Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Bass Trumbo, City Engineer W.C. Smith, Fire Chief Burl Skelton, Chief of Police Hollis Spencer and Alderm Heflin, Christie, Watson, Wheeler, Thomas, Burgin, Faucette and Short, mutes The Minutes of the regular meeting on Monday, January 24, 1964, a copy of which had previously been maile pproved to each of the Aldermen wereaapproved as written. The City Attorney introduced and at the request of the Council, read a proposed ordinance in its entirety entitled,"AN ORDINANCE ACCEPTING NEWLY ANNEXED TERRITORY TO THF. CITY OFT AYETTEVILLE, ARKANSAS; ASSIGNING TO WARDS; AND OTHER PURPOSES." No further action was taken at this time. ussion The Council had a long discussion on the zoning of newly annexed territ?ry;to the City of Fayetteville, on which under the present zoning ordinance becomes R -1A Single Family Residential District upon annexation. ng Alderman Faucette then moved to authorize the Planning Commission to hold clipFublic Hearing relative to a- nance mending the zoning ordinances whereby all territories upon being annexesd to the City of Fayetteville, Arkansas, would be in 0-1 Open Land District, rather than R -1A Single'Family Residential District as is now provided in the zoning ordinance. 0• The motion was seconded by Alderman Christie and upon roll call, the following vote was recorded: "Aye" Hdflin, Christie, Watson, Wheeler, Burgin, Faucette and Short. McGoodwin, Cunsulting Engineer, appeared before the Council showing the plans for outfall sewers a uthorized collection sewers to be built in the Southwest part of the City and explained that the plans had been to approved by the State Health Department and the U.S. Public Health Department and requested that a date dvertise be set for receiving the bids. . for Alderman Wheeler moved that the City Clerk be authorized and directed to cause a Notice to Contractors Bids to be advertised in the Northwest Arkansas Times, a•newspaper published in Washington County, Arkansas, for and having a general circulation in the City of Fayetteville, Arkansas, for bids to be received and Sewer opened on Monday, March 23, 1964 at 2 o'clock p.m., $.,S.T. Works The motion was seconded by Alderman Faucette and passed unanimously. The City Engineer reported that the construction of two sections of sewer laterals were needed on Highwa, 71 South. One to cross highway just south of Country Club Road and one"to cross highway just south of Purdy's Store, at an estimated cost of $25,000 and $27,000 respectively. After a long discussion, Alderman Wheeler moved to approve the construction of the two sections of sewer laterals on Highway 71 South -and that the City Engineer be and he is, hereby authorized to advertise for bids on the project. The motion was seconded by Alderman Heflin a;id passed unanimously. Alderman Wheeler then moved that the City employ9A J.E. McClelland, Consulting Engineer, for this proj The motion was seconded by Alderman Thomas and passed unanimouijy. , Representatives of Elkins Water Improvement District No. 7 appeared besdre the Council with reference to their contract with the City of Fayetteville, Arkansas, and requestred that Paragraph B of the contract be changed. I I ' After a very long discussion, Alderman Burgin moved Suburban Water District No. 7 be allowed to use re- bate money from City Revenues up to $25,000 to go into a contingency reserve fund provided that the levy of 4.5 mills not be reduced nor the total assessment of the district, $560.0(X).00 not be reduced without approval of the City Council of the City of Fayetteville and in no event shall either he reduced until a -pp- sum of $25,000.00 derived from surplus funds from levies against the district alone be used to pre- lfew maturely call bonds in inverse numerical i6rder. Alderman Short read a proposed resolution entitled, "A RESOLUTION FIXING THE RESPONSIBILITY FOR CATALOGING' AND CLASSIFYING RULES AND REGULATIONS GOVERNIuG THE FISCAL POLICIES OF THE CITY OF FAYEPTEVILLE, ARKANSAS; AS PASSED AND APPROVED BY THE CITY COUNCIL." Alderman Short moved that the resolution be admpted. The motion was seconded by Alderman Burgin and passed unanimously whereupon the Mayor declared the resolution