McGoodwin, Consulting'Engineers, as a joint venture be u approved as presented and recommended by the Water & Sewer Committee, and that said contract be executed Goodwin. E. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Hugh Kincaid, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Christie, Watson, Bone, Thomas, Burgin, Faucette, and Short. Absent: None. The minutes of the regular meeting on Monday, September, 27, 1965, a copy of which had previously been mailed to each of the Aldermen, were approved as written. The City Building Inspector presented the petition of Dr. Phillip Deal for a permit to use wooden shingle on a commercial building which had been denied by the Board of Appeals but which they referred to the City Council. The City Clerk read a resolution from the Board of Appeals whereby they re d thi,,p P the Council for their consideration; also a.resolution requesting the Council to study the nI ance and Fire Prevention Ordinance with reference to amending in order to"permit the use of wooden shingles for roofing in both•Residential and Commercial Zones. After a long discussion, Alderman Burgin moved to refer this to the Ordinance Committee for study and recommendation with reference to aarnending the Bu1ldgn9'rC6dei.0rdand Fire Prevention Ordinance to permit the use of wooden shingles for roofing material in both the Residential and Commercial Zones. The motion was seconded by Alderman Heflim and passed unanimously. The City Planner presented a resolution from the Planning Commission recommending that the Council accept a deed for an alley in th@ Read Addition from Preston Hathcock and Edna Hathcock, husband'and wife. Aftefr:•a brief discussion, the'City Attorney introduced and, at the request of the C6uncil, read a propose ordinance in its entirety entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF CERTAIN LANDS I THE CITY OF FAYETTEVILLE, ARKANSAS, FOR A PUBLIC ALLEY" Alderman Thomas moved that the Ordinance be passed. The motion was seconded by Alderman Bone and passed unanimously, whereupon the Mayor declared the Ordinance passed. ORDINANCE N0, 1463. AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF CERTAIN LANDS IN THE CITY OF FAYETTEVILLF,, ARKANSAS, FOR A PUBLIC ALLEY. WHEREAS, there has been duly presented to the City Council of the City of Fayetteville, Arkansas, a quitclaim deed executed by Preston L. Hathcock and Edna H. Hathcock, husband and wi-Se, and dated July 12, 1965, wherein the grantors have granted for public use certain lands in the City of Fayetteville, Arkansas, for the purpose of a public alley, and WHEREAS, the lands described inssaid quitclaim deed are as follows: A 20 foot alley situated in the Northeast (NE) quarter (a�)tb8 the Southeast (SE) quarter ( ) of Section B, Township 16 North,Range 30 West, and being more particularly described as follows: Begin- hing at a point on the right of way line of Highway 16 (Garland Avenue), said point being 511.5 feet North and 25 feet West of the Southeast corner of said 40 fere tract; thence West 275 feet; thence North i 15=65 SECTION 2. That the City of Fayetteville, Arkansas, hereby accepts and confirms the grant and dedi- cation by said quitclaim deed of the aforedescribed land for a public alley, and hereby declares said alley to be a*+public alley; and the City Council hereby assumes the care, control and jurisdiction of the 15=65 SECTION 2. Brown, Mayor of the City of Fayetteville, Arkansas, be and he is hereby authorized and direc- to make application, in the name of the City of Fayetteville, Arkansas, for a Federal grant under the Public Law 660, as amended; to be applied to the cost of the construction of said sewage facilities. Thi City of Fayetteville, Arkansas, hereby agrees that if a Federal grant for the project is made pursnant t( the Federal Water Pollution Act, the City will pay the remaining costs of the approved project.
