RESOLUTION NO, 19-64
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
That the City Council accept a Performance Bond from Transvideo Co., Fayetteville, Arkansas, in the
amount of $5,000.00 guarantying that the area as shotirri on the attached map is completely changed out for
all channels to include FPI Radio by December 31, 1965.
Upon the presentation and formal acceptance of the bond at the next regular Council meeting, the
Council agrees to release all funds presently held in escrow and all future funds subject to deposit in
this account .

Alderman Christie presented a petition from Cy Carney to vacate certain streets and alleys in thb R.ochier
Heights Addition.
After a brief discussion, the City Attorney read a proposed resolution setting forth the date, time, and
place of a Public Hearing on this petition.
Alderman Christie moved the resolution be adopted.
The motion was seconded by Alderman Thomas and passed unanimously, whereupon the MA•yor declared the
resolution adopted.

ORDINANCE N0. 1418
AN ORDINANCE VAuATING AND ABApDONING MEREDITH STREET, IN THE STUBBLEFIELD ADDITION TO THE CITY OF
FAYETTEWILLE, ARKANSAS.
WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas,
on the 5th day of October, 1964, asking the City Council to vacate and abandon all of Meredith Street
in the Stubblefield Addition to the City of Fayetteville, Arkansas, and
WHEREAS, after due notice as required by law, the Council has, at the time and place mentioned
in the notice, heard all�Dbrions dbsiring to be heard on the question and has ascertained that the street
hereinbeofre described, has heretofore been dedicated to the public use as a street; has not been
actually used by the public generally for a period of at least five years subsequent to the filing of the
plat; that all the owners of the property abutting upon the street to be vacated have filed with the
Council their written consent to such abandonment, and that public interest and welfare will not be
adversley affected by the abanddnment of such street.
NOW, THEREFORE, PE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FA.vETTEVILLE, ARKANSAS:
SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vacates and abandons all its
rights, together with the rights of the public generAlly, in and to the street designated as follows:
All of Meredith Street which is the extreme street running East and West of Plock 4 and 6, in the
Stubblefield Addition to the City of Fayetteville, Arkansas, and reserving unto said City of Fayetteville
Arkansas,its successors and assigns an easement of right-of-way, on, over,
under and across the portion of said street hereby vacated for the purpose of constructing, installing„
operating, laying and relaying, relocatingiagd maintaining all public utilities now located or which
may hereafter be located upon said vacated street by said City, or any corporation havingg'a franchise
or right-of-way from said City. As a condition to the closing of said Meredith Street, the City shall
be held free and harmless from liability as to any claimes of the abutting owners for damages to the
property described herein, which may result from the City or other utility companies constructing, in-
stalling, operating, laying and relaying, relocating, and maintaining all public utilties now located,
or which may herediter be located upon said vacated street, and further that the petitioners agree that
they will refrain from altering or changing the grade of the terrain, which would cause damage to utility
lines located in that area.
SECTION 2. A copy of this ordinance duly deitified by the City Clerk shall be filed in the offic
of the recorder of the county and recorded in the deed records of the county.
SECTION 3. This ordinance shal'.take effect and be in force from and after its passage, approval
andpublicatior..

The Mayor reported this was the time, date and place set for a public hearing on a petition to vacate
` and abandon certain streets and alleys in the Rochier Heights Additon to the City of Fayetteville, Ark-
ansas,
The City Clerk reported that a notice of the public hearing had been published once a week for two
consecutive weeks in the Northwest Arkansas Times, a daily newspaper published inT.Jashington County,
Arkansas,cand having a general circulation in the City of Fayetteville, Arkansas, and that an abstract
of certificate of title showing the owners of record had been attached to the petition prior to the time
set for the public hearing; also that the utility companies had stated they had no objection to the
vacating and abandoning of the street and alley. f
After a brief discussion, The City Attorney introduced and at the request of the Council, read a proposed

District which had been approved by the Planning Commission.

WHEREAS, the County Court of Washington County, Arkansas, 'did on'October 30, 1964, make an Order
annexing the following territory to the City of Fayetteville, Arkansas, to -wit:
part of the Southwest r._.uarter of Section 35, Township 17 North, of Range 30 West, being more
particularly described as follows, to -wit: Beginning at a point where the present boundary
line of the City of Fayetteville, Arkansas, intersects the South line of the N4J;, of the SWC
of Said Section, township and range; and running thence North 300 feet; thence West 150 feet,
thence South 1312.3 feet; thence East 150 feet; thence North 1012.3 feet, more or .less, to
the place of beginning, containing 3.5 acres, more or less.

