Jack to vacate and abandon that portion of Haddon Street between Bigger Avenue and Cherry Avenue in the City of Fayetteville, Arkansas, Alderman Short moved that the resolution be adopted. The motion was seconded by Alderman Burgin and passed unanimously, whereupon the Mayor declared the resolution adopted. RESOLUTION N0. 21-64 VINEREAS, it appears that a petition to vacate and abandon Haddon Street, was duly filed by Wm. L. Jack and Phoebe H. Jack with the City Clerk of the City of Fayetteville, Arkansas, on the 9th day of November, 1964; and WHEREAS, it appears that this is the next regular meeting of the City Council following the filing of said petition. Absent: Fire Chief Furl Skelton. - IMINUTE.S The %inutes of The Regular Session held on November 9th, 1964, a copy of which had previeualy been mailer APPROVED to egch of the aldermen, were approved as written. 1424 The Mayor reported this was the date, time and place set for a public hearing on a petition to abandon and vacate that portion of Haddon Street between Bigger Avenue and a street lying parallel to and one block South of said Bigger Avenue, not yet officially named, but known as Cherry Avenue, located in the Country Club Addition to the City of Fayetteville, Arkansas. The City Clerk reported that he had caused the notice of the public hearing to be published in the Northwest Arkansas Times, a. daily newspaper published in 1.41ashington County, Arkansas, and having a general circulation in the City of Fayetteville, Arkansas, once alweek for two consecutive weeks, that also had an abstractor-�rs Certificate of Title showing the owners of record of the real estate abutting upon said street, also A. resolution from the Planning Commission recommending that this street be vacat and abandoned and letter's from the utlity:} companies stating they had no objection tot he street being closed. There being no objection, the City Attorney read a proposed ordinance in its entirety, entitled, "AN ORDINANCE' VACATING AND ABANDONING A PART. OF HAP"ON STREET." Alderman Thomas moved that the ordinance pass. The motion was seconded by Alderman Wheeler and passed unanimously, whereupon the Mayor declared the ordinance passed. ORDINANCE N0. 1424 AN ORDINANCE VACATING AND ABANDONING A PART OF HADDON STREET. I&IEREAS, a petition was duly, filed with the City Council of the City of Fayetteville, Arkansas, on the 6th day of November, 1964, asking that the City Council to vacate and abandon part of Haddon Street, located in the Country Club Addition to the City of Fayetteville, Arkansas, and id1EF.EAS, after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described; has heretofore been dedicated to the public use as a street; has not been actually used by the public generally for a period of at least five years subsequent to the filing -of the plat; that all the owners of the 1rol-erty abutting upon the street to be vacated have filed with the Council their written consent to such abandonment, and that public interest and welfare will not be adversi�-.y affected by the abandonment of such street, N0143 THEREFORE, BE IT ORDAINED By THI CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. POJWffl, MAYOR LETTER, The City Clerk read a letter from the Mayor vetoing Ordinance 1421 passed by the Council Monday, FROM, THE 9, 1964 and stating his reasons therefore which was spread in the Minutes and reads as follows: MA YOR CONCERNING November 12, 1964 THE VETOING To the City Council OF ORD. City of Fayetteville 1421 Fayetteville, Arkansas Gentlemen: I have dedided that the ordinance passed -Monday night, regarding the zoning of annexed areas as 0-15 would cause many problems in the future. I believe that the ordinance should be written as suggested by our City Planner, Mr. Vizzier. I am sure some of ;jou do realize the possibility of repercussions on usch an ordinance, regardless of b it might be worded. I have talked with several of the councilmen, and I think it is the intention of all concerned that we do have a zoning ordinance on all annexed 'areas, but that it is impossible to have an ordinance that will cover any area regarding the different classifications. So it is with this in mind that I am vetoing Ordinance No. 1421, passed Monday, November 9, and have instructed our City Attorney to submit an' ordinance as outlined by Vr. The City Attorney reported that the City Planner, James Vizzier, had made certain recommendations to amend zoning ordinance 1239. The City Attorney introduced and at the request of the Council read a proposed ordinance in its entirety, entitled, "AN ORDINANCE AMENPING ZONING ORDINANCE No, 1239 REVISED ZONING DT_STRICT MAF OF FAYETTEVILLE, ARKANSAS, APPROVED MAY 28, 1962) TO PROVIDE THAT THE NE'wiLY ANNEXED