First meeting�f The Board of Directors of the City of Fayetteville, Arkansas, City Manager Form of Government met for
card of Directors the first time in regular session at the Down Town Motor Lodge on Monday, February 14, 1966 at 7:00 A.M.
Present: City Attorney.Hugh Kincaid, City Clerk George Davis, City Controller Albert J. Jones,
City Engineer W. C. Smith, Chief of Police Hollis Spencer, and Board Members: James T. Kerlin,
Sylvia Swartz, Joe McFerran, G. Melton, Jr., Arnold Christie, Don Trumbo, and Dale Dunn.
Oath of Office The OATH OF OFFICE was administered to each of the Board Memberdsby the County Clerk Mrs.RRuth Roberts.
Trumbo elected Director Don Trumbo was elected Mayor and Director Sylvia Swartz was elected Assistant Mayor by

The City Attorney introduced and, at the request of the Board of Directors read a proposed Ordinance
in its entirety entitled, "AN ORDINANCE ESTAELISHING THE TIME AND PLACE FOR REGULAR MEETINGS OF THE
BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, A"1D REFEALING SECTIONS 2-2 AND 2-3, CODE

Director Chiistte moved that the Ordinance pass.
The motion was seconded by Director Kerlin and passed unanimously, whereupon the Mayor declared the

ORDINANCE N0. 1488
' AN ORDINANCE EBTAELISHING THE TIME AND PLACE FOR REGULAR MEETINGS OF THE PDARD OF DIRECTORS OF THE
CITY OF FAYETTEVILLE, ARKANSAS, AND REPEALING SECTIONS 2-2 AND 2-3, CODE OF ORDINANCE, OF THE
CITY OF FA"ETTEVILJ ARKANSAS.
WHEREAS, under applicable Law of the State of Arkansas, it is the duty of the Board of Directors
to establish regular meeting days for said Board, within the first and thdsd weeks in each calendar
month,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That regular meetings of the Board of Directors shall be held on Monday in &he first
and third weeks of each calendar month at 7:30 P. M. in the City Council Rood of the City
Administration Building.
SECTION 2. That when any such meeting falls on a legas holiday, the meeting shall be held on a
substituted date fixed by adjournment at the last preceding meeting.
SECTION 3. That Sections 2-2 and 2-3, Code of Ordinances, of the City of Fayetteville, Arkansas,
and all other ordinances or parts of ordinances in conflicty herewith are hereby repealed.
SECTION 4. That in order to comply with the laws of the State of Arkansas calling for regular
meetings within the first and third weeks'of each calendar month and because of the need to provdde
for the continued operation of the City of Fayetteville, an emergency is declared to exist and this
Ordinance being safety, the same shall be in full force and effect from and after its passage.

The motion was seconded by Director Kerlin and passed unanimously.

A RESOLUTION ESTABLISHING AOTHORITY TO SIGiN CHECKS ISSUED BY THE CITY OF FAYETTEVILLE, ARKANSAS, UNTIL
A MANAGER IS EMPLOYED, OR UNTIL SOONER TERMINATED BY RESOLUTION OF THE BOARD OF DIRECTORS.
WHEREAS, various ordinances of the City of Fayetteville, Arkansas, require the signature of
two persons on City checks, the City Treasurer or Controller and usually the Mayor, or in some
instances the Superintendent of the Water and Sewer Departments or some other person designated by the
City, and
WHEREAS, Checks for the Fi'remen's'Relief and Perision Fund are: signed by the:Mayor`and City-
Treasurer, and
WHEREAS, checks for the Policemen's Pension and Relied! Fund are signed by the City Treasurer,
the Chairman and Secretary of the Policemen's Pension and Relief Fund Board of Trustees, and the
Chairmanship of that Board has been vacated by reason of the fact that the Chairman was Chairman of
the Police Committee of the City Council, and
WHEREAS, in order to rrovide for the continued operation of the City of Fayetteville pending
employment of a City Ma$er,1�t._i's-necessary to designate persons to sign checks issued by the City
and said Funds,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 2. That all checks issued form the Firemen's Pension and Relief Fund shall be signed
by the Superintendent of the Water and Sewer Departments and the City Treasurer.
SECTION 3. That all checks issued form the Policemen's Pension and Relief Fund shall be
signed by the City Treasurer, the Action Chairman of the Board of Trustees of said Fund-- who shall be
elected from the Board's present membership, and the Te retary of said Board.
SECTION 4. That the authority conferred by this Resolution shall be exercised consistent
ftth the applicable ordinances of the City of Fayetteville, the laws of the State of Arkansas, and the
gpproved Budget of the City of Fayetteville, and such authority shall continue until a City Manager

