ORDINANCE N0. 1474 AN ORDINANCE FIXING THE DUTIES AND THE METHOD OF COMPENSATION DF THE CITY ATTORNEY OF THE CITY OF FAYETTE ARKANSAS, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH, INCLUDING SECTION 2-102 2-111 CODE OF ORDII WHEREAS, the City Council of the City of Fayetteville, through its Finance Committee, has now study of the duties and compensation of the office of City Attorney of the City of Fayetteville, . WHEREAS, in furtherance of said study, an advisory committee composed of three practicing attorneys of the Washington County Bar Association, were appointed to make an independent study of the duties and compensation of said office and to make recommendations pertaining thereto, and WHEREAS, said advisory committee after examination of the duties and time required of said office, prevailing compensation for such work in this vicinity, and after conducting a study of the duties and 'compensation of 'said office in five other cities in the State of Arkansas comparable in size to this City ihas made and repmrted its recommendations to the City Council, and WHEREAS, The City Council, agter due consideration Bf said studies and the recommendations of said advisory committee and the Finance Committee, is desirous of implementing said recommendations. 6 N("? The duties of the City Attorney of the City of Fayetteville, Arkansas shall be as fmllows: A. To prosecute all cases whether civil or criminal involving the violation or enforcement of city ordinances before the municipal court Snd to prosecute or defend all appeals of such cases from the municipal court to the circuit court. Be To preform routine duties for the water and sewer departments, to funnish legal advice to the Mayor or City Manager, City Council Aldermanoor Board Member, Chief of Police, Chief of the Fire Department, City Controller, City C1erk,'Chairman of the Civil Service Commissions, and Chairman of the Planning commission, and all other city official's and administrative heads of departments of the city whether elected, appoints, or employed by the city. C: To draft all ordinances, resolutions, contracts, leases, conveyances, bonds, and such other instruments of writing as may be required by the business of the city. D. To furnish written opinions ppon subjects of a legal nature relating to the affairs of the city goternment requestdd by any dity official or administrative department head. E. To attend City Council meetings and upon request any meeting therefor, any meeting ofany commit of the City Council, and any meeting of the civil service commission, board of adjustment, board of appeals, planning commission, or any other administrative board of the City government. SECTION 2. Compensation. The regular salary of the City Attorney and a regular allowance for inci- dental expenses incurred in connection with the perdormance of his duties, shall be established by the mt annyal budget. Said salsary shall be full compensation for all services required by Section of this ordinance to be performed by the City Attorney, SECTION 3. Additional Services. The City Attorney shall receive additional compensation in the eve: t he is called upon to render services in connection with improvement districts, bond issues and other al matters not specified in Section 1 of this Ordinance, and when he is called upon to render legal vices in any situation where the City of Fayetteville is involved in a cause pending to the Circuit, neery or County Court of the State of Arkansas, or the United States District Court; or in appeals to Supreme court of the State of Arkansas, the United States Court of Appeals and the Supreme Court of t. ted States, or in any other legal proceeding not otherwise provided for in Sectton 1 of this Ordinance SECTION 4. Sedtions 2910, and 2-11 of the Code of Ordinances, City of Fayetteville, Arkansas, and all other ordinances or parts of ordinances in conflict herewith, are hereby repealed, and this ordinance dhall take effect from and after its passage, approval and publication.. SECTION %. The provisions of this ordinance shall be included and incorporated intthe Code of Ordinances of the Eity of Fayetteville, Arkansas, as an addition or amendment thereto, and shall be appro riately renumbered to conform to the uniform unmbering system of the Code. There being seven "Ayes" and no "Nays" the Mayor declared the Ordinance passed. ORDINANCE N0. 1475 AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF CERTAIN LAND FOR THE PURPOSE OF A PUBLIC STREET IN THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a warranty deed from Bill House and Olga House, husband and wife, and Tony Latrechia and Bernice Latrechia, husband and wife, dated December 17, 1965, wherein the grantors grant,'bargain and sell into the City of Fayetteville, its successors and assigns, the following described tract of lands situated in Washington Bounty, Arkansas: A part of the Fractional East Half (Frl. W of the Northwest Quarter (NW�) of Section 3, Township 16 North,,Range 30 West, being more particularly described as follows; to -wit: Beginning at a point which is 236.78 feet East and 20 feet South of the Northwest coiner of the above metioned quarter section; thence South 155 feet; thence 30.8 feetEEast; thence 81.1 feet South; thence West approximately 38.5 feet to a point 229.3 feet East and 256.09 feet South of the Northwest corner of said quarter section; thence North 0825' West 236.1 feet; thence 9.2 feet East to the point beginning. And in addition, all that land not included in the above description which is within a c circle having a radius of 40 feet from its center point which is located 229.3 feet East and 256.09 feet South of the Northwest corner of said quarter section. M WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a warranty deed from James Doyle Shelton and Welma Doris Shelton, his wife, dated December 17, 1965, wherein the grantors grant, bargain and sell unto the City of Fayetteville, its successors and assigns, the following described land situated in Washington County, Arkansas, to -wit: A part of the Fractional East one-half (Frl. 4) of the Northwest Quarter (NW�) of Section 3, Township 16 North, Range 30 West and being more particularly described as follows: Beginning at a point which is 236.78 feet East and 20 feet South of the Northwest corner of the above mentioned eighty; thence East 30.8 feet; thence South 155 feet; thence West 30.8 feet; thence Norbh 155 feet to the point of beginning. M WHEREAS, the Planning Commission of the City of Fayetteville, Arkansas recommend the acceptance of the above described lands for the purpose of a public street in the City of Fayetteville, Arkansas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the dedication and grant of the above-described land, and hereby declares said land to be a public street, and the said Citi Council hereby assumes the care, control and jurisdiction of same.