TERRITORY SHALL COME IN ZONED AS A-1 ANNEXED TERRITORY DISTRICT,11owith the proposed recommended change. After a long discussion, Alderman Short moved to refer the ordinance to the Ordinance Committee and City Planner to study and present at the next Regular Meeting of the Council. The motion was seconded by Alderman Watson and upon roll call, the following vote was recorded: AYE Watson, Thomas and Short. NAY Heflin, Christie, Wheeler, Burgin, And Faucette. There being three AYES and five NAYS, the Mayor declared the motion defeated for lack of a majority. Alderman Short then moved that the rule be suspended and the ordinance placed on the second reading. The motion was seconded by Alderman Burgin and passed unanimously. The ordinance was then read for the second time. After a very long discussion, Alderman Faucette moved that Sub-paragra.phs 4 and 5 under Paragraph C, "Uses Permitted" and Sub -paragraphs F and G under Uses Permitted be omitted from the ordinance and that the ordinance be placed on the third and final reading as amended. The motion was seconded by Alderman Burgin and upon roll call, the following vote was recorded: AYE Watson, Thomas, Faucette and Short. NAY Heflin, Christie, Wheeler, and Burgin. There being four AYES ar. four NAYS, the motion to amend the ordinance and suspend the rule was defeated for lack of a 2/3 majoiity vote, After another long discussion, Alderman Short moved that the rule be further suspended and that the original ordinance be placed on the third and final reading. The motion was seconded by Alderman Purgin and upon roll call, the following vote was recorded: AYE Heflin, Christie, Watson, Wheeler, Burgin and Short. NAY Thomas and Fua.cette. There being six AYES and only two NAYS, the Mayor declared the rule suspended, whereupon the ordinance was then read for the third and last time. The Mayor then declared the ordinance open for discussion. After another long discussion, the Mayor aske the question, "Shall the ordinance Pass?" Upon roll call, the following vote was recorded: AYE Heflin, Christie, Watson, Wheeler, Thomas, Burgin. NAY Faucette and Short. ' DINANCE I ORDINAT'CE NO* 1425 1425 AN ORDIN.A*'CE AMENDINr- ZOFING ORDINANCE NO. 1239 REVISED ZONING DISTRICT MAP OF FAYETTEVILLE, ARKAA'S4S, APPROVED MAY 28, 1962, TO PROVIDE Tu4T THE NEWLY ANNEXED TERRITORY SHALL COME IN ZONED AS A-1 ANNEXED TERRITORY DISTRICT. WHEREAS, at the request of the City Council, a public hearing was held before the Planning Commis of the City of Fayetteville, Arkansas, on November 18, 1964,.to discuss a proposed amendment of Zoning Ordinance no. 1239 the zoning of newly annexed territory,"and WHEREAS, notice of said public hearing, setting forth the date, time and place and purpose of hearing, and location of property was published in the Northwest Arkansas Times, a newspaper of general circulation in said City, more than 15 days prior to said public hearing, and WHEREAS, following said public hearing, and after the question had been referred back to the F3&nning Commission for further study, by the City'Council, said Planning Commission certified the City Council of the City of Fayetteville, Arkan6as, its recommendation that the newly annexed territory come into the City zoned 0-1 Open Land District. 740:4, THE:FFCRE, BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKAISAS: SECTION 1. That- ordinance no. 1239 Article III, Section I, Classification of District be aipended by.the addition of a new zoning district, to be known as A-1 Annexed Territory District, SECTION 2. That ordinance no. 1239 Article IV, Section V, Zoning of Annexed Territory be amended to read as follows: "SECTION 5. Zoning of Annexed Territory All territory which may hereafter be annexed to the City shall be governed by and subject to the requirements of A-1 Annexed Territory District until such time as the Zoning District Map shallhave been amended to authorize other use or uses for the newly annexed territory. This district is intended to designate land located on the fringe or urban areas which is generally undeveloped or is used primarily for agricultural purroses but where future urbanization is expected. The regulations which are authorized for the district, therefore, are designed to encourage and protect open land and agri- cultural uses until such time as urbanization is warranted and the appropriate change in district class- ification is made. 1. Uses Permitted a. Single Family dwellings, guest houses and quarters for farm employees. b. Public and semi-public uses such�as schools, churchs, public services and utilities, air- ports and landing fields, parks, playgrounds, golf courses and driving ranges, including customary access uses and buildings. C. Agricultural uses, including horiculture, nurseries, orchards, forest and forestry, apiaries, field crops, the breeding and raising of livestock, and riding stables, provided that all stables, barns,animals sheds or shelters shall be located not less than one hundred (100) feet from any prorerty line. Agricultural uses, further, are subject to the following exceptions and conditions. 