Plat The Building Inspector presented a plat for a proposed sub -division which is a part of Block 8 Broad - Presented View Sub -division to the City of Fayetteville, Arkansas, which had been approved by the Planning Commi-' Broadview ission. Alderman Short moved that the ordinance pass. The motion was seconded by Alderman Faucette and passed unanimously, whereupon the Mayor declared the ordinance passed. RDINANCE ORDINANCE N0. 1380 O. 1380 AN ORDINANCE TO ACCE PP AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS, AND EASEMENTS IN A SUBDIVISION OF PART OF BLOCK 8 OF BROADVIEW SUBDIVISION TO THE CITY OF FAYE^1TEVILLE3 ARKANSAS. WHEREAS, there has been duly presented to the City of Fayetteville, Arkansas, a plat dated November, 196 known as a subdivision of Part of Block 8 of Broadview Subdivision to the City of Fayetteville, Arkansas which the owners have dedicated for the public use the streets, alleys and easements shown upon said pla and YIHEREAS, the City Planning Commission of the City of Fayetteville, Arkansas, has recommended the accept- ance of said plat. NOW, THEREFORE, BE IT ORDAINED BYYTHE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City of Fayetteville, Arkansas, hereby accepts and confirms the dedication of 'all streets, alleys and easements, dedicated in a Subdivision of Part of Block 8 of Broadview Subdivision to the City of Fayetteville, Arkansas, and hereby declares said streets, alleys and easements to be publ streets, alleysand easements, and the said City Council hereby assumes the care,^i control and jurisdict of the same. NG The City Building Inspector brought up.the problem and the Building Inspectors policy of issuing build permits for remodeling and erection of County, State Federal and Public School Buildings. The Inspector noted that a bond issue for public school improvements had been approved by the citizens of Fayetteville. The question of whether or not building permit fees should be charged for these buildings and the zoning requirements for public schools should be cleared up and a definite policy adopted. He requested that the building and ordinance committees study these problems. Alderman Short moved to refer this to the Building and Ordinance Committee. The motion was seconded by Alderman Wheeler and passed unanimously. The Mayor reported that the Standing Committees for the Year of 1964 would be the same as in 1963. Murphy be reappointed and that Floyd Carl Jr. rvice be appointed to the vacancy of A.P. Eason Jr. mmission Alderman Burgin moved to accept the recommendation of the Mayor and appoint J -.W. Board of Alderman Thomas moved to appoint James Kerlin to the Board of Adjustments as recommended by the Mayor. AAjust. The motion was seconded by Alderman Watson and passed unanimously. Appoint The Mayor then.recommended that Don Trumbo Jr. be appointed to the Board of Appeals Vice Robt. McKinney Trumbo to whose term expired January 1, 1964, for a five year term. Board of Alderman Thomas moved to appoint Don Trumbo Jr. as a member of the Board of Appeals as recommemded by the Appeals Mayor. The motion was seconded by Alderman Wheeler and passed unanimously. Change- Alderman.Short presented some minor changeorders in the contract for Firestations No. 3 and 4, at a total Orders cost to the City of $325.72• for After a brief discussion, Alderman Short moved to accept the changeorders and authorize the Mayor and the Fire City Clerk to execute thehohgnge orders in the contract, as requested. Stations The motion was seconded by Alderman Faucette and passed unanimously. The change orders were spread in the minutes as a permanent record. FIRE STATIONS # 3 and #4 F'AYET'TEVILLE, ARKANSAS December 12, 1963 Change CHANGE ORDER #1 Order #1 1. Replace electrical panels "A" and "B" in Fire Station #3 (nobth) with one panel #QH412HAR0 and one panel Q0420RO for 3 phase service. No change in cost 2. Add one (1) convenience duplex outlet with separate 20 amp circuit under counter top of kitchen cab- inet and by sink for electric water heater. Add: $23.23 3. Replace three (3) lighting fixtures "Y" with three (3) Litecraft fixutres #F342PR with 150 watt par 38 lamp or approved equal in each fire station #3 and #4. No change in cost. 4. Use kitchen sink Eljer Model E-2271 in each fire station #3 and #4, as originally specified. Rough