C.S.T. Present: Mayor Guy E. Brown, City Clerk George J. Davis, CixtlrrControll.er Albert J. JAes, City Attorne Bass Trumbo, CiMr.Engineer W.C. Smith, and Alderman Christie, Watson, Wheeler, Thomas, Burgin.. Faucette, and Short. Ansent: Alderman Heflin, Police Chtef Hollis Spencer and Fire Chief Burl Skelton. The minutes of the Regular Meeting on M fiday July 20, 1964, a copy of had previously been mailed to eac of the Aldermen were approved as written. The Building Inspector presented the final Suh-division Plat of W.C. Rogere::for Oakland Hills Additoon to the City of Fayetteville, Arkansag which had been approved by the planning Commission. After a brief discussion, the City Attorney introduced and at the recuest of the Council read a prO- po posed yrdinance in its entirety entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ATL STREETS, ALLEYS AND EPSEMENTS IN OA.VAND HI -LS ADPITI'N TO THE CIT" OF FA"ETTEVI3LLLE, A.RKA.id°AS". Alderman Short moved that the rule a suspended and that the Ordinance be3-gn the second reading. The motion was seconded by Alderman Wheeler and passed unanimously. The Ordinance was then read for the second time. Alderman Short then roved that the rule Ferfiu•ther suspended and the ordinance be glMced on the third Ordinance No. 1405 and final reading. AV , CITv CLERK Alderman Short reported that the Finance Committee had made the following recommendations or. Change Order #3 of the Central Fire Station reading as follows: R" RETORT OF THE FINANCE COMMITTEE TO THE CIT`' C01'DTCIL OF FAYETTFI,IILLE, ARKANSAS, ON CHAYGE ORDFR P3 IN CONNECTION WITH THE CONSTRUCTIO" OF THE CENTRAL FIRE STATION 0 On instructions from the Council, the Finance Committee conducted an investigation of Change Order #3 on the Central Fire Station. Two mmmbers of the Committee, along with Alderman Christy and Thomas, met with Mr. Shelton; b?r. Shirley, Chief Skelton, Mayor Brown and Controller Jones on Wgdnesday afternoon, July 29. The architect, Mr. Shelton, stated: Report of Fi.a.nce Com, 1: That the changes became necessary when several aldermen, Mayor Provm, Mr. Shirley, and others at noon one day, while inspecting the site, determined the bench mark on Center Street, 2. That the building, if constructed with the lower floor on one level, would have had to be built with a very deep foo6ing caused by a 4 -foot drop in elevation from one end of end of the site to the other. 3. Extra cost for foundation and footings is covered in the specifications and instead of footings, dropping the floor in the truck room two feet and eight inches, which pleased the Fire Chief because of the e-tra ceiling height, was adjudged to be the more feasible of the two alternatives. 4. The extra work could have been reported as just that -extra work - which is covered in the specifications but it was reported as a change order. Mr. Shirley stated: 1. That the difference in cost between lowering the floor on part of the building or building on fill'wi.th deeper footings and foundat'ons would have been negligible. 2. That if he had been required to give an estimate of the increased cost before don- sstruction was started, it would have had to have been higher because he would have had to afford ample protection to himself. Handled as it was, the city redeived the benefit of paging only the actual cost as shown in the itemized statements attached to this report. 3. That had there been any reason for doubt that this was not in accord with the wishes of the city, would not have afforded a feasible structure, and effected at a net savings, he would have insisted on a Change Order before construction was begun. Chief Skelton stated: 1. That the bi:ilding as constructed made a,t etter fire station because of the increase fi ceiling height in the truck room, and because the driveway into the truck room is on a grade with Center Street. 2. That numerous items were added to the building at his suggestion by the contractor at no additional cost to the city. On the basis.of these statements, the FinanceCComuni.ttee feels: 1. That there is, and vm s, room for argument as to whether the extra work done on the Central Fire Station represents work that should have been classified as extra work or as a Change Order. 2. If the Change Order had been made prier to the beginning of the construction, the additional cost to the city would, in all probability, have been higher than the figure presented. • 3. Assumption of approval by the Council was made on something less than formal action recorded in the Minutes and,although all concerned acted in good faith and vrith the Change Order #3 best interest of the city in mind, the Council is nevertheless placed in the ambiguous approv d position of ratifying the expenditure of funds after the fact has been accomplished. 