im ado pt ed. RESOLUTION N0, 144 A RESOLUTION FIXING THE RESPONSIBILITY FOR CATALOGING AND CLASSIFYING RULE, AND REGULATIONS GOVERNING THE FISCAL POLICIES OF THE CITY OF FAYETTEVILLE) ARKANSAS, AS PASSED AND APPROVED BY THE CITY CONHIL. WHEREAS, the will and purpose of the City Council, as stated in Ordinance Number 1382, passed and approved January 13, 1964, can best be served bytthe orderly presentation of rules and regulations settin forth the basic fiscal policies of the City of Fayetteville, Arkansas, and WHEREAS, the primary purposes of the rules and regulations are to assign definite responsibilities and to establish clear lines of authority, and WHEREAS, the rules and regulations passed and approved by the City Council should be maintained in systematic and readily accessible manner, and 1dHEREAS, Ordinance Number 1382, passed and approved January 13, 1964, provides for the adoption of and regulations governing allphases of fiscal control; NCIKI THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: . 2-64 No. 3-64 275 SECTION 1. WHEREAS, Ordinance No. 1382, passed and approved January 13, 1964, provides for the enactment of head and/or foreman, shall and regulations in all areas of fiscal control, the City. I. It shall be the duty of the City Controller in cooperation with each department head and/or foreman to design a form or forms whereby the time of all city employees will be accounted for and certified for each and every pay period. SECTION 2. The methods of accounting for and certifying all employees' time shall be by the "exception basis" or the "positive basis". SECTION 3. The City Controller, in cooperation with eachdepartment head and/or foreman, shall Gide which method is to be used by each department of the City. or special session. The SECTION 4. -It shall be the responsibility of the D.partment of Finance to distribute the pay. of the City of Fayetteville. SECTION 5. That there is hereby appropriated from the unappropriated surplus of the General Fund of the City of Fayetteville, the sum of twenty -Five thousand dollars ($259000.00 to be credited to a fund which is hereby designated the "Contingency ;laid" for the purpose of providing funds for emergency expenditures of the City of Fayetteville. SECTION 2. Expenditures from the Contingency Fund shall be made by resolution, passed and approved by the City Council in regular or special session. The money in the Contingency Fund shall be continously invested and reinvested by the 1965 City Controller in direct obligations of, or obligations, the principal of and interest on which are un- �0 conditionally guaranteed by the United States Government. Resolution RESOLUTION NO, 4-64 4'64 A RESOLU'T'ION ESTABLISHING A REPLACEMENT FUND FOR THE CITY OF FAYETTEVILLE, ARKANSAS; PROVIDING FOR THE REPLACING OF MONEYS USED FROM AREPLACE1�ENf1 FUND; FIXING THE RESPONSIBILITY FOR UTILIZING A REPIACEMENT FUND; PROVIDING A BUDGET FOR A REPLACEMENT FUND; A14D FOR OTHER PURPOSES. WHEREAS, the City of Fayetteville has a substantial investment in vehicles and machinery that is used.by the various departments of the City, and WHEREAS, the replacement of vehicles and machinery is a major financial problem in the operations of the City of Fayetteville, and WHEREAS, Ordinance Number 1085, passed and approved June 20, 1955, provides a "Vehicle and Main- tenance Equipment Replacement Fund", which is inadequate for today's needs, and WHEREAS, Ordinance Number 1382, passed and approved January 13, 1964, provides forthe establishmei of funds; NOW, THEREFORE, BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That there is hereby appropriated from the unappropriated surplus of the General Fund the sum of $15,000.00, from the unappropriated surplus of the Public Works Fund the sum of $2,500,00, an( from the unappropriated surplus of the Shop Fund the sum of $500.00, all of which to be credited to a fund which is hereby designated as the "Replacement Fund", for the purpose of providing funds for the re� placement of vehicles and machinery used by all departments of the City. SECTION 2. That each and every month from and after the passage and app$oval of this resolution, until terminated by appropriate action of the