The minutes of the regular meeting on Monday, October 11,.1965, a copy of which had previously been maile
to each of the Aldermen, were approved as written.
The City Planner presented a petition.from the Motors Finance Corporation, Fayetteville, Arkansas, which
Ordinance had been approved by the Planning Commission, to rezone certain property on the west side of U. S. Highway
No 146f4 No. 71 North±andinbrth ofr`LbwnshipoRbad, from 0-1 Open land District to C-2 Thoroughfare Commercial District.
After a brief discussion, the City Attorney introduced and, at the request of the Council, read a propose
ordinance in its entirety entitled, "AN ORDINANCE A14ENDING ZONING ORDINANCE NO. 1239, AND REVISED ZONING
DISTRICT MAP OF FAYETTEVILLE, ARKAAISAS, APPROVED MAY 28, 1962,.TO REZONE CERTAIN REAL ESTATE FROM 0-1 OPE
LAND DISTRICT TO C-2 THOROUGHFARE COMMERCIAL DISTRICT".
Alderman Thomas then moved that the Ordinance be passed. The motion was seconded by Alderman Faucette and
passed unanimously, whereupon the Mayor declared the Ordinance passed.

WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville, Arkansas,
on October 12, 1965, on the petition of Motors Finance Corporation, requesting that said Planning Commission
recommend to the City Council of the City of Fayetteville, Arkansas, that the City Council enact an ordinance
re zoning the following described territory, to -wit:
A strip of land situated in the Southwest Quarter (SE;) of the Southwest Quarter(SWJ) of Section 35, (35)
Township 17 North, Range 30 West, described as beginning at a point 97.68 feet East of the Southwes
corner of said Forty Acre Tract, thence North 325.38 feet; thence East 149 feet; thence in.a South-
westerly direction 327 feet; more or less; thence West 86 feet to the point of beginning;
from 0-1 Open Land District to C-2 Thoroughfare Commercial District, and
WHEREAS, notice of said public.hearing, setting forth the date, time, place, and purpose of hearing,
and location of property was published in the Northwest Arkansas Times, a newspaper of general circulation
in said City, more than 15 days prior to said.public hearing, and
WHEREAS, following said public hearing, said Planning Commission certified to the City Council of the
City of Fayetteville, Arka-nsas, its recommendation that an ordinance be adopted rezoning the above
described property from 0-1 Open L4nd District to C-2 Thoroughfare Commercial District.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the above described property, presently zoned 0-1 Open Land District, be and the same
is hereby rezoned to C-2 Thoroughfare Commercial District.
SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed, and
this ordinance shall be in full force and effect from and after its passage, approval, and publication.

WHEREAS, a public hearing was held before the Planning Commission of the City of Fayetteville,
Arkansas on October 12, 1965, for the.purpose of considering amendment of the Zoning Ordinance, No. 1239,
passed and approved June -13, 1960, as amended by Ordinance No. 1339, passed and approved February 25, 19 3,
in order to reduce the period of time required for notice by newspaper and signs preceding hearings by tle
Board of Adauetment on appeals and applications for variance, and
WHEREAS, notice of said public hearing, setting forth the date, time, place andpurposes of said he ring
was published in the Northwest Arkansas Times, a newspaper of general circulation in said City more tha
15 days prior to said public hearing, and
WHEREAS, following said public hearing, said Planning Commission certified to the City Council of the

SECTION 3 Appeals or Variances
Any appeal or application for variance to the Board of Adjustment may be taken by any
person, firm or corpora tion aggrieved, or any governmental officer, department, board
or bureau affected by any decision of the building inspector based in whole or in part
upon the provisions of this ordinance.
The Board of Adjustment shall publish a notice of the time and place of a public hearing
upon such appeal or application for variation; such notice shall be published at least
once not less than seven (7) days preceding the date of such hearing in an official
paper or newspaper of general circulation in Fayetteville, such notice to contain the
particular location for which the appeal or variation is requested as well as a brief
statement of what the proposed appeal or variation consists of. A sign eighteen (18)
inches high and thirty(30) inches wide or larger as determined by the building inspector,
also giving such notice, shall be placed upon the property by the building inspector
seven (7) days before the date of the public hearing. The Board shall also give notice
of such hearing to interested persons and organizations as it deems feasible and
practicable. Upon the date of the hearing any party may appear before the Board in
person or by attorney.
The applicant shall be required to pay a filing fee of ten(.$10.00) dollars to cover
the cost of publishing and mailing notices and such other expenses as may be incurred
in connection with such appeal or application.

