The City Planner reported that the Blanning Commission had studied the Quitclaim Deed offered to the C.
by Cy Carney and Lettie Carney„ husband and wife, for street purposes located in the Rochier Heights
Addition to the City of Fra,9etteville, Arkansas.
The Planning Commission made the following recomendations as set out in Resolution PC 9-65 which reads
as follows:
RESOLUTION PC 9-65
WHEREAS, after more study of the quitclaim deed afforddd by Cy Carney and Lettie Carney, husband
and wife, to the City of Fayetteville, for a 50- foot street was given, the Planning Commission voted to
make a recommendation.
NOW, THEREFORE, BE IT RECOMMENDED BY THE CITY PLANNING COMMISSION TO THE CITY COUNCIL OF THE CITY
OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the City of Flyetteville accept a deed made by the proper person for the dedica
of a 50 foot street to be a continuation of Paris Avenue from the south line of Rochier Street to the
point where Paris -Avenue was not closed by Ordinance No. 1426, said point being 84 feet south of the
line of Grandview Street; and
SECTION 2. That a temporary turn -around be provided at the end of that portion of Paris Avenue to
be opened and improved; and
SECTION 3. That it be recommended to Cy Carney and Lettie Carney, husband and wife, that Rochier
Heights Addition be replatted.
PASSED AND APPROVED this 27th day of april, 1965.

Alderman Short commended the Chief of Police for his effort to apprehend the persons or person res-
ponsiable for the telephone calls making threats to bomb various Public Buildings.within the City.
Alderman Short then moved that each Alderman donate his Aldermen's salery for one month as a reward
to any personopersons giving evidefice which would lead to the arrest and conviction of the person or
persons respon le for making these telephone threats.
The motion was seconded by Alderman Watson and passed unanimously.
There being no further business Alderman Short moved to Adonurn. The motion was seconded by Alderman
Watson and passed unanimously, whereupon the Mayor declared the meeting.adjourned.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FA.Y EPTEVILLE, ARKANSAS:
Section 1. That Section 7 of Ordinance Number 1443, passed and approved april 26, 1965, be and the

"Section 7. That the rates fixed by this ordinance shall go into effect on the first day
of August, 1965, so that the first bills will be surmitted and wi 11 be due and payable
between August 1, and August 10, 1965."

Alderman Short read a proposed resolution authorizing a Supplemental Airport Agreement.
Alderman Short moved that the Resolution be adopted.
It was seconded by Alderman Burgin and passed unanimously, whereupon the Mayor declared the Resolution
adopted.

18"65 WHEREAS4the Airport Agreement by and between the City of Fayetteville, Arkansas, and Central Airlines
Inc.,•expired December 21, 1964, and
WHEREAS, a new Airport Agreement by and between the City of Fayetteville, Arkansas, and Central Airlines
Inc., has been prepared and is ready for adoption, and

WHEREAS, a Supplemental Airport Agreement will he necessary to cover additional office space requested
by Central Airlines Inc.,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OV FAYETTEVILLE, ARKANSAS:
Siction 1. The Mayor and City Clerk be and they are hereby authorized to sign the Airport agreement dated
February 1, 1965.
Section 2. The Airport Afereement dated February 1, 1965, shall be attached hereto and made a part of this
resolution.
Section 3. The Mayor and City Clerk be and they are hereby authorized to sign a Supplemental Airport
Agreement for an additional one hundred fifteen and a half (115.5) square feet of office space located in
the southwest corner of the Airport Terminal Building,
Section 4. The Supplemental Airport Agreement shall be.subject to the same terms and provisions contained
in the Airport Agreement dated February 1, 1965.
Section 5. The Supplemental Airport Agreement shall be dated 4unt 1, 1965, attached hereto and made a
part of this resolution.

