right-of-way would be needed for the Arkansas State Highway No. 16 Bypass than we now have (45ft) and
that the City land Agent was getting estimates of the cost for the additional right-of-way.
He further reported that most of the extra cost would be along 15th Street west of U. S. highway No. 71.
After a long discussion, the City Manager introduced and, at the request of the Directors, read a propos
resolution in its entirety entitled, " A RESOLUTION BY THE CITY BOARD OF DIRECTORS OF THE CITY OF FAYETT
ARKANSAS, MAKING CERTAIN REWESTS AND A SSURANCES TO THE ARKANSAS HIGFWAY DEPARMME'JT CONCERNING HICH14AY L