SECTION 2. That the City Clerk is hereby authorized and directed to cause the amendments hereby
adopted to be incorporated and published in the supplements to Appendix A of.the Code of Ordinances,
City of Fayetteville, Arkansas,
SECTION 3. All -ordinances or parts of ordinances in conflict herewith shall be and the same are
hereby repealed, and this ordinance being necessary for the preservation of the public peace, health,
comfort, convenience, morals, safety and welfare of the City of Faygtteville, Arkansas, an emergency is
hereby declared to exist and this ordinance shall be in full force and effecttfrom and after its passage
and approval.

Alderman Short moved that the Resolution be adopted.

WHEREAS, the City of Fayetteville, Arkansas, recognizes the need for proper and orderly growth and
the prevention of undesirable physical conditions, and
WHEREAS, continuous comprehensive planning for the City of Fayetteville is recognized as essential
for its future growth and development, and
WHEREAS, the financial resources of the City of Fayetteville are not adequate to finance in whole
the necessary planning services, and
WHEREAS, the University of Arkansas, acting as the State Agency for planning assistance, can apply
for financial assistance from Federal sources,
NOW THEREFORE, BE IT RESOLVED that the City Council of Fayetteville, Arkansas, requests that the
University of Arkansas apply for a reservation of Federal planning fuhds to undertake a planning program
which may include the following: ` _
1. Revision and updating of base maps.
2. Economic and Population Base Studies.
3. Revision and updating of
a. Land Use Plans
b. Street and Highway Plans
C. Community Facilities Plans
d. Capital Improvements Programs
4. Revision and gpdating of Administrative Controls and Procedures.
5. Preparation of supporting documents and reports explaining the work.
BE IT FURTHER RESOLVED that the City of Fayetteville will make available the sum of $rW'00 per mo
over a period of two years to be used In part in defraying the cost of the proposed planning program as
determined by the city of Fayetteville and the University of Arkansas.

ase Alderman Christie reported that the Subdivider of Eastwood Addition had requested to be released from t

d He further reported that the Subdivider had not met the requirements of Subdivision Ordinance No. 1245
in all the streets in this Subdivision.
After a long discussion, Alderman Christie moved that the City Clerk be authorized to execute a Release
Deed on Eastwood Addition or any part thereof upon approval by the City Engineer.
The motion was seconded by Alderman Bone and passed unanimously.

Lake Wilson Alderman Helfin moved that the Arkansas Game and Fish Commission be premitted to use Lake Filson as a
nursery pond as long as needed.
The motion was seconded by Alderman Christie and passed unanimously.

Dear Sir:
You are no doubt aware of the efforts of the Arkansas Game and Fish Commission to pr6perly stock
Beaver Reservoir with desirable game fishes. We have, in addition to the native fishes available is us
in Arkansas, introduced *lleye and northern pike, however, once these little fish are stocked in a new
lake and the lake becomes full of the spawn of all the fishes, then to keep stocking small fishes is
wasteful since the fishes present in the lake will eat the small fishes which we stock.
In this regard, I am wondering if we could kill out all the fish in the old water supply lake
(Lake Wilson) then we could use Lake Wilson as a nursery pond for walleye. By stocking day-old walleye
in Lake Wilson, we could grownthese fish up to 4 or 5 inches and drain them into Westfork Creek during
the rainy season in the winter. This would give us a large supply of fingerling walleye for Westfork
Creek as well as White River and Beaver Resetvoir.
Please advise me.

The Mayor reported that he had a request for 3 parking meters on the west side of Block Avenue and
immediately north of Spring Street.
After a brief discussion; the City Attorney informed the Council that the parking meters were zoned by
ordinance and an ordinance was required to authorize the installation of any parking meters outside bf
regular zones.
No further action was ta4bwat this time.
There being no further business Alderman Short moved to adjourn.
The motion was seconded by Alderman Heflin and passed unanimouslyf
Whereupon the Mayor declardd the meeting adjourned.
