Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. -Jones, City Attorney Hugh Kincaid, City Engineer W.C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton and Aldermen: Heflin, Christie, Watson, Wheeler, Thomas, Burgin, Faucette and Short. Absent: None. t Minutes The Minutes of the Regular Meeting qV Monday, Janaury 18, 1965, a copy which had been previously mailed Approved to each of the aldermen, were approved as written. 00 The City Attorney presented a court order from the County Court of Washington County, annexing certain 0101 territory to the City of Fayetteville, Arkansas. After a brief discussion, the City Attorney introduced and at the request of the Council read a proposed ordinance in its entirety, entitled, AN ORDINANCE ACCEPTING TERRITORY ANNEXED TO 'rHE CITY OF FAYETTEVILM ARKANASAS; ASSIGNING SAID TERRITORY TO WARDS AND FOR OTHER PURPOSES. Alderman Thomas moved that the ordinance pass. The motion was seconded by Alderman- Burgin and passed unanimously, whereupon the Mayor declared the ordins passed. Ordinance ORDINANCE N0. 1429 1429 AN ORDINANCE ACCEPTING TERRITORY ANNEXED TO THE CITY OF FAYETTEVILLE, ARKANSAS; ASSIGNING SAID TERRITORY TO WARDS, AND FOR OTHER PURPOSES. WHEREAS, the County Court of Washington County,.Arkansas, did on November 4, 1964, make an order annexing the following described territory to the City of Fayetteville, Arkansas, to -wit: The East Half (EJ) of the Northwest Quarter (NW,i-,) and the West Half (WJ) of the Northeast Quarter (NEy) of Section 14, Townhsip 16 North Range 30 West of the 5th P.M., containing 160 acres, more or less. and, • WHEREAS, the County Clerk of Washington County, Arkansas, has £orwarded•a transcript of said pro- ceedings to the City Council of the City of Fayetteville, Arkansas, and WHEREAS, more than thirty days have elapsed since the date of said order and no proceeding has beer instituted in the Circuit Court to prevent said annexation and no notice thereof has been givenas require by law. NOW, THEREFORE, BE IT ORDAINED PY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: -� SECTION 1. That the annexation of the above-described territory to the corporate limits of the City of Fayetteville, Arkansas, beand the same is hereby accepted, and all said territory is hereby assigned to and made a part of Ward 3 of the City of Fayetteville, Arkansas. SECTION 2. This ordinance shall be in full force and effect from and after its passage, approval and publication. PASSED AND APPROVED THIS 1st day of February, 1965, APPROVED: GUY E. Insp, garage across the City from 603 No. Willow Avenue to 38 University. The Building Inspector reported that �o issue the house moving problefm in general was originally discussed by the Council in 1962 and the Council at °fovi'ng that time authorized the Building Inspector to issue a moving permit provided certain conditions and re - Permit quirements were met. In this case one of the adjoining property owners refused to give his permission. After a long discussion; Alderman Burgin moved to authorize the Building Inspector to issue a permit to move the residential garage as outlines above provided it meets all of the zoning requirements. The motion was seconded by Alderman Heflin and upon roll call, the following vote was recorded: AYE Heflin, Christie, Watson, Thomas, Burgin, Fauceette and Short.r.NAY, Wheeler. There being seven AYES and one NAY the Mayor declared the motion passed. Airport Alderman Short read a proposed Airport Agreement between the City and Central Airlines, which had some Agreement changes differing from the old Airport Agreement. Executed After a brief discussion, Alderman Short moved to approve the airport agreement and that the Mayor and City Clerk be and they are hereby authorized to execute the contract with the Central Airlines. The motion was seconded by Alderman Burgin and passed unanimously. ipprove Alderman Short moved to approve the General Fund Budget for the year of 1965, as presented by the City ;en. 'rial Alderman Short reported that the Budget Committee, Sanitation Committee and City Controller had studied 3udget for the Budget for the Sanitation Department and they recommended -a trial budget for the first three months sanitation of 1965. Quarterly) Alderman Short then moved to -adopt a quarterly budget for the Sanitation Department for the first quarter of 1965 as presented by the City Controller and the Budget Committee, The motion was seconded by Alderman Thomas and passed unanimously, Alderman Short read five recommendations from the City Controller which were sihmnarized in his original dvertise budget prepared for 1965.' or bids Alderman Sbort moved to accept recommendation No. 1 which was to authorize the City Engineer to prepare or gas