The City Council of Fayetteville, Arkansas, met in regular session on Monday December 9, 1963 at 1:30 p.n
in the Council Room of the City Administration Building.'
Present: Mayor Guy..E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney
Bass Trumbo, City -Engineer W.C. Smith, Chief'of Police Hollis Spencer,'Fire Chief Burl Skelton and
Aldermen: Heflin, Christie, Watson, Wheeler, Thomas, Burgin, Faucette, and Short.
Absent: None
The minutes of the Regular meeting on Monday November 25, 1963 and of the special meeting on Thursday
December 5th 1963, a copy of which had previously been mailed to each of the Councilmen were approved as
written.
The Mtayor reported that plans for remodeling the east side of the administration building on the Main
floor, had been discussed with the Chamber of CommercetAfter a long discussion,
Alderman Thomas moved that the Building and Ordinance Committee be and they are hereby authorized to
meet with the Building Committee of the Chamber of Commerce relative to remodeling the East Side of the
main fl6or of the City Administration Building by the Chamber of Commerce without expense to the City,
and that the said Building and Ordinance Committee is hereby given authority to a6E'."
The motion was seconded b Alderman Burgin"and passed unanimously.
The City Attorney, at the request of the Council, read the proposed ordinance which had been left on the
first reading at the regular meeting of the Council on Monday November 25, 1963, in its entirety, for
the second time entitled, "AN ORDINANCE. ENACftNG FIRE REGULATIONS: PROVIDING PENALTIES FOR VIOLATIONS
THEREOF: AND FOR CIPHER RELATED PURPOSES."
Alderman Burgin moved that the rule be suspended and that the ordinance be placed on the third and final
reading.
The motion was seconded by Alderman Short andpassed unanimous.
The ordinance was then read i.'n its entirbty for the third and last time,
After a long discussion, the Mayor asked the question, "Shall the Ordinance Pass?"
Upon roll call, the following vote was recorded:
"Aye" Heflin, Christie, Watson, Wheeler, Thomas, Burgin, F?ucette, and Short.
"Nay'1 None
There being eight "Ayes" and no "Nays", the Mayor declared the ordinance passed.
Alderman Heflin then moved that the Emergency clause be adopted.
The motion was seconded by Alderman Wheeler and passed unanimous, whereupon the Mayor declared the
Emergency Clause be adopted.
ORDINANCE N0, 1379
AN ORDINANCEACTING FIRE REGULATIONS; PROVIDING PENALTIES FOR VIOLATIONS THEREOF; AND FOR OTHER RE-
LATED PURROSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVU,LE, ARKANSAS:
SECTION 1. That the following acts shall be misdeameanors and shall be punished by a fine of not
less than $10.00 and no more than $100.00 or a jail sentence mot less than 10 days and not.more than a
,year or both such fine 6r imprisonment.
a. The setting on fire or causing or procuring to be set on fire, any forest, brush or other in-
flammable vegetation on lands not his own.
b. Allowing fire to escape from the control of the person building or having charge of the fire, or
'to spread to the lands of any person other than -the builder of the fire.
c. The burning of any brush, stumps, logs,rubbish, fallen timber, grass, stubble, scrap materials
junk or debris of any sort, whether bnshNnown land or that of another, without taking necessary pre-
caution both before lighting'the fire and at all times thereafter to prevent the escape thereof. The
escape of such fire to adjoining timber, brush, or grass lands shall be prima facie evidence that nec-
essary precautions were not taken.
d. Building a camp fire upon lands, not one's own, without clearing the ground immediately'around
it free from material which will carry fire,.or leaving thereon, a camp fire to spread thereon or by
throwing away a lighted cigar, match, cogarette, or by thenuse of firearms or in any other manner start-
ing a fire in forest material not his own and leaving the same un extinguished.
e. Defacing or destroying fire warning notices.
SECTION 2. When one of the above desdribed offenses is committed by an agent or employee, with the
consent or b;> the command of the employer or principal, such employer or principal shall be liable in
the sam manner and to the same extent as if the act had been committed by himself.

SECTION 5. Any fire or any forests, cut over, brush lands, or grasslands, burning uncontrolled
is declared a public nuisance b;r reason of its menace to life or property. Any person, firm or corpor-
ationrresponsible for either the starting of theexistence of such fire is hereby required to control
or extinguish it immediately and if said person, firm or corporation shall refuse, neglect or fail to
do so, any organized fire suppression force may summarily abate the nuisance this constituted by control
ling or extinguishing the fire and the cost thereof may be recovered from said respohsible person, firm
or corporation by civil action.
SECTION 6. This ordinarice being necessary for the preservation of the public peace, health, comfor
convenience, safety and wle£are of the City of Fayetteville, Arkansas, an emergency is declared to exist
and this ordinance shall be in full force and effect from the date of its passage and approval.

The City Clerk read a proposed ordinance in its entirety, entitled,"AN ORDINANCE PROVIDING THAT ALL
AUTOMOBILE DEALERS WITHIN THE CITY OF FAYETTEVILLE, ARKANSAS, FURNISH THE FAYETTEVILLE POLICE DEEART-
MENT CERTAIN INFORMATION ON VEHICLES PURCHASED AND SOLDJPROVIDING A PENALTY, AND FOR. OTHER PURPOSES."
No further action was taken at this time and the ordinance was left on the first reading.
There being no urther business, Alderman Heflin moved to adjourn. It was seconded by Alderman Shorty
and passedous w ere on the Mayor declared the meeting adjourn%
