RESOLUTI0N IN SUPPORT OF AFFLICATION' FOR FEDERAL PLAPTNING ASSISTANCE GRANT TO CONDUCT BASIC PLANNING
STUDIES AND bAPPING FOR THE CITY OF FAYETTEVILLE, ARKANSAS, PRIOR TO•THE PREPARATION OF A REGIONAL
URFAN AREA FLAN.
WHEMAS, the City of Fayetteville, Arkansas, has been designated by the Regional Office of the
Department of Housing and Urban Development as a part of a larger urban area and must participate in
a regional program of planning within said urban area in order to be fully eligible for Federal
planning assistance funds, and
WHEREAS, pending organization of such a program and application for assistance within the framework
of the larger urban area, the City of Fayetteville, Arkansas, is critically in need of maps, topography,
economic data, population data, land use and street data in order to alleviate urgent problems obstructi
and blighting the development of the City of Fayetteville,and adjacent urbanizing areas, and
WHEREAS, it is imperative that studies to provide this information be undertaken without further
delay in order to avert irreparable harm to the City of Fayetteville, and to that end the Board of D
of the City of Fayetteville,,deside to submit an application for Federal planning assistance in order
to secure the necessary funds to conduct the basic plAnning studies and mapping herein referred to,
1101'11 THEREFORE, BE IT RESOLVED EY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILTE, ARKANSAS:
SECTION 1. That an application ddr Federal.planning assistance grant under Section 701 df the
Housing Act of 1954, as amended, to conduct the basic mapping and planning studies herein -above
referred to shall be prepared and filed as expeditiously as possible.
SECTION 2.

C. Since the.present City plans were prepared iii 1959, large areas have been annexed to the
City and considerable.development has accurred without up dating and revising the plans.
d. To properly service its rapidly expanding population the City must plan and build major sewer
and water facilities within the next two years, and plans for these facilities must be guided by
thorough population and land use studies.
e. The University,of Arkansas, located in the City, is planning a 50 mil'ion dallar building
program to accomodate•expected growth, and additional space for campus expansion and off campus
housing are urgently needed.
f. The Board of Directors feels that its most urgent task is the planning and consturction of
major and collector street system with integral facilities for drainage of surfact water.
g. The present land use plan is so general that it is inadequate as a guide for zoning, and
many areas of the City are being blighted as a result of imporper zoning controls.
h. The Housing Authority is preparing an apTlication for an urban renewal project, and it is
imperative that this project fit properly into long range plans for land use andstreets.

SECTION 3. For the purpose of building a comprehensive coordinated plan for the entire urban
region, the information obtained through the basic studies and mapping will be made available to
the regional planning organization at its request.
SECTION 4. In recognition of the fact that plans will be prepared for the entire urban
region, topographic, land use and street studies will be prepared for the City and the adjacent
urbanizing area only.
SECTION 5. Realizing that the development and economic health of the City of FRyetteville
are interdependent with the urban region, the Board of Directors agrees to participate actively
in the regional planning agency and its.efforte to make a coordinated, comprehensive plan for the
development of the urban region when it is organized.,

Advisory Committee The Administrative Assistant read a letter from Director Christie recommending that an Advisory
for Parks & Comnitteeibr Parks and Rpereation be appointed.

Director Arnold Christie recommends that an RdvisoryyCommittee for Parks and Recreation
be appointed and financed, if necessary.
The objective will be to surbey the existing parks, recreational facilities and programs
now in existence. The study should recommend programs for improving recreational facilities and
coordinating recreational facilities and the need for expnsicn of.any and all prograge.
Suggested membership of the committee is a s'foll.ows: Sylvia Swartz, Rodney.Ryan, Frances
Woods, Allan ('rilber, Jr., James Brown, Benny Winborn, Joe Taylor, Rip Lindsey, Jim Vizzier and
representative of the Adplt Center (rirs..Newell Shaw) Temporary Advisers.
Directur Dunn moved that the temporary Advisory Committee for Parks and Recreation be appointed
as recommended by Director. Christie with the addition of Mrs. Newell Shaw as a representative
from the Adult Center (provided she would accept) to explie upon competion of the Study when
recommendations are made and accepted. .
The motion was seconded by Director Kerlin and passed unanimously.
Community Conference
Mr. Benny Winborn appeared before.Board of -Directors and gave a report on the Community Conference
on Social Service
on Social Services.
-Commended.
*After a long discussion Director Melton moved that'the City support the County Conference on
"Social
Services in their endeavor to institute a count. --wide study using the facilities of the
Institute.of Community Studies, and that we commend them for their effortt'and suprort them
morally.
The motion was seconded by Director Dunn and passed unanimously.