specifications and advertise for bids for the purchase of gas and oil for the several departments of the nd oil City on at least a 6 month basis at both sr,d retail "and bulk prices. The motion was seconded by Alderman Heflin and passed unanimously Discon- Alderman Short then moved to accept recommendation No. 2 which was that the Shop Fund be discontinuted tinue and the assets of the' fund be trantgerred to the Public Works Fund to become a part of the general assets Shop Fund of the City. The motion was seconded by Alderman Thomas and passed unanimously. Re -design Alderman Short then moved to accept Recommendation No, 3 which was that the City Controller, Mayor and hop Dept. Shop Foreman re -design the equipment cost records and all other records of the Shop Department to clairif, the services performed, the accountability for lahor hours, and inventory and/or use of materials. The motion was seconded by Alderman Thomas and passed unanimously. The motion was seconded by Alderman Burgin and passed unanimously. The motion was seconded by Alderman Wheeler and passed unanimously. Alderman Christie reported that the Street Committee had recommended the approval of the Budget for the Street Department as presented in the proposed budget provided emphasis be placed on Maintenance and that any and all new construction work be presented,to the Council for their approval. They requested an additional 90 days in which to complete their report for the Council. Alderman Wheeler moved that consulting Engineers John Mahaffey and L.M. McGoodwin be granted an additions 90 days to complete their report to the Council. The motion was seconded by Alderman Thomas and passed unanimously. The Minutes of the regular meeting on Monday, February 1, 1965, a copy of which had previously been sailed to each of the aldermen, were approved as written. The City Planner.presented a petition for rezoning of property on the north side of Cato Springs Road north of and adjacent to McClinton's Second Addition from I72 Heavy Industrial District to R-18 Single Family Residential District, which had been approved by the Planning Commission. After a brW discussion, the City Attorney introduced and, at the request of the Council, read a proposE ordinance in its entirety entitled, "AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1239, AND REVISED ZONING DISTRICT NAP OF FAYETTEVILLE, ARKANSAS APPROVED MAY 28, 1962, TO REZONE CERTAIN REAL ESTATE FROM I-2 HEAVY INDUSTRIAL DISTRICT TO R -1B SINGLE FAMILY RESIDENTIAL DISTRICT.° Alderman Short then moved that the Ordinance pass. The motion was seconded by Alderman Burgin and passed unanimously, where upon.the Mayor declared the Ordinance passed. ORDINANCE NO. 1430 AN ORDINANCE AMENDING ZONING ORDINANCE N0.12395 AND REVISED ZONING DISTRICT 11AP OF FAYETTEVILLE, ARKA APPROVED MAY 28,1962, TO REZONE CERTAIN REAL ESTATE FROM I-2 HEAVY INDUSTRIAL DISTRICT TO R -1B SINGLE FAMILY RESIDENTIAL DISTRICT. WHEREAS, a public hearing was held before the Planning Commission,lof the City of Fayetteville, Arkansas, on February 2, 1965, on the petition of McClinton Brothers Company requesting that said Plannir Commission recommend to the City Council of the City of Fa,yetteville,,Arkansas, that the City Council enact an Ordinance rezoning the following described property which is presently zoned I-2_Heavy Industrial District, to -wit: A part of the Southwest Quarter of the Southwest Quarter, Section 21, Township 16 North of Range 30 ?Jest of the Fifth Principal Meridian, Fayetteville, Arkansas, more particu] described as follows: Beginning at a point that is N.:00 24' E, 660.0 feet from the Southeast Corner of the Southwest Quarter of the Southwest Quarter of Section 21; thence West 310.0 feet; thence N 00 24' E , 160.2 feet; thence N 800 31' E, 131.8 feet; thence N 00 24' E, 50.0 feet: thence N 800 31' E, 182.5 feet; thence S.00 24' W, 262.0 feet to the point of beginning, containing 1.53 acres, more or less, from I-2 Heavy Industrial District to,R-1B Single Family Residential District, And WHEREAS, notice of said public hearing, setting forth the date, time, place and purpose of hearing, and location of property was published in the Northwest Arkansas Times, a newspaper of general circu- lation in said City, more than 15 days prier to said public hearing, and WHEREAS, following, said public hearing said Planning Commission certified to the City Council of the City of Fayetteville, Arkansas its recommendation that an ordinance be adopted rezoning the above- described property, which is presently zoned I-2 Heavy Industrial District, to R -1B Single Family Residential District: IJOW THEREFORE, PEIT ORDAIt:ED By THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE) ARKANSAS: SECTION 1.