The motion was seconded by Alderman Burgin and passed unanimously.
Alderman Christie reported that bids had been received and opened for an Asphalt Finisher and portorable
Roller for the Street Department, however only one bid was reveived for the Asphale Finisher, (Sperader)
which was the ohe of R. A. Young and Son, Inc.,Fort Smith, Arkansas ar a net cost to the City of'$14,000•�
provided the City purchase the Asphale Finisher and Portarable Roller both from them at a net cost of
;1 $20,382.00 .
` Since this was the lowest bid meeting the requirements in the specifications Alderman-Ch'ristie moved to
(1( purchase the Asphal-'Finisher and Portfrable Roller from R. A. Young and Son.,Inc., Fort Smith, Arkansas
at a net cost of $20,382.00, including a trade-in of the old Asphale Finisher but retaining the old
Roller now.in use.. (all prices F.O.B. Fayetteville,Arkansas)
The motion was seconded by Alderman Burgin and upon roll call the following vote was recorded, "AYE"

The City AttorneyReported that in the Civil Suit of H. E. Board and-Ethel L-.WBoardit-Husband and Wife
VS. City of Fayetteville, Arkansas, and Municipal Corporation that the Court had ruled that the defendent
pay the sum of 2,000.00 dollars to the Elaintill for daminagea caused by fluds due to the construction
of the dam at Lake Sequoyah and he recomended this amount be paid withour further Litigation.
Alderman Thomas moved to accept the recomendation of the city attorneyaand pay the sum of 2,000.00 dollars
to H. E. Board and Ethel L. Board, Husband and Wife withour further Litigation, and that a copy of the
Court Judgement be Sperad in the Minutes in PROCEDURE OF THE CITY COUNCIL.

Nor on this 6th day of May, 1965 this cause came on for trial, the plaintiffs claiming a taking of
approzimately 10 acres of land contained in the following described tract, and claiming damages to the
balance, rest and residue of said lands:
A part of the South Half of the Southeast Quarter of Section eight (8), described as
follows: Beginning at a point on the bluf which is nine (9) chains and 200 links
East of the Southwest, corner of said 80 acre tract, and running with the bluff North
32 West six (6) chains and 80 links to the channel of White River, thence up the

channel of said river in a Southeasterly direction to the mouth.of the West
Fork of White River, thence up the West Fork of White River to the South line of
said 80 acre tract, thence West with said line to the placeof beginning, contain-
ing13 i acres, more or less,. The Northwest Quarter of the Northeast Quarter,
and all that Fart of the Northeast Quarter of the Northeast Quarter lying and
being West of the West Fork of White River, Containing three (3) acres, more or
less, and the North Half of the Northwest Quarter, all in Section 17, less and
except 3# acres, more or less, sold to James A. Merdeith, described as:
Beginning at a point on the North line of said Northwest Quarter of the North-
west Quarter of the M4ddle of the Wyman Road 660 feet Bast of the Northwest
corner of the said 40 acre tract, and running thence South 260 feet, thence
East to the Baldwin -Wyman Road, thence in a Northerly direction with the said
Baldwin -Wyman Road to the middle of the Wyman Road; thence West with the
Wyman Road to the place of beginning, containing three and one-half acres, more
or less. All of the above described'Aand being in Township 16 North, or Range
29 West.
The plaintiffe6 appeared in person and by their attorneys, James R. Hale and Rex W. Perkins. The
endant City of Fayetteville, Arkansas, and Municipal Corporation, appeared by its attorneys, William
Putman and Hugh R. Kincaid. Whereupon all parties announced ready for trial, and a jury composed of
lve (12) members of the regular panel of petit Jurors of thes court were duly selected, impaneled,
sworn, according to law to try the issues of fact herein. After having heard the evidence intro -
ed, the instructions by the court, and argument of counsel, said jury retired to deliberate, and hav

RESOLTTION NO 9-65
WHEREAS, Alderman Garland Wheeler,is retiring from the City Council and all activities
connect9d with the City Government, and
WHEREAS, Garland Wheeler has served as ah Alderman from Ward 2 during the period from
November 20, 1961, to June 7, 1965.
WHEREAS, By his cooperation and untiring efforts, together with the other officials of
the City Government, he has, in the completion of the new Police Facilities Building,
A new Central Fire Station, and two Wing Fire Stations, as well as many othr lesser pro-
bects, he has helped to make the City of Fayetteville, Arkansas a better place to live
thereby erecting a permanent monument to himself and his posterity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE,
ARKANSAS:
Section 1. That a vote of appreciation by the City Council be extended to G#rland Wheeler
as a retiring member of the City Government of Fayetteville, Arkansas.
Section 2. That a copy of this resolhtion be mailed to him and that this resolution be
spread in the minutes as a permanent record in ther-IROCEDURE OF THE CITY COUNCIL.