ORDINANCE REGULATING VEHICLES CARRYING, TRANSPORTING OR MOVING HOUSES, BUILDINGS AND SIMILAR
RUCTURES AND LOADS WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND AMENDING
YETTEVILLE CODE OF ORDINANCES BY ADDING SECTION 19-99, THERETO.
WHEREAS, the practice of moving houses, buildings structures and similar loads by vehicles over the
reets and highways within the corporate limits of the City of Fayetteville, Arkansas, has resulted in
vere disruption of the flow of traffic on the streets and highways within the City of Fayetteville
d has caused substantial hazard to the health and safety of the motoring public, and
WHEREAS, it is necessary to regulate the movement of such cargoeswithin the City of Fayetteville
to provide for the supervision of such traffic by the Police Department of the City of Fayetteville,
nsas.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYET'EVILLE) ARKANSAS,
SECTION 1. That the Fayetteville Code of Ordinances be amended by adding section 19-99 as fbllows:
SECTION 19-99. Regulation of Vehicles Transporting Houses and.Other Structures.
(a) No vehicle or combination of vehicles tarring, transporting or moving.any house,
or similar structure orlC&ad which exceeds with load a total outside width of eight (8) feet, or
a total height of thirteen feet, six inches (13'611), or a total lengAh for single truck of forty
(40) feet, or total lengrA for combination of vehicles of fifty-five (55) feet shall be operated
over the streets or highways within the corporate limits of the City of Fayetteville, Arkansas,
except as provided in this ordinance.
(b) Hours of Movem%nt.
(1) Movement of such oversized vehicles shall be in daylight only, in periods of
visibility, between the hours of 5:30 A.M. to 6:30 A. M., and 8:30 A. M. and 11:39 A. M.
and the hours of 1:00 P. M. to 3:00 P. M. and no movement shall be made on Saturdays,
Sundays or holidays, or on other days when heavy traffic is anticipated over the
routes desired or when weather condition make such movement impractical.
(2) The term "holiday" as used herein means the following holidays: INdependence
Day, Labor Day, Veteran's Day, Thanksgiving Day, Christma6 Day, New Year's Day,
special, general or primary election days.
(c) Appl.ication'and Permit.
(1) A written application for permit shall be filed with the Chief of Police
not later than 24 hours prior to and intended movement, specifying the vehicle and load to be
operated or movej, the route (streets and/or highways) to be followed, the date and time the
movement is desired, and, in consideration for granting of such permit, the aplicant shall assume
(and so state in the application) to streets, Highways or facilities, persons or private property
resulting from such movement.
(2) If in the judgment of the Chief of Folice, or his duly authorized representative,
the movement desired can be accomplished with safety and without undue impediment to the flow of
traffic and can be adequately supervised by the Police Department on the date, time and route requested
a permit shall be issued authorizing said movement. The Police Chief, or his authorized representative
shall have authority to deny the permit, if in his opinion these reguircments cannot be met, or to
prescribe additional condition for its issuance, such as a different route, time or date, or manner
of movembnt or other dition, to insure safe movement of the vehicle in questipn and to irg;gre O
adequate supervision coTthe movemant by the Police Department.
(3) The Police 'Chief, or_his dulq _authorized••represeritative, -shall have authority 'td waive
the. requirements•of this Ordinance as to days of movement,so'as-to•-allow an'oversized vehicle, moving
under'a'State emergency permit) to proceed through the -City on a Saturday; Sunday,or holidays. during the
hours,permitted by this Ordinance, provided -that at the time of such movement the vehicle can be moved
safely and under the supervision of the Police Department.
(d) •Com2L ance with Other -:Laws. All movements .by such :permit shall comply with -all State
and City laws regulating movement of vehicles upon the streets and highways of the City and State, and
nothing in this '0'rdinance'shall be construed'as amending -or affecting''Sections'19-97, 19-98 of the'.,
Fayetteville Code of Ordinances.
(e) Signs: The Chief of 'Police 'shall +cause appropriate•signs'to be.erected,and maintailed
on highways entering.the.City; 'designating the requir.ements:Of the. Ordinance;
(f.): Penal tvl'Any opeiator:found-violatin'g the provisions of this Ordinances: or,any.owne,,
principals -employer, lessors: 1•essee;4geht, or officer.lofqany firm or corporation who permits such
operator -to violate !said provisions shall,be ouilty of a misdemeanor and.upon,first conviction thereof
shall be punished by a fine of not more than one hundred dollars ($100.00) and for a second conviction within
one (1) year shall be punished by a fine of not more than two hundred dollars ($200.00) and for a third
conviction and each successive conviction within one (1) ,year shall be punished by a fine of not morie than
five hundred dollars ($500.00).

SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed and
this ordinance shall be in full force -and effect form and after its passage, approval and publication.

the Bost and Performance Bond and Evidence of proper insurance.
The motion was seconded by Director Melton and passed unanimously.

be given the authority to accept the low bid on the car, since Dierector Melton suggested that if the
car has not arrived when the City Manager comes, the City have an understanding that the low bidder will
furnish a demonstrator until the car arrives.
Director Dunn moved that the Administrative Assistant be empowered to accept the low bid on the
automobile for the O'ity Manager. _
The motion was seconded by Director Kerlin and passed unanimously.
There being no further business Director Melton moved to adjourn.

Director Melton requested thatthe Administrative Assistant outline the history of the relationship
between the City and the Flanning Consultant.
Mr. Jones reported that Mr.•Vizzier was employed in the latter partoof 1964, when the City Council
Authorize payment
recognized the need to relieverMr. Lieberenz of the responsibility of assisting the Planning
to James Vizzier.
Commission. Included in his contract were: (1) Administrative details: (2) Establishment of
planning office; (30) Workable Program recertified, and (4) Utilization of as many Federal
programs as possible.
Five hundred dollars per month was appropriated, to be paid to him until ap?roval of the
Community Renewal Program, which occured in October 1955. He was paid $5,000 in 1965 up to that time,
but no other paymentb have been made to him.
Director'Melton moved that Mr. Vizzier be paid at the rate of $500.00 per month until December 31, 1966
and retroactive tntMirch 1, 1966.