4. All interested parties, including administrarive officials, the City Council, the a andhitect and the contractor, rag to considered negligent if they realised thr t the changes made were eebatable as to whether t}ey represented extra. work covered in the specifications or as an addendum to the original Dlan covered by a Change Order, 5. If there is a lesson to be learned from this, it is that the expenditure of pub#c funds is a public trust invested solely in the Cite Council. Expenditures in any amount and for any purpose must be made only after due consideration, a thorough understanding }-,y all concerned, and reflected in a majority vote of the Council. This is a prerogative that must be .iealously guarded in all areas involving the expenditure of funds if the Citv Council is to fulfill its obligation and discharge its re- sponsibility. If the Council desires a redommendation from the Finance Committee, the Committee re- commenes that Change Order #3 be approved and that the Mayor and the Finance Depart- rment be authorized to make final settlements with the contractor and the architect subject to a release from all leins or other incumbrances. Alderman Short then moved that Change Order #3 be approved at a total cost of $6,911.40. The motion eras seconded by Alderman Thomas and passed unanimously. (See Change Order #3, pare ?14). Alderman Thomas read a proposed resold tion creating the position of and employing a Sanitary Engineer for the City of Fayetteville, Arkansas. Resolution 17-64 Alderman Thomas moved that the resolution he adopted. The motion was seconded by Alderman Short and passed unanimously, whereupon the Mayor declaredthe resolution adopted. RESOLUTION NO, 17-64 BE IT RESOLVED FY THE CITY COUNCIL OF THT CITv OF FAVETTEVILTE, ARKANSAS: That the positiom of Sanitary Engineer for the City of Fayetteville, Arkansas is hereby created who will be responsible for all sanitary services presently listed in Ordinance No. 1.194 2. That Mr. Daniel J. PROWNI FYAYOR U 322 The City Engineer explained that Suburban Water District No.l (6reenland) had requested permission to construct approximately 200 feet of 2? inch cast iron nater main outside their district in order'to loop water mains and remed¢/a low pressure area within the district. If permitted, it would relieve the City of having to do the Vork when they take over the district's system at some future date. Alderman Christie reported that some adtion needed to be taken regarding the parking on National Street and Government Street; also a part of Dunn Street. After a brief discission, the City Attorney introdpce and at the request of the Council read a proposed ordinance in its entirety entitled, "AN ORDINANCE PROHIBITING THE PARYING OF VEHIChSS ON THE SOUTH SIDE OF NATIONAL STREET FROM. GOVEMWENT STREET TO DUNN STREET AND DUNN STREET FROM NATIONAL STREET TO 11th STREET, IN THE CITY OF FAYETTEVILLE, ARKANSAS.9 Alderman Christie then moved that the rule be suspended and the Ordinance be placed under the second reading. Any person who may be convicted of a misdemeanor by the Fayetteville Municipal Court and who shall be committed to jail to servi his sentence imposed by said Court and/or in default the payment of the fine and costs adjudged against him, if'willing; to discharge said sentence and/or fine and costs by manual labor on any public street, alley, public buildings, public parks and/or any other public improvement of the City, or to perform any other lawful labor for the benefit of the City of Fayetteville, Arkansas.. SECTION 2.. The City may work such a prisoner for the time he shall have been adjudged to be im- prisoned and for such further time as will discharge the fine and costs for which he may be committed at the rate of $5.00 per day. SECTION 3. The City shall obligate itself to furnish said convicts with good and wholesome food with comfortable clothing, with medicine when sick, and not require them'to work unreasonable hours, mor for a longer time during any one day than any other laborers doing the same kind of labor a re accustomed to do. ' SECTION 4. It shall be the duty of the Chief of Police or a designated assistant to keep a record in which shall be stated the naive of the prisoner, time of committment and the punishment ad- judged by the Court, as well as the number of days such prisoner may be held to labor and a record of days worked bir such a prisoner. SECTION 5. That all ordinance or parts of ordinances in conflict herewith are hereby repealed and this ordinance shall he in force and effect from and after its passage, approval and publication.
