Present Mayor,Gq E. Brown, City Clerk, George J. Davis,*City Controller,Albert J. Hones, City Attorney Hugh Kincaid, City Engineer W. C. Smith, Chtbf of Police Hollis Spencer, Fire Chief Burl Skelton and Alderman Heflin, Christie, Watson, Bone, Thomas, Faucette, and Short. Absent Aldermen Burgin. The minutes of the regular meeting on Monday,December 69 1965, a copy of which had previously be mailed to each of the Aldermen, were approved as written. The City Planner read a resolution from the Planning Commission recommending the acceptance of deeds for a forty foot street. _ After a long discussion the City Attorney inteoduced and, at the request of the Council, read a proposed %S ordinance in its entirbty entitled, "AN ORDINANCE OT ACCEPT AND CONFIRM THE DEDICATION OF CERTAIN LAND FOR THE PURPOSE OF A PUBLIC STREET IN THE CITY OF FAYEPTEVILLE, ARKANSAS." Alderman Short moved that the rule be suspended and the Ordinance be placed on the second reading. The motion was seconded by Alderman Christie and passed unanimously. The Hadinance was then read for the second time. The Mayor then declared the Ordinance open for discussion. There being no discussion, Alderman Short moved that the rule be further suspended and the Ordinance placed on the third and final reading. The motion was secondddbky Alderman Christie and passed unanimously.. The Ordinance was then read for the third and last time. The Mayor then &liked the question," Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Heflin, Christie, Weston, Bone, Thomas, Faucette, and Short. "Nay" None. . There being seven "Ayes" and no "Nays" the Mayor declared the Ordinance passed. ORDINANCE NO. 1475 AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF CERTAIN LAND FOR THE PURPOSE OF A PUBLIC STREET IN THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a warranty deed from Bill House and Olga House, husband and wife, and Tony Latrechia and Bernice Latrechia, husband and wife, dated December 17, 1965s wherein the grantors grant,*bargain and sell u6to the City of Fayetteville, its successors and assigns, the following described tract of lands situated in Washington Bounty, Arkansas: A part of the Fractional East Half (Frl. ED of the Northwest Quarter (NW�) of Section 3, Township 16 North,,Range 30 West, being more particularly described as follows; to -wit: Beginning at a point which is 236.78 feet East and 20 feet South of the Northwest corner of the above metioned quarter section; thence South 155 feet; thence 30.8 feetEEast; thence 81.1 feet South; thence West approximately 38.5 feet to a point 229.3 feet East and 256.09 feet South of the Northwest corner of said quarter section; thence North 0825' West 236.1 feet; thence 9.2 feet East to the point beginning. Township 17 :• North, Range 29 West, together with all•the improvements for the sum of $50,000.00, of which $1,000.00 had been paid to secure the option. Alderman bone further moved to exercise the option and purdhaee another tract of land from C. A. and Nary A. The motion -was seconded by Alderman Fancette and passed unanimoubly, agreeded to Alderman Bone moved that the City agree to enter into a contract for furnishing water and helping finance furnished4ater to a proposed Suburban Water District to be formed in the Vicinity of Elkins, Arkansas, said contract to be Elkins. the same form as agreed to with Suburban Water District No. 7 with an added provision to exclude an Federal or other grants to determine initial costs. ORDINANCE N0. 1476• AN ORDINANCE DISSOLVING STREET IMPROVEMENT DISTRICT N0. 58 OF THE CITY OF FAYETTEVILLF, ARKANSAS, AND TERMINATING THE BENEFIT ASSESSMENTS PRESENTLY BEING LEVEED IN SAID DISTRICT. WHEREAS, by Ordinance No. 1019 the City Council of the City of Fayetteville, Arkansas, established Street Improvement District No. 58 for the purpose of draining, grading, paving and otherwise impeoving Hill Avenue from the South line of Wall Street to Seventh Steeet, Seventh Street from Hill Avenue to Duncan Avenue, Duncan Avenue from Seventh Street t6 Garland Avenue, Garland Abenue South from its intersection with Brooks Avenue to the North line.of the right of way of the St. Paul Branch of the St. Louis - San Francisco Railway Company,,and WHEREAS, by Ordinance No. 1030 the City Council Bf thedCity.:afaFayetteville, Arkansas, levied an a assessment for benedits in Street Improvement District N.. 58 for 1953 and annually thereafter until the whole of said local assessment be paid, and WHEREAS, a petition was filed with the City Council -of -the City of••Fayettevil]:e; Arkansas on tovember 26, 1965, ty the Commissioners of Street Improvement District No. 58, reporting that the bonded indebtedness of^said District has been retired aiid'•that all refundb of surplus assessments have been substantially completed, and that the only funds remaining to the credit bf the District are those necessary to wind up the affairs of the District, and WHEREAS, said petition requests that the City Council of the City of Fayetteville, Arkansa an ordinance dissolving Street Improvement District'No. 58, of Fayetteville, Arkansas and removing and terminating the benefit assessment presently levied against the real property in said District. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. Street Improvement District No. 58.of the Citi of Fayetteville, Arkansas is hereby dissolved and the benefit assessments presently being levied against the real property in said district for the purpose of retiring the bonded indebtedness of said District are herbtytterminated and removed. SECTION 2. A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the County Collector of Washington County, Arkansas, SECTION 3. That all ordinances or partsof ordinances in conflict herewith are hereby repealed, and this Ordinance shall be in full force and effect from and after its passage, approval and publication. Sewer set RESOLUTION 19-65 WHEREAS, the:City Council df the City.of Fayettecille has authorized a program of construction of sewerage works at an estimated cost of $3,854,800.00 and the United States Government, acting through thb Public Health Service, has offered a federal grant in the amount of $1,103,940.000as designated on Part A Offer and Acceptance, now under consideration by this body. NOW, THEREFORE, BE TT RESOLVED by the City Council of the City of Fayetteville, that said offer as submitted, together with the terms and conditions thereof, is hereby accepted and approved; and that Guy S. Brown, `ayor, of the City of Fayetteville, it hereby authorised and directed to sign said Offer Acceptance and nay other necessary documents required to complete the project on behalf of said city. BE IT FURTHER RESOLVED that the City of Fayetteville has or will procure a fee simple or such other estate or interest in the site of the project, including the necessary easements and right-of-way, as to assure undisturbed use and ppssession for the purposes of construction, operation afid maintenance of the works for the estimated life of the project; and that in the event such title, estate, or interest in sue site, easements or rights-of-way in the future may be contested, the City of Fayetteville will defend and maintain its title in such site and hold the United States Government blameless in such action; and that before any federal payment is requested pursuant to said grant, said city will provide certification as t the sufficiency of such estate or interest.
