HomeMy WebLinkAbout1966-01-17 MinutesDo The City Council of Fayetteville, Arkansas, met in regular session on Monday, January 17, 1966, at 7:30 P in the Council Room of the City AdministaAtion Building. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Hugh Kincaid, City Engineer W. C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Christie, Watson, .Thomas, Burgin, Faucette, and Bone. Absent: Alderman Wells Bone. The minutes of the regular meeting on Monday, January 39 1966, a copy of which had previously been mailed to each of the Aldermen, were approved as written. The City Attorney presented a County Court Order whereby the Court had ordered the annexation to the City 0f Fayetteville, Arkansas, all the City owned property at Lake Sequoyah, as petitioned by the City of gyetteville. After a brief discussion, the City Attorney introduced and, at the request of the.Council, read a propose b ordinance in its entirety for the first time entitled, "AN ORDINANCE ACCEPTING TERRITORY TO THE CITY OF Q_ FAYETTEVIILE, ARKANSAS, ASSIGNING SAID TERRITORY TO WARDS, AND FOR OTHER PURPOSES". - soy Alderman Christie moved that the rule be suspended and the Ordinance placed on the second reading. { The motion was seconded by Alderman Thomas and passed unanimously. The Ordinance was then read for the second time. The Mayor then declared the Ordinance open for discussion. -There being no further discussion, Alderman Short moved that the rule be further suspended and that the Ordinance be placed on the third and final reading. The motion was seconded by Alderma n Christie and pa=ssed unanimously, whereupon the Mayor declared the motion passed. The Ordinance was then read for the third and last time. The Mayor then asked the question, "Shall the Ordinance pass?" Upon roll cell the following vote was recorded, "Aye" Heflin, Christie, Watson, Thomas, Burgin, Fqucette, and Short. "Nay" None. There being seven "Ayes" and No "Nays", the Mayor declared the Ordinance passed. ORDINANCE N0. 1479 AN ORDINANCE ACCEPTING TERRITORY TO THE CITY OF FAYETTEVILLE, ARKANSAS, ASSIGNING SAID TERRITORY TO WARDS AND FOR OTHER PURPOSES. WHEREAS, the County Court of Washington County, Arkansas, did on December 15, 1965, enter an order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: All those parts of Sections 8, 9, 16, 179 200 21, 22, 23, 26, and 28 all in T -16-N, R -29-W, of the Fifth Principal Meridian in Washington County, Arkansas, containedwithin the boundary more particularly descri' as follows, to -wit: Beginning at the southeast corner of the NE 1/4 of Section 17, thence in a northerly direction to the southeast corner of the north 666 feet of the SE 1/4 NE 1/4 of Section 17; The lands enclosed in the above description involve an area of 1,284.06 acres, of which 32.8 acres lie within the corporate area of the City of Fayetteville, Arkansas, leaving a net of 1,251.26 acres to be annexed. The above descrippibn covers all the City of Fayetteville, Arkansas ogned property in and around Lake Sequggh and no other lands, and, WHEREAS, the County Clerk of Washington County, Arkansas, has forwarded a transcript of slid to the City Council of Fayetteville, Arkansas, and WHEREAS, more than thirty days have elapsed since the date of said order, and no proceeding has instituted in the Circuit Court to prevent said annexation, and no notice thereof has been given as by law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That annexation of the above-described territory to the corporate limits of the City of Fayettetille, Arkansas) be and the same is hereby accepted, and all of said territory is hereby assigned to and 'made a part of ward three (3) of the City of Fayetteville, Arkansas. WHEREAS, there has been duly presented td the City Council of the,City of Fayetteville, Arkansas, plat dated April 19, 1965, known as Hillside Addition to the City of Fayetteville. Arkansas, in which t owners have dedicated for the public use the streets, alleys and easements shown upon said plat; and WHEREAS, the City