City Property for the year of 1965 (to be collected in 1966), which is an increase of two mills over 196, After a brief discussion, Alderman Short moved that a tax of 16 mills be levied on all City Property for the year of 1965 (to be collected in 1966) to be allocated as follows: PURPOSE LEVY General Government Operations 5.0 Mille General Obligation Bond Fund 4.0 " Police Pension Fund 1.0 " Fire Pension Fund - 1.0 " Fire Protection 3.7 " Park.Maintenance. .3 " Capital Improvements 1.0 ." Total Tax Levy 16.0 Mills being no further business, Alderman Watson moved to adjourn; The motion was seconded by Alderman and passed unanimously, whereupon the Mayor declared the meeting adjourned. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Christie, Watson, Bone, Thomas, Burgin, and Faucette. Absent: Alderman Carter Short. The minutes of the regular meeting on Monday, November 8, 1965, a copy of which had previously been to each of the Aldermen, were approved as written. The City. Planner, James Vizzier, presented the petition of Jerry Sweetser to rezone certain real estate at the Northwest corner of the intersection of Gregg Avenue and North Street, klach had been discussed at the regular meeting on October 25, 1965, and which had been recommended by the Planning Commission. A large group of property owners living in this area appeared in opposition to the rezoning and after a very long discussion, the City Attorney introduced and, at the request of the Council, read in its entirety a proposed ordinance entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1239, AND REVISED ZOM DISTRICT MAP OF FAYETTEVILLE, ARKANSAS,.APPROVED MAY 282 19620 TO REZONE CERTAIN REAL ESTATE FROM R -1B SII FAMILY RESIDENTIAL DISTRICT TO R-3 MULTI -FAMILY RESIDENTIAL DISTRICT AND C-2 THOROUGHFARE COMMERCIAL DIST] Alderman Burgin moved that the rules be suspended and the ordinance be placed on the second reading. The motion was seconded by Alderman Heflin and upon roll call the following votes were recorded, "Ayes: Heflin, Bone, and_Burgin, "Nay": Christie, Watson, Thomas, and Faucett. There being three "Ayes" and four "Nays", the motion to suspended the rule was defeated for lack of a too -thirds majority vote and the Ordinance was left on the first reading. Ordinance The City Planner, James Vizzlerr presented the petition of A. T. Parlor and Hazel E. Parker, husband and No. 1470 wife, and Herbert L. Storthz have petitioned for a change of zoning from R-lA Single Family Residential District to R4 Multi -Family Residential and Dormitory District of property on the east side of Garland Avenue which had been approved by the Planning Commission. After a brief discussion the City Attorney introduced and, at the request of the 'dounEll, read a proposed ordinance in its entirety entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE NO.. 1239, AND REVISED ZONING DISTRICT MAP OF FAYEfTEVILLE, ARKANSAS, APPROVED MAY 28, 1962, TO REZONE CERTAIN REAL ESTATE FROM R-lA SINGLE FAMILY RESIDENTIAL DISTRICT TO R-3 MULTI -FAMILY RESIDENTIAL DISTRICT." Alderman Burgin moved that the rule be suspended and the Ordinance be placed on the second reading. The motion was seconded by Alderman Heflin and passed unaaimoub�7. The Ordinance was then read for the second time. Alderman Thomas moved that the rule be further suspended and that the Ordinance be placed on the third and final reading. The motion was seconded by Alderman Heflin and passed unanimouhly. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being no discussion, the Mayor asked th question, "Shall the Ordinance pass2" Upon roll call the following vote was recorded "Aye" Heflin, Christie, Watson, Bone, Thomas, Burgin, and Faucette. "Nay" none. C. Rogers and Cleada Rogers on the following described property, to -wit: Lots 5,6,7,8 and 9 of Block 4; all of Block 5; Lots 139 14, 15, 16, 17, 18 and 19 of Block 6; Lots 10, 11,'129 13, 149 159 16, 17 and 18 of Block 8; and all of Block 9; all lots and blocks being in Oakland Hills Addition to the City of Fayetteville, Arkansas, as per plat of said addition record0d in the office of the Circuit Clerk And Ex -Officio Recorder of Washington County, Arkansas. The motion was seconded by Alderman Watson and passed unanimously. The City Planner presented the plat of the proposed John Smyth Addition and after a long discussion the City Attorney introducdednd, at the request of the Council, read a proposed,' ordinance in its entirety entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS AND EASEMENTS IN THE JOHN SMYTH ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS." Alderman Bone movedthat the rule be suspended and that the Ordinance be placed on the seconded reading, The motion was seconded by Alerman Heflin and passed unanimously. The Ordinance was then read for the second time. Alderman Thomas moved that the rule be further suspended and that the'Ordinance be placed on the third ar last reading. The motion was seconded by Alderman Faucette and passed unanimously.6 The Ordinance visa then read for the third and last time. The Mayor then declardd the Ordinance open for discusstion. There being no discussion, the Mayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Ayeg Heflin, Christie, Watson, Bone, Thomas, Burgin and Faucette. "Nay" None. There being seven "Ayes" and no 9Nays" the Mayor denlared the Ordinance passed. ORDINANCE N0. 1471 AN ORDINANCE TO ACCEFT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS AND EASEMENTS IN THE JOHN SMYTH ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS. WHEREAS, there has been duly presented to the City Council of the City of Fayettefiille, Arkansas, a plat dated October 25, 1965, known as the John Smyth Addition to the City of Fayetteville, Arkansas, in which the owners have dedicated for the public use the streets, alleys and easements shown upon said plat and WHEREAS, the City Paanning Commission of the City of Fayetteville, Arkansas, has recommended the. acceptance of said plat; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. Present: Mayor Guy Be Brown, City Controller, Albert J. Jones, City Attorney Hugh Kincaid, eity Engineer W. C. Smith,aand Alderman Heflin, Christie, Watson, Bone, Thomas, Burgin, Faucette, and Short. Absent: City Clerk. In the absence of City Clerk George J. Davis, City Controller Albert J. Jones acted as City Clerk, The Mayor reported that the purpose of the mebting was to discuss a water supply for Johnson,Arkansas, Engineering contract with McGoodwin and Mahaffey, consulting engineers, Mebting with Beaver Water Distric Board of Directora, and that all members of the Council had been -notified by letter and by telephone. but -A long discusstbn was had concerning a new water line and fire hydrants for Johnson.,AArkansad.no further action was taken at this time. After a long discussion, Alderman Burgin moved that the Mayor and City Clerk be and they are hereby authorised to execute an engineering contract with Consulting Engineers L. M. McGoodwin and John Be Mahaffey for the Water Project to obtain treated water from the Beaver Walter District in accordance with the report submitted by Consulting Engineers McGoodwin and Mahaffey. The motion was seconded by Alderman Heflin and passed unanimously. Alderman Bone then moved that the City of Fayetteville enter with Beaver Water District in making to the Federal Government for any and all Federal Funds available for Water Projects. The motion was seconded by Alderman Faucette and passed unanimously. ,There being no further business, Alderman Short moved to adjourn. The motion was seconded by Alderman Thomas and passed unanimously, whereupon the Mayor declared the meeting adjourned. There being no farther discussion, the Mayor asked the question , " Shall the Ordinance pass?" Upon roll call the following Vote was recorded "Aire" Heflin and Watson.