City Council, there shall be appropriated frin ti,e General Fund the sfun of $1,000.00 per month, from the Public Works Fund the sum of $800,00 per month, and from the Shop Fund, the sum of $25.00 per month, all of which shall be credited to the "Replacement Fund", foi the purpose set forth in Section .I hereof. SECTION , Expenditures from the Replacement Fund diall be made by resolution passed and aproved by the City Council in special or regular session and only for the replacement of vehiiles and machinery listed on the schedule which is attached and hereby made a part of this resolution as Exhibit 1. SECTION 4.. A new schedule of vehicles and machinery and a budget for the Replacement Fund shall be prepared and submitted to the City Council at the same'time, indand same manner, and subject to any and all rules and regulations governing the preparation and submission of the annual budget.. SECTION 5. The money in the Replacement Fund shall be continously invested and reinvested by the City Controller in direct obligati.onlfof, or obligations, the prinicpal of and interest on which are un- conditionally guaranteed by the United States Government. Approved The motion was seconded by Alderman Wheeler and passed unanimously. Approved Alderman Heflin then moved to appropriate $13,000.00 from the Unappropriated Funds to purchasectwo Purchase Pakmore or similar equipment for the Sanitation Department, 2 Pakmore The motion was seconded by Alderman Watson and passed unanimously. BROWN, MAYOR The City Council of Fayetteville, Arkansas, met in special session on Friday, February 14, 1964 at 12:00 o'clock noon in the Mt. Inn Motor Lodge. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Bass Trumbo, City Engineer W.C. Smith, Fire Chief Burl Skelton, Chief of Police Hollis Spencer, and Alde men: Heflin, Christie, Watson, Wheeler, Thomas, Burgin, Faucette and Short. Absent: None The Mayor reported that the purpose of the meeting was to consider a resolutioh prohibiting extensions water mains beyond the City limits.and that all members of the Council had been notified by U.S. Mail and by telephone. Alderman Short moved that the Council do not consider entering into a contract with Suburban Water Dis No. 8 at this time. The motion was seconded by Alderman Heflin and upon roll call, the following vote was recorded: "Aye" Heflin, Christie, Wheeler, Thomas, Faucette and Short. "Nay" Watson and Burgin. Their being six "Ayes" and two "Nays", the Mayor declared the motion pass.' The/City Attorney read a'proposed resolution prohibiting the extensions of water mains outside the City imits. Alderman Heflin moved.that the resolution be adopted. The motion was seconded by Alderman Faucette and upon roll call, the following vote was recorded: "Aye" Heflin, Christie, Wheeler, Thomas, Watg6n, Faucette and Short. "Nay" Burgin. Their being seven "Ayes" and one "Nay", the Mayor declared the motion pass. BH N, AiAYOR ATTEST'so)g* EOR G J.elDAVIS, CITY CLERK 91den'map Whiner presented a proposal of the Fulbright Investment Company to sell to the City 202 acres located at Fayette Junction for $7;000 cash plus the property now occupied by the City Jail. _ After a long discussion, Alderman Burgin moved that the City accept the offer of the Fulbright Investment Company dated February 6, 1964 to sell to the City for a future water and sewer department operations center 201 acres of land on Cato Springs Road and west of Frisco Railroad for $7,000 and the lot of approximately 31 % 78' on which the present City Jail is located, and that the Mayor and City Clerk are authorized and directed tooexecute'the necessary deeds to convey the City property to the Fulbright In- vestment Company upon recevpt of a warranty deed with an abstract and an acceptable title ©pinion from th City Attorney from the Fulbright Investment Company to the City of Fayetteville fon the said 2o-2 acre tract. The motion was seconded by Alderman Heflin and upon roll call the following vote was recorded: "Aye" Heflin, Christie, Wheeler, Thomas, Burgin, And Short. "Nay" Watson and Faucette. Thein being six "Ayes" and two "Nays", the Mayor declared the Mtioni0 passed, re being no further business, Alderman Short moved to adjourn.