in for sinls listed in nItems not in contracts." Add: $98.00 5. Rough in for electric heater in "Items not in contracts." Delete electric water heaters in Fire Stations #3 and A. Add: $67.00 6. Rough in for lavatories in "Items not listed in contracts." Delete lavatories in fire Stations #3 and A. Add: $110.00 7. Change floor drain line in hose room bf fire stations #3 and #4 from sand pit drain lime to sewer drain line at service sink. Deduct: $24.12 8. Change sand pit drain line for fire station #3(north) to terminate 5 feet outside of building at southwest comer instead of northeast comer as shorn on plans. Add: $51.61 Total addition to contract price by incorporation of this change order Add: $325.72 CITY OF FAYET VILLE GENERAL CONTRACTOR MAY � BY CITY CLERK ARCHITECT BY Fire Chief Burl Skelton reported that certain equipment would be needed by the Fire Department during the year 1964 and he recommended that the equipment be liurchased early in the ,year. Authorize After a brief discussion, Alderman Heflin moved to authorize the Mayor to advertise for bids.on January Bids 15 and 22, 1964 for one 750 gallonnpbr minute pumper, 1 rescue unit with 750 gallon per minute pamper n1'Equ1p. one snorkel with 1,000 gallon per minute pump and one aerial ladder with 1,000 gallons per minute pumper, all to carry class A rating but only the pumper, rescue unit, and either the snorkel or aetiall ladder would be purchased, the decision to be made by the Council after the bids are opended on February 12, 1964. AN ORDINANCE ESTABLISHING THE DEPARTMENT OF FINANCE OF THE CITY OF FAYETTEVILLE, FIRING THE RESPONSI* BILITIES OF THE CITY CONTROLLER, ESTABLISHING THE RELATIONSHIP BETWEEN THE PAYOR, THE COUNCIL, OTHER ELECTED MUNICIPAL OFFICIALS, MID THE DEPARTMENT OF FINANCE: DECLARING AN EMERGEIICY, AND FOR OTHER PUPO.SES . WHEREAS, it is compatible with good accounking practice that the City Council establish ane agency of municipal government to supervise the collection and disbursement of funds according to rules and reg- ulations adopted by the City Council, and WHEREAS, the establishment of proper procedures dealing with such collection and disbursement requires adequate education and practice in the field of accounting, and WHEREAS, the tenure of elected officials is subject to the will of the people, but the business of the City will continue from administration to administration and from City Council to City Council, and WHEREAS, all of the financial affairs of the City, both short range and long range, should be grounded in procedures fiscally sound, economically reasonable, and pledged to the maximum utilization for all. of the governmental needs of the City of Fayetteville, NOrl, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL IIF THE CITY OF FAYETTEVILLE; !� SECTION I. There is hereby established the Department of Finance of the City of Fayetteville. SECTION II. The Department of Finance shall be headed by a person acceptable to the City Council and shall be Imown.as.the City Controller. SECTION III. The Department of Finance, upon the recommendation of the City Controller and the Mayor, may be, at the discretion of the City Council, sub -divided into offices having specified areas of responsibilities, such as but not restricted to collecting, disbursing, and internal auditing. SECTION IV. It shall be the duty of the Department of Finance to: (A) Collect, record, issue receipts for all funds legally levied by the Municipal government of the city of Fayetteville and to perform this service in accordance with the rules and regulations governing collection, recording, and receiving as approved by the City Council (B) To disburse money in accordance with the rules and regulations goberningtthe disbursements of funds as approved by the City Council. (C) To advise the Council at stated intervals of the status of all funds, as well as the gener fiscal status of the municipal government. (D) To present to the City Council suggested 'rules and regulations or changes in current rules .and regulations that would improve systems for collecting, disbursing an budgeting funds. (E) To recommend to the City Council the investment of surplus funds. (F) To assit and advise with the Mayor, other elected officials, department heads and the City Council in the construction