Planning tommission,of the City of Fayetteville, Arkansas, has recommended the acceptance of said p38t; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. WHEREAS, there has been duly presented to the City Council of the City of Faybbteville, Arkansas, a plat dated June 30, 1965, known as Sequoyah Heights to the City of Fayetteville Arkansas, in which the owners have dedicated for the public use the streets, alleys and easements shown upon said plat; and WHEREAS, the City Planning Uommission of the City of Fayetteville; Arkansas, has recommended the acceptance of said plat; NOW, THEREFORE, BE TT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the dbdication of all streets, alleys and easements in the Sequoyah Heights Addition to the City of Fayetteville, Arkansas, and hereby declares said streets, alleys and easements to Bekpublic streets, alleys and easements, and ti City Council hereby assumes the care, control and jurisdiction of the same. APPROVAL: lim � • ,d �� s , Alderman Burgin moved that the City Clerk be and he is hereby authorized to excute a release deed for All lots in Sequoyah Heights Addition to the City of Fayettefellie, Arkansas, as per plat of said Add on file in the office of the Circuit Clerk and Ex -Officio xecorder of Washington County, Arkansas. The motionviwas seconded by Alderman Thomas and passed unanimously. Alderman Burgin reported that Bids had been received and opened for two loaded -digger tractors for the Water and Sewer Department. AldermannBurgin then read a'letter from the Water Superintendent wherein he recAmmended the purchase of the two loader -diggers from the low bidder, which was the one from the Davis Equipment Co „ Springdale, Arkansas, at a net cost of $9,456.84 including a trade-in of the two old loader -diggers now in use. Alderman Burgin'then moved to accept the recommendation of the Water Superintendent and purchase two Case loader -diggers from the Davis Equipment Co., Springdale, Arkansas, at a total cost of $19,343.40 less a trade-iri of two old loader -diggers for the sum of $9,886.56 or a net cost to the City of $9,456. The motion was seconded by Hlderman Short and'passed unanimously. Appoint The Mayor reported that Mr. John I Smith had resigned from the Board -of Adjustment and he recommended J. F. Palmer that Mr. J. F. Palmer be appointed to fill this vacancy. Board of Adju Alderman Christie moved to accept the recommendation of the Mayor and appoint Mr. J. F. Palmer as a Adjustment member of the Board of Adjustment Vice Mr. John I. Smith effective as of January 1, 1966 and sgid term to expire January 1, 1968. The motion was seconded by Alderman Watson and.passed unanimously. No. 1-66 453 Alderman Christie read a petition from 0. H. Gamble and Christine Gambl&,husband and wife, Buell B. Woods and Lillian C. Woods, husband and wife, Murray F. Lewis and William A. Lewis requesting the City to vacat and abandon a portion of an alley in A. L. Trent Subdivision of Oak Grove Addition to the City of Fayetteville, Arkansas.' The City Attorney read a proposed resolution entitled, " A RESOLUTION SETTING A HEARING ON A PETITION TO VACATE AN ALLEY AND PROVIDING FOR NOTICE OF SAID HEARING." Alderman Short moved the Resolution be adopted. The motion was seconded by Alderman Heflin and passed unanimously, whereupon the Mayor declared the Resolution adopted. RESOLUTION NO. 1-66 A RESOLUTION SETTING A HEARING ON A PETITION TO VACATE AN ALLEY AND PROVIDING FOR NOTICE OF SAID HEARING. WHEREAS, a petition has been filed with the City Council of the City of Fayetteville, Arkansas, by O. H. Gamble and Christine Gimble; Buell B. Woods and Lillian C. Woods; Murray F. Lewis and William A. Lewis, requesting the City Council to vacate and close the following described portion of an alley in A. L. Trent Subdivision of Dak Grove Addition to the City of Fayetteville, Akkansas, and in Block 14 Revised Plat of Blocks 14 and 15 in City Park Addition to said City, to -wit: BEGINNING at the Southwest corner of Lot (4) in Block (3) of A.