TERMINATED BY RESOLUTION OF THE BOARD OF DIRECTORS.
WHEREAS, Sections 2-64 through 2-68, of the Code of Ordinances, City.oY.Fayotteville, Arkansas,
establish the procedures and authority for purchases BB supplies, apparatus, equipment, materials, and
other things requisite for public purposes in and for the City, and for making all contracts for work or
labor to be done, materials or other necessary things to be furnished for the benefit of the City,
or in carrgmng out any work or undertaking of a public nature therein, and
WHEREAS, in order to provide for the continued operation of the City of Fayetteville, Arkansas,
until such time as a City Manager is employed, it is necessary to appoint a person to exercise the
authority conferred by said Sections of the Code of Ordinances upon the "Mayor or his duly authorized
representative,"
NOW, THEREFORE, BE IT RESOVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the Superintendent of the Water and Sewer Departments shall be authorized to
exercise the powers conferred upon the "Mayor or his duly authorized representative" by Sections
2-64 through 2-68, of the Code of Ordisanees of the City of Fayetteville, Arkansas, and he shall sign
purchase orders therefor.
SECTION 2. That the authority conferred by this Resolution shall be exercised by said person
in conforiAy with the procedures and monetary limitations provided in the said Sections of the Code
of Ordinances; provided that the competitived bidding provisions of Sections 2-67 and 2-68 shall nbb
apply in the case of car -load purchases for routine operations for the Plater and Sewer Department.
SECTION 3. That the authority vested in said person shall continue until a Citi Manager is
employed or until such authority is sooner terminated by ap?ropriate resolution of the Board of Dire

The Mayor appointed Directors Dale Dunn, James Kerlin, and Sylvia Swartz to act as a Steering Committee
Appoint Steering to solicit and receive applications for City Manager and to prepare a synopsis of the applications
Committee and present to the Board of Directors for their study.
Board At this time Director Kerlin announced his resignation from the Board of Adjustment and Directors
Resignations Melton and Trumbo announced their resignation from the Board of Appeals, all of which were to be in eff
as of February 14, 1966.
After a brief discussion the Board of Directors agreed to meet on the Monday afternoon at / bI0 o'dlock
one week before the regular meeting whiehiis on the first and third Monday of each month.
There being no further business, Director Melton moved to adjourn.
The motion was seconded by Director Kerlin and passed unanimously, whereupon the Mayor declared the
meeting adjourned.

WHEREAS, notice of said public hearing, setting forth the date, time, place and purpose
said hearing and location of property was published intthe Northwest Arkansas Times, a newspaper
general circulation in said City, more than 15 days prior to said public hearing, and
WHEREAS, following said public hearing, said Planning �otmnission certified to the Board of
ectors of the City of Fayetteville, Arkansas, its recommendation that an ordinance be adopted
oning the above-described Property which is presently zoned R-2 Tao Family ResidentiAl District,
R-3 Multi-Fandly Residential District.

The City Planner presented the petition of Donald Williams and Bill Bequette to rezone certain real estat
(Rezoning property
located on the east side of Dunn Avenue from R-2 Two -Family Residential District to R-3 Multi -Family
of Donald Williams
Residential District which had been approved by the Planning Commission.

After a brief discussion, the City Attorney introduced and, at the request of the Directors,, read a
Proposed ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING ZOMING ORDINANCE
N0. 1239, AND REVISED ZONING DISTRICT MAP -OF FAYETTEVILLE, ARKANSAS, APPROVED MAY 28 1962, TO REZONE
CERTAIN REAL ESTATE FROM R-2 TWO FAMILY RESIDENTIAL DISTRICT TO R-3 MULTI -FAMILY RESIDENTIAL DISTRICT."
Director Christie moved that the rule be suspended and the Ordinance placed on the second reading.
The motion was seconded by Director Dunn and passed unanimously.
The Ordinance was then read for the second time.
The Mayor then declared the Ordinance open for discussion. There being no discussion, Director Christie
moved that the rule be further suspended and the Ordinance placed on the third and final reading.
The motion was seconded by Director Kerlin and passed unanimously.
The Ordinance was then read for the third and last time.
The Mayor then asked the question,"Shall the Ordinance pass?"
Upon roll call the following vote was recorded, "Aye" Kerlin, Swartz, McFerran, Christie, Trumbo, and Dun
"Nay" None.
There being six "Ayes" and No "Nays", the Mayor declared the Ordinance passed.

AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1239, AND REVISED ZONING DISTRICT MAP OF FAYETTEVILLE,
ARKANSAS, APPROVED MAY 28, 1962, TO REZONE CFRTAIN REAL ESTATE FROM R-2 TWO FAMILY RESIDENTIAL DISTRICT
TO R-3 MULTI -FAMILY RESIDENTIAL DISTRICT.
WHEREAS, a public hearing was held before the Planning Commission of the City of
Fayetteville, Arkansas, on February 15, 1966, of the petition of Donald Williams and Bill Eeguette, .