of the annual budget and in long range projects requiring eithi the acquisition of new funds or the build-up of retained funds to achieve a capital outlay not feasible in the annual budget. (G) To supervise the spending of the funds allocated by the City Council in the annual budget in order that each item of disbursement will be in compliance with the rules and regulatil adopted by the City Council governing budgetary expenditures. SECTION V. If any section, subsection, sentence, clause of phrase of this ordinance is foreanp7eaeon deUardd unconsitutional or invalid, such decision shall not affect the validity of the remaining portio of this ordinance. SECTION IV. Whereas the passage of this ordinance is necessary for the preservation of the public h peace and safety, an emergency is dealared to exist, and this ordinance shall be in full force and e from and after its passage and approval. SETTING FORTH THE BASIC FISCAL POLICIES OF THE MUNICIPAL GOVERNMENT OF THE CITY OF FAYETTEV FIXING THE RESPONSIBILITY OF THE COLLECTION AND DISBURSEMENT OF FUNDS; PERMMING THE CITY COUNCIL BY RESOLUTION TO ADOPT RULES AND REGULATIONS GOVERNING ALL PHASES OF 'FISCAL CONTROL; DECLARING AN EMERGENCY AND FCR OTHER REASCYNS. DISBURSEMF2ITS (A) All funds disbursed by the City of Fayetteville shal be made b�- check, signed by the Mayor, indicating his approval of the expenditures, and countersigned by the City Controller indicating that th amount expended is in complete compliance with all rules and regulations governing the purchase of mater and/or services as adopted by the City Council. SECTION III. ESTAELISHMRIT OF FUNDS (A) The City Council upon recommendation of the Mayor and City Controller and in;iaccordance wit good municipal accounting practices, shall establish specific funds into which all receipts shall be de- posited. (B) All funds shall be establ§hed and activated by mules and regulations adopted b• the City Council governing collections for the City of Fayetteville. SECTIO14 IV. BUDGETING (A) The Mayor shall on or before the last regulat council meeting in November of each year pre to the City Council a budget drawn in accordance with the rules and regulations governing budget constr adopted by the City Council, SECTION V. AUDITING (A)' The City Council will adopt from time to time, by resolution, rules and regulations submittedl by the Department of Finance covering the collection, expending, and auditing all funds of the City of Fay- etteville. ay- etteville. Finance Committee of the City Council concerning budgeting, investment of Hinds, supplemental appropriation of unallocated funds, and any other areas of fiscal control not specifically assigned to the Department of Finance. SECTION VII. WILL AND PURPOSE (A) It is the will and purpose of the City Council of Fayetteville in the adoption of this ordi nance to expressly state that all funds collected by the City shall be duly levied and deposited in the Department of Finance, that all disbursements by the City shall be in accordance with the rules and reg- ulations adopted by the City Council, and that proper plans for the development of municipal services by all departments bf municipal government shall be formulated and articulated in the adoption of an ahnual report. SECTION VIII. SAVINGS CLAUSE (A) If any section, subsection, sentence., clause or phrase of this ordinance -is for any reason declared unconstitutional or invalid, such decision shall riot affect the validity of the remaining porti of this ordinance. SECTION IX, EMERGENCY (A) Whereas the passage of this ordinance is necessary for the preservation of the public healt peace and safety, an emergency is declared to exist, and this ordinance shall be in full force and effec from and after its passage and approval. Jones, as City Treasurer to fill the vacancy of Mr. Roy Nix, City Treasurer, who has been ill and unable to fulfillthe duties of the office of City Treasurer during the past twelve months, until a candidate is dul7r elected for thatoffice. The motion was seconded b;r Alderman Thomas and passed unanimously. The overall budget for the year of 1964 for the General Fund and P„blic Works Fund, was discussed and an agreement reached, but no further action was taken at this time. There being no further business, Alderman Hcflin moved to adjourn.