Alderman Christie reported thgt the Parking on Country Club Road.had become hazardous and something shou]
be done restricting the parking on this road.
After a long discussion, the City Attorney introduced'and at the request of the Council read a proposed
ordinance in its entirety for the first time entitled, "AN ORDINANCE AMENDING ORDINANCE N0. 1414 PROHIBIT

Alderman Christie moved that the rule be suspended and the ordinance placed on the second reading.
The motion was seconded by Alderman Wheeler and passed unanimously. The ordinance was then read for the
second time.
Alderman Thomas then moved that the rule be further suspended and the ordinance placed on the third and.
final reading.
The motion ergs seconded by Alderman Heflin and passed unanimously. The ordinance was then read for the
third and final time.
The Mayor then declared the ordinance open for discussion. There being no discussion, the Mayor:sked the
question "Shall the Ordinance Pass?" Upon roll call, the following vote was recorded: AYE Heflin,
Christie, Watson, Wheeler, Thomas, Burgin-, and Short. NAY None. There being seven AYES and no NAYS,
the Mayor declared the ordinance passed.
Alderman Heflin moved that the Emergency Claude be adopted.
The motion was seconded by Alderman Burgin aid upon roll call the following vote was recorded: AYE
Heflin, Christie, Watson, Wheeler, Thomas, Burgin and Short. NAY None. There being seven AYES and no

AIB ORDINANCE AMENDING ORDINANCE NO. 1414 PROHIBITING THE PARKING OF VEHICLES ON CERTAIN DESIGNATED
TPI THE CITY OF FAYETTEVILLE, ARKANSAS, AND. FROVIDING A PENALTY FOR VIOLATIONS THEREOF,
RE IT ORDAINED BY THE CITY COUNCIL OF TIE CITY OF FAYETTEVILLE) ARKANSAS:
SECTION 1. That Ordinance No. 1414 be amended to read as follows:
"Section 1. It shallbe unlawful for any person, firm or corporation to park a vehicle of any kind
whatsoever on either side of the pavement of the following designated streets in the City of Fayetteville
Arkansas:
Maple from Mission to Arkansas Avenue; Gregg f om Douglas to Dickson; University from Williams to
Dickson; Douglas from Leverett to Gree (Only on the North side)¢ Beginning at the intersection of School
Street and Sixth Street, proceeding thence East to Locust; thence South on Locust to Seventh Street;
thence East on Seventh Street to 'stood Street and from W6dd,Street North to Highway 16 East; and Twenty -
Fourth Street (Country.Club Road).
SECTION 2. During the hours from 8:00 a.m. to 6:00 p.m., it shall be unlawful for any person,
firm or corporation to park a vehicle whatsoever on either side of the pavement of the following de-
signated streets in the City of Fayetteville, Arkansas,
Leverett Avenue from Maple to Douglas (only oh the West Side); Meadow from Churdh to Plock; S
from Church to College.
SECTION 3. Any person, firm or corporation violating the provisions of this Ordinance shall be de
guilty of a misdemeanor and upon conviction thereof shall be fined in a sum of not more than $25.00 for
each offense."
SECTION 2. It appearing that the above named streets are congested by reason of heave traffic, a
necessary for the protection of the public health, and safety an emergency is hereby declared to exist,
and this ordiaance, shall be in full force and effect from and after its }passage and approval.

Th`e Ipinutes of The Regular Session held on November 9th, 1964, a copy of which had previsunly been mai
to each of the aldermen, were approved as written.
The Mayor reported this was the date, time and place set for a public hearing on a petition to abandon
and vacate that portion of Haddon Street between Bigger Avenue and a street lying parallel to and one
block South of said Bigger Avenue, not yet officially named, but known as Cherry Avenue, located in the
Country Club Addition to the City of Fayetteville, Arkansas,
The City Clerk reported that he had caused the notice of the public hearing to be published in the
Northwest Arkansas Times, a. daily newspaper published in Washington County, Arkansas, and having a
general circulation in the City of Fal•etteville, Arkansas, once a'week for two consecutive weeks, that
also had an abstractor!Is Certificate of Title showing the owners of record of the real estate abutting
upon said street, also a. resplution from the Planning Commission recommending that this street be vacat
and abandoned and letters from the utlity;i companies stating they had no objection to the street being
closed.
There being no objection, the City Attorney read a proposed ordinance in its entirety, entitled, "AN

Alderman Thomas moved that the ordinance pass.

AN ORDINANCE VACATING AND ABANDONING A FART OF HADDON STREET.
WHEREAS, a petition was duly, filed with the City Council of the City of Fayetteville,
Arkansas, on the 6th day of November, 1964, asking that the City Council to vacate and abandon part of
Haddon Street, located in the Country Club Addition to the City of Fayetteville, Arkansas, and
WHEREAS, after due notice as required by law, the Council has, at the time and place
mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that
the street hereinbefore described; has heretofore been dedicated to the public use as a street; has not
been actually used by the public generally for a reriod of at least five years subsequent to the filing
of the plat; that all the owners of the prol-erty abutting upon the street to be vacated have filed with
the Council their written consent to such abandonment, and that public interest and welfare will not be
adversel-y affected by the abandonment of such street,
NO'A', THEREFORE, PE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