1. Farms devoted to hatc?ing, raising, breeding and marketing or chickens, turkeys, or other poultry, fowls, rabbits, fur -bearing -animals, fish or frogs shall have a tract, lot or parcel or not less than one (1) acre. 2. Killing, butchering or dressing of livestock, fowl, fish or other animals raised on the premises for personal home consumption of the' property owner is permitted provided that killing, butchering, or dressing is done in an accessory building which is located not less than one hundred (100) feet from any property line. 3. Hog raising for other than resident family consumption is permitted on tracts, lots or parcels or more than five (5) acres, provided that feeding pens or.shelters are not bl:oser than one hundred (100) feet from the property line of the tract on which they are located. 4. Veterinary office and animal hospitals. 5. Roadside stands for agricultural produce. d. Trailer courts and mobile trailer homes on individual lots provided that are in compliance with City Ordinances regulating such trailer homes or trailer parks. e. Home occupations --any home occupation such as those offering professional services, barbers beauticians, dressmaking and launderers, provided that no persons other than members of the householdare employed in such occupations and that not more than Twenty-five (25) per cent of the total floor area in any dwelling unit is devoted to such use. f. Radio and TV transmitting towers. g. Heavy equipment storage. h. $igns, free standing and informations, pertaining to public improvements the sale of lease of premises or relating directly to the ise of the property involved and not exceeding 12 feet by 24 feet in size; signs pertaining to home occupations which do not exceed 2 feet by 3 feet in size. 2. American Municipal Assoc. for the total fee of $150.00 per ,year. Alderman Short moved that.the Mayor and City Engineer be and they are hereby authcri" d and directed to prepare specifications and advertise for bids for the removal of the building on Parking Lot No. 1. The motion was seconded by Alderman Thomas and passed unanimously. Alderman Short read a proposed contract 'With T.J. Raney and Sons, financial advisors for the City of Fayetteville, Arkansas outlining the services and.costs ($7.00 per $x,,000.00 bond) which would complete the terms accepted by the City of Fayetteville, Arkansas, at the regular Council Meeting on September 14, 1964. Alderman Short moved to accept the terms of the contract of T.J. Raney and Sons and that the Mayor and City Clerk be and they are hereby authcat-ed and directed to execute the contract. The motion was seconded by Alderman Thomas and passed unanimously. The contract ties. outlining the services and costs were spreadar. the minutes and reads as follows: Honorable Mayor and City Council City of Fayetteville Fayetteville, Arkansas Gentlemen: In our proposal dated September 4, 1964, addressed to Mr. Albert J. Jones, City Controller, said proposal to become a part of this contract, we outlihed the services that we :oil.l perform acting for City of Fayetteville in the capacity of fifnancial advisor. T'his proposal, with the exception of the amount of our fee and the expenses we are to assume, was accepted by the City of Fayetteville on September 15, 1964. In accordance with said proposal, we her?by agree to act as ,your financial advisor and to perform all services outlined therein; and, we agree to pay the following expenses: (1) Printing of the Fonds, (2) Trustees' fee; (3) Pond approving attorneys' fee; (4) newspaper publication costs of all ordinances and all resolutions necessary to the issuance of the propo*U water and sewer bonds; (5) newspaper publicati costs oR the Notice of Sale; (6) Publication costs of advertising the bonds for sale in THE DAILY POND BUYER, the leading trade paper for municipal bond dealers. Fhe motion was seconded by Alderman Faucette and passed unanimously. Refer RC Cola Alderman Heflin read a letter from F. H. Strong, manager of Royal Crown Cola Co, wbg also appeared in sanitation person, protesting the sanitation rates for his plant. Mr: Strong stated that he needed only one pickup a complaint to month and the price charged was exorbitant. Sanitation bfter a long discussion, Alderman Burgin moved to refer this to the Sanitation Committee. Committee. he motion was secondeddby Alderman Wheeler and passed unanimously.
