WHEREAS, the,City Council df the City.of Fayettecille has authorized a program of construction of
sewerage works at an estimated cost of $3,854,x•00 and the Udited $tater Government, acting through thh
Public Health Service, has offered a federal grant in the amount of $1,103040.O00as designated on Part A
Offer and Acceptance, now under consideration by this body.
NOW, THEREFORE, BE TT RESOLVED by the City Council of the City of Fayetteville, that said offer as
fitted, together with the terms and conditions thereof, is hereby accepted and approved; and that
S. Brown, `ayor, of the City of Fayetteville, it hereby authorised and directed to sign said Offer
ptance and nay other necessary documents required to complete the project on behalf of said city.
BE IT FURTHER RESOLVED that the City of Fayetteville has or will procure a fee simple or such other
estate or interest in the site of the project, including the necessary easements and right-of-way, as to
assure undisturbed use and ppssession for the purposes of construction, operation add maintenance of the
works for the estimated life of the' project; and that in the event such title, estate, or interest in suc
site, easements or rights-of-way in the future may be contested, the City of Fayetteville will defend and
maintain its title in such site and hold the United States Government blameless in such action; and that
before any federal payment is requested pursuant to said grant, said city will provide certification as t
the sufficiency of such estate or interest.
PASSED, APPROVED AND ADOPTED at a meeting of the City Council of the City of Fayetteville,on the
20th day of December, 1965.

Alderman Christie moved that the City Clerk be and he is here by authorized to excute a release deed for
All Lots and Blocks in Virginia Hills Addition to the City of Fayetteville, Arkansas, as per plat of said
Addition on file in the. office of the Circuit Clerk and ExXfficio Recorder of Washington County, Arkansas.
The motion was seanned by Alderman Short and passed unanimously.
Alderman Short moved to approve the Budget for General Find for 1966 as presented by the City Conto113r
and recommended by the Finknce Committee.
The motion was seconded by Alderman Faucette and passed unanimously.
There being no further business Alderman Faucette moved to adjourn.
The motion was seconded by Alderman Bone and passed unanimously, whereupon the Mayor declared the
adjourned. i

Present: Mayor Guy E. Brown, City Controller Albert J. Jones ity Attorney ugh Kincaid, and Alderman
Heflin, Christie, Watson, Thomas Burgin, and Short.
Absent: Alderman Bone and Faucette.

with Urban Renewal powers, to appoint Commissioners of skid Housing Authority, and to designate said
q Commissioners to serve for terms of one, two, three, four, and five, years, respectively, from the date
0 their appointment, and to pass the Public Works Budget for 1966, and that all members of the Council had
been notified by letter and by telephone, but Alderman Bone and Faucette were unable to attend, however
they had waived notice of the meeting.

Comes now the undersized, being a duly elected, qualified, and acting members of the City Council
of the City of Fayetteville, WA and specifically waives notice of a special meeting of the Fayette
City Council to be held in the City Couhcil Room of the City Administration Building, Fayetteville, Arkan
at 12:00 o'clock Noon, on December 29, 1965.

Alderman Burgin moved to approve the appointment of the Commissioners of Housing Authority as
by the Mayor and outlined above.
The motion was seconded by Alderman Short and passed unanimously. .
Alderman Watson moved to approve the Budget for the Street Dept., Sanitation Dept., and the Shop Dept.
for the year 1966 as presented by the City Controller and recommended by the Finance Committee.
The motion was seconded by Alderman Short and passed unanimously.

WHEREAS, under the provisions of Act 298, 1937 Acts of Arkansas, as amended, and Act 212, 1945 Acts
of Arkansas, as amended, Housing Authorities were created in each City of the State of Arkansas, and
vested with certain powers and authority pertaining to housing in said cities, and vested with certain
urban renewal and development powers and authority in mild cities, and
WHEREAS, under the aforeslid Acts, as amended, before a Housing Authority of a city is empowered to
transact any business or exercise the powers so authorized, the city must determine and declare by proper
resolution that there is a need ddr an authority to funcition in said city and that it is in the public
interest to elect for said Authgrlby to also have the powers epnderred by said Acts, an amended, 40r
urban renewal and development, and
WHEREAS, the City Council of the City of Fayetteville, Arkansas at a special meeting on Dedember
2ft' 1961, by motion only, attempted to appoint a Board of Housing Abthority and Urban Renewal, but did
not by proper resolution make the'nedessary.determinations and election to have powers, as requirdd by
law, in carder to validly constitute said Housing Authority and epafer geitsbng, urban renewal and developme
powers thereon; and the Board so appointed at said 'Speciarmeeting;_never-having form l ly_organi`zed itself
transacted any business or exercised any powers, and not being validly established according to the Laws
of Arkansas, it is deemed in the best interest of'the public to rescind the motion made at said special
meeting, and proceed in the manner prescribed .by law to establish a validly constituted Housing Authority,
with the powers as aforesaid, and provide for the appointment of Commissioners of said Authority, and
WHEREAS, the City Council of the City of Fayetteville, Arkansas, finds that insanitary and unsafe

inhabited dwelling accomodations exist in the City of Fayetteville, Arkansas, and that there is a shortage
of safe or sanitary dwelling accomodations bn said City available to persons of.low income at rentals they
can afford; and that there is a need for a Housing Authority in shad City; and that it is to bbe best
interest of the public that the City of Fayetteville, Ar#ansae elect bb have and confer upon said Housing.
Authority all such powers and authority per6aining to housing and urban renewal and development authorized
by the aforeslid Acts,aand amendments thereto.
NOW, THEREFORE, BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the motion at a special meeting of the pity Council on December 28, 1961, attempting
to appoint a Board of Hofising Authority and Urban Renewal be and the same is hereby rescinded and renders
of no effect whatsoever.
SECTION 2. That a need is hereby determined and declared to exist for a Housing Authority in the
City of Fayetteville, Arkansas; and that it is in.the public interest that said Housing Authority have
all powers authorized by Act 298, 1937 Acts of Arkansas, as amended, and Act 212,.1945 Acts of Arkansas,
as amended, including powers of urban renewal and development.
SECTION 3,. That a Housing Authority for the City of Fayetteville, Arkansas, is hereby established
and determined to exist, and said Authority shall have and there is hereby vested in and conferred upon
it all powers and authority authorized by Act 298, 1937 Acts of Arkansas, as amended, and Act 212, 1945
Acts of Arkansas, se amended, including powers of urban renewgl and development.
SECTION 4. That the Mayor of the City of Fayetteville, Arkansas, is hereby authorized and directed
as provided in the Acts and amendments aforesaid to appoint five (5) persons as Commissioners of said
Housing Authority, and to designatedaaid Commissioners to serve for terms of one, two, three, four and
five years, respectively, from the date of theft appointment.
