. 1437 AN ORDINANCE TO AMEND ORDINANCE N0, 1418, VACATING AND ABANDONING MEREDITY STREET, IN THE STUBBLEFIELD
ADDITION TO .THE CITY OF FAYETTEVILLE, ARKANSAS, TO INCLUDE IN SAID ABANDONMENT ALL RESERVATIONS AND
EASEMENTS FOR PUBLIC UTILITIES UPON, OVER AND UNDER SAID ABANDONED STREET.
WHEREAS, the City of Fayetteville, Arkansas, by -Ordinance No. 1418, passed and approved November
9, 1964, vacated and abandoned all its rights, together with the rights of the public generally, in and
to the street designated as all of Meredith Street which is bhe extreme street running East and West
of Blocks 4 and 6 in Stubblefield Addition to the City of Fayetteville, Arkansas;
WHEREAS, a Petition has been filed before the City..Council,showing that the property adjacent to
said closed street is in open..land.and that no utilities are now or proposed to be located on said close
street and*thit purchasers of said property are proposing to erect a church building over said closed
street but the title to said lands is encumbered by the above reservation of easement by the City, and
that no•useful trublic purpose would be served b y the reservation of said easement for public utilities
thereon:

'WHEREAS,.in said Ordinance'No. 1418 said City reserved"an easement to right of way, on over;
under and across the portion of said street vacated for the purpose of construtcting, installing, operat-
ing, laying,, and relaying, relocating and maintaining all public utilities now located or which may

'right-of-way from said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. The City of Fayetteville, Arkansas, does hereby release,•vacate and'abandon.all its
rights, together with the rights of the public generally, in and to the street designated as follows:
.All of Meredith Street which is the extreme street running East and West of Blocks 4 and 6, in Stubble-
field Addition to the City of Fayetteville, Arkansas.
SECTION 2. ThatCi l that portion of Ordinance No. 1418 insofar as the same attempts to reserve
to the Citi Iof Fayetteville, Arkansas,its successors and assigns an easement or right of way on, over,
under and across a portion of said street so vacated for the purpose of construction, installing,
operating, laying and relaying, relocation, andmaintaining all public utilities now located or which may
hereafter b9 located upon said vacated street by said City, or any corporation having a.franchise or
right of way from said City, is hereby repealed and said Ordinance No. 1418 is hereby amended accordinly.
SECTION 5. A copy'of this Ordinance duly certified by the CityClerk shall be filed in the office
of the recorder:of the county andrecorded in the deed records of the county. .
SECTION 4. This Ordinance -shall take effect and be in_force from and after its passage, approval
and publication. '

The City Engineer explap)tne;!that an easement fora sewer main constructed late in 1964 on Mrs. Ford's p
operty at the corner of Williams and Duncan Streets has been requested by the University of Arkansas to
be released in order that their attorneys may approve the purchase of the Ford property for a future
building site and that the city transfer the title of the main north of Williams Street to the Universi
After a brief discussion Aldermen Wheeler moved that the Mayor and City Clerk`be'authorized to execuit
the necessary Right 'of Way release for the sewer main recently constructed on the Ford Property at the,
corner of Duncan Avenaa and Williams Street and that the title to that part of the sewer main tying
north of Williams Street be transfered to the University of Arkansas. The Motion was seconded by
Aldermen Burgin and passed unanimously.
The City Engineer stated that work will begin within a month on a new shopping center at the corner of
South School Street and 15th Street and that the City plans a 30" sewer outfall across this -property,
to be constructed within 2 or 3 years. That an easement has just been secured from the u mer for this
sewer. That by putting this sewer in at this time in advance of the building construction considerable
savings will be made. The pipe will be ductile iron in order that buildings made be erected over the
sewer and that estimated cost of the1550 feet necessary is $12,000.00 to $15,000.00.
The City Engineer.requested authority to arrange to have this section of sewer installed on an emergency
basis taking bids for the pipe and employing a local contractio to construct the sewer.
Aldermen Thomas moved that the City Engineer be authorized to take immediate measures on an emergency
basis to construct the 550 feet of 30" ductile sewer main across the proposed shopping center at 15th
Street and South School using practices consistent with the time available to accrompish the work prior
to actual building of the shopping center. The motion was seconded by Aldermen Short, and passed
unanimously.
Aldermen Wheeler moved that L. M. McGoodwin be employed to prepare plans and specifications for the fir
stage in the construction of an Operation Center for the Water and Sewer Depot on the Cata Speings Road
property. That the first stage x111 consist of the preparation of the site grounds,fencing, Street
grading and graveling, Sewer mains, and two buildings shown on the master plan as the Supply Building
and Shop Building. The motion was seconded by Aldermen Short.and passed unanimously.
There being no further business, Aldermen Watson moved to adjourn. The motion was seconded by Aldermen
Burgin and passed unanimously, whereupon the Mayor declared the meeting adjourned.
