HomeMy WebLinkAbout1964-09-14 MinutesJ ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVIELE, ARKANSAS: N0, 1411 Cont. SECTION 1. Any person who may be convicted of a misdemeanor by the Fayetteville Municipal Court and who shall be committed to jail to serve his sentence imposed by said Court and/or in default o the payment of the fine and costs adjudged against him, if,willing, to discharge said sentence and(or fine and costs by manual labor on any public street, alley, public buildings, public parks and/or any other public improvement of the City, or to perform any other lawful labor for the benefit of the City of Fayetteville, Arkansas.. SECTION 2.. The City may work such a prisoner for the time he shall have been adjudged to be im- prisoned and for such further time as will discharge the fine and costs for which he may be committed At the rate of $5.00 per day. SECTION 3. The City shall obligate itself to furnish said convicts with good and wholesome food with comfortable clothing, with medicine when sick, and not require them' to work unreasonable hours, mo for a longer time during any one day than any other laborers doing the same kind of labor are a ccustome to do. N SECTION 4. It shall be the duty of the Chief of Police or a designated assistant to keep a record in which shall be stated the naive of the prisoner, time of committment and the punishment ad- judged by the Court, as well as the number of days such prisoner may be held to labor and a record of t days worked b�- such a prisoner. I• SECTION 5. That all ordinance or parts of ordinances in conflict herewith are hereby repealed and this ordinance shall be in force and effect from and after its passage, approval and publication. Fitzhugh and Clara M. Fitzhue for St. 'husband and wife, and one from A.r. Eason Jr. and MarilgiH. Eason, husband and wife, both of which were Purposes for an extension of Crest Drive. Accepted Alderman Chii!5tie moved that the deed be accepted and the City Clerk authorizedto cause the deed to be recorded in the Circuit Clerk's Office with the deed record of Washington County, Arkansas. The motion was seconded by Alderman Short and passed unanimously. September 14, 1964 to consider the Raney & written proposals submitted by five financial houses concerning the employment of a financial advisor for Sons as the City of Fayetteville in connection with a prorosed expansion of water and sewer facilities. . Finance Director of the Finance Department Albert J. Jones gave a detailed analysis of each of the five proposals Advisor and after careful evaluktion the Finance Committee recommends that the firm of T.J. Raney and Sons of for City Little Rock be appointed financial advisor to the City and that a mutually satisfactory contract for specific services and fees be worked out between T.J. Raney and Sons and the City and presented to the Council for approval just as soon as possible. The Committee further recommends that the Mayor return the proposals of the other companies and thank the for their interest in our problems. Alderman Short moved to adopt the report. The motion was seconded by Alderman Faucette and passed unanimously. Brooks The Mayor presented a deed by Doyle E. Brooks and Forrest Brooks, husband and wife, for street purposes. Deed After a brief discusion, Alderman Heflin moved to accept the deed subject to the approval -of -the City Accepted Engineer. The motion was seconded by Alderman Watson and passed unanimously. bush- Alderman Christie reported that a representative from the State Highway Department had recommended that a a temporary truck route leading from U.S. Highway 71 South to State Highway 16 East be established as orary follows: School Street East to Locust Avenue; thence South one block to 7th Street; thence East to Wood k Street thence North on Wood Street to HighwaY 16, and that the State would service and maintain this e route for trucks until a permanent route of Highway 16 could be established and contracted. After a long discussion, during.which several citizens along the proposed routespoke in opposition to routing of trucks over the, streets, Alderman Christie moved to accent the proposal of the St, Highway Department and establish the truck route from U.S. Highway No. 71 to Arkansas State Highway No. 16 East through the City as outlined above. The motion was seconded by Alderman Burgin and passed unanimously. ORDINA 1412 INANCE 141-3 Alderman Christie reported that at the last regular meetin;? of the Council on August 31, 1964 the Counc had held a long discussion on the establishing of more one-way 'streets and the regulating of parking on several other streets, but no further action was taken at tha')ime. After a very long discussion, the City Attorney intxduced and at the request of the Council read a pro- posed ordinance in its entirety, entitled, "AN ORDINANCE AMENDIMIG SECTION 3 OF ORDINANCE 1,0. 1111 ESTAB- LISHINC ONE -1 -TAY STREETS; PRESCRIBING PENALTIES FOR THE VIOLATIONS OF ITS PROVISIONS; AND FOR OTHER FUR' POSES." Alderman Burgin moved that the ordinance pass. The motion was seconded by Alderman Heflin and passed unanimously, whereupon the Mayor declared the ordinance passed. ORDINANCE N0, 1412 AN ORDINANCE AMENDING SECTION 3 OF ORDINANEE NO, 1111 ESTAPLISHING CNE -?.,TAY STREETS; PRESCRIBING FOR THE VIOLATION OF ITS PROVISIONS; AND FCR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That Section 3 of Ordinance No. 1111 shall be amended to read as follows: Description of part of street Center street from College Ave. to Church Ave. Mountain street from Chul!cb,dAve. to College Ave. East Avenue from Mountain Street to Dickson St. Block street from bickson'street to Rock street. Any person violating section 1 of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined in a sum not lessxtha6 $1.00 nor more than $25.00. SECTION 3. It appearing that th.e above named streets are congested by reason of heavy traffic,and it if necessary for the protection of the public health and safety, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval. It shall he unlawful for any person, firm or corporation, to park a vehicle of any kind (whatsoever on either side of the pavement of the following designated streets in the City of Fayetteville wrkansas. Maple from Midsion to Arkansas Ave., Gregg from Douglas to Dickson, University from Williams to Dickson e Douglas from Leverett to Gregg (only on the North side), Beginning at the intersection of School Street i 0 and 6th St. proceeding thence Fast to Locust; thence South on Locust to 7th street} thence East on the 7th Street to Wood Street and.from Wood Street to North to Highway 16 East. SECTION 2. Alderman Short then moved that the City Council allocate a total of $25,000.00 in five installments of y $5,000.00 annually to the Bos Club for the sole purpose of building a shimming pool. City of Fayetteville Fayetteville, Arkansas Gentlemen: (� We are grateful to you for inviting us to submit a proposal for a report on Beaver Lake as a source of water supply for the City of Fayetteville. This proposal is made as a joint venture of the Fayetteville consulting engineering firms of John E. �?J�j Mahaffey and Associates, Inc., and L.M. McGoodwin, Consulting Engineer. Previous experience of the two firms working together on large Fayetteville projects has accrued to the advantage of the City of Fayetteville projects hs wrell as to the individual members of the joint venture, with each of the members of the join venture contributing its respective talents and organization to the advantage of all. Our organizations have operated from A Fayetteville base for many ,years and are familiar with the economica and social pattersn of the City. Our firms ar•evall versed in all aspects of using Beaver Lake as'�a water supply and the many factors involved in cooperating with Beaver Water District. It is proposed that our study and report willcover all conditions involved, estmated costs of ob> taining water from Beaver Reservoir, transporting it and treating it through facilities of Beaver Water District, and delivering tt:eated water to the City of Fayetteville through traiiiiision mains to be buil , owned and operated by the City of Fayetteville. The report will, of necessity, include studies of using existing water supplies in conjunction with the Beaver supply. It will also include an investigation of possible "stage" construction of recommended facilities. We are making a separate proposal for a study and report on treated water storage and trunk line distribution mains. This water supply report will, however, necessarily cover certain items of distri- bution construction required for delivery of water to the existing system. The report will include evaluation of projected water usage information heretofore made available to the City, and if required, modification of such information according to the information asdialable
