Absent: None The Minutes of the regular meeting on Monday September 23, 1963, special meeting Wednesday October 2, 1963, and of the regular meeting adjourned on Monday, October 14, 1963 were approved as written. Allngg discussion was held on the need of an ordinance amending Ordinance # 1138,( Unloading of Gasoline and other volatile mixtures). The City attorney introduced and at the request of the Council read a propoeed in its entirety entitled, "AN ORDINANCE AMENDING ORDINANCE NO. 1138, MORE SPECIFICALLY TO PRO= VIDE THA BULK PLANTS SHALL BE EXCLUDED FROM LOCAL REGULATIONS PERTAINING TO HOURS OF DELIVERY OF GAS- OLINE." Alderman Short moved that the Ordinance pass. The motion was seconded by Alderman Wheeler and passed unanimously, whereupon the Mayor declared the Ordinance passed. ORDINANCE =, 10 AN ORDINANCE AMENDING ORDIMCE NO. 1138, MORE SPECIFICALLY TO PROVIDE THAT BULK PLANTS SHALL BE EX- CLUDED FROM LOCAL REGULATIONS FERTAINING TO HOURS OR DELIVERY OF GASOLINE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE; ARKANSAS. Section 1. That Section 1 of Ordinance No. 1138 shall be amended to read as follows: Section 1. "Gasoline, or any other volatile liquids, shall not be distributed, or delivered in wholesale quantities, to any filling stations for storage, or sale or transferred from on vehicle to another, between the hours of 8:00 p.gi, and 5:00 a.m., except when such distribution or delivery is authorized by a permit issued by the Chief of the Fayetteville Fire Department on appropriate appli- cation; and the Chief of the said Fire D.,partment is hereby authorized to issue such permit. It is specifically provided that the provisions of this ordinance shall not apply to bilk plants." Section 2. After a long discussion, the Mayor, at the request of the Council, appointed a committee of Alderman Short and Burgin to study this with the City Attorney and City Controlle,raaddrreport at the next regular meeting on Monday, October 28, 1963. + The City Clerk presented the petition of W.A. Lewis and Murray F. Lewis ,to close a portion of an alley in A.L. Trent subdivision of Oak Grove Addition to the City of Fayetteville, Arkansas, which had been approved by the City Planning Commission of Fayetteville, Arkansas. After a brief discussion, the City Attorney introduced add read a propoodd resolution setting fotth the time, date, place, and purpose of a Public Hearing to be held on said petition. Alderman Short moved that the resolution be adopted. The motion was seconded by Alderman Burgin and passed unanimously whereupon the Mayor declared the reso- lution resolved. solution RESOLUTION N0. 16-63 .18-63 WHEREAS, it appears that the petition of W.A. Lewis and N{urray F. Lewis, to vacate and abandon a portion of an alley in the A.L. Trent subdivision of Oak Gpve Addition to the City of Fayetteville, Arkansas, more particularly described as follows; Beginning on Davidson Street, at the Southwest corner of Lot (5) in Block (3) running thence in a Northeasterly direction along the West line of Lot (5) (70) feet, more or less, to the Southweste8brrndtxvft.Lob 44 # Bil.eck (3); thence West (12) feet, thence in a 8obthwesterly direction along the East line of Lot (3) in Block (3) (70) feet, more or less, to the South- east corner of said Lot (3) in Block (3); thence East (12) feet to the point of beginning. The i0otion was seconded by Alderman Watson and passed unanimously whereupon.the Mayor declared the Ordinance passed. Ordinance ORDINANCE N0. 1372 No. 1372 AN ORDINANCE 1MENDING ORDINANCE N0, 1083, MORE SPECIFICALLY TO PROVIDE FOR THE RENTING OF CERTAIN PAR SPACES IN OFF-STREET PARKING L01TS AND FOR OTHER PURPOSES, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS, Section 1. Ordinance No. 1083 and all other ordinances pertaining to off-street parking of the City of Fayetteville, Arkansas, are amended to provide that the Fayetteville Parking Association is hereby authorized to rent pp to 60 parking spaces, located in the off-street parking lots which are now subsidized by said assodiation, for a charge of $6.00 per month for each narking space. All proceeds from the rental of•hhe aforesaid parking spaces shall be transferred to the city at the end of each month, with said amount being credited to the amount the Assiciation is required to pay tbothe city for subsidizing the operations of certain off-street parking lots located in the City of Fayetteville, Ark- ansas, Section 2. It is specifically provided that the public will still be authorized to park in those parking spaces marked for rental. Section 3. A permit shall be issued by the Association to any person renting any one of the afore- said parking spaces, and said permit shall be affixed to the persons vehicle,in sncb a way that those persons policing the parking lots will ne able to observe the permit. That all vehicles which display the permit as above mentioned may be.parking the the parking spaces specifically marked for rental, without the necessity of depositing any coins in the meter for that parking space. Section $. The sale of the parking permits, the marking of meters for rental, the collection of the rental proceeds, and all other matters related to the rental of parking spaces located on the off9street parking lots, shall be managed by the Association. Section 5. The motion was seconded by Alderman Burgin and passed unanimously. Alderman Short reported that the Econo-Car Rental System of Arkansas, had made application to t he City for permission to operate rental cars from the Municipal Airport. After a long discussion, Alderman Short read a proposed license agreement for this carerental system. Alderman Short then moved to accept the license agreement and that the Mayor and City Clerk be and they are, hereby authorized to execute the contract, and that the Mayer, City Engineer, and Manager of the airport, be authorized to designate the parking spaces for the cars and the telephone space. The motion was seconded by Alderman Heflin, and passed unanimously. The license agreement was spread in the minutes as a permanent record. License LICENSE AGREEMT Agreement THIS IJCE14SE AGREEMENTx made and entered into thithis day of October, 1963, by and between the City of Fayetteville, Arkansas, a municipal corporation, hereinafter designated as Licensor, and Econo-Car Rental System of Arkansas, hereinafter designated Licensee, WISNTES. SETH: The Licensor hereby grants permission to the Licensee to operate a telephone in the Terminal Building in the Fayetteville,Municipal Airport, to be used exclusively and for the.purpose of pro- viding telephone service to be utilized by the Licensee in operation of its car -rental system. The Licensee hereby agrees to pay to the Licensor as consideration for this License the sum of Ninety-five Dollars ($95.00), payable in advance. This License agreement shall be for a term beginning and ending The Licensor further agrees that the Licensee shall be entitled to two parking spaces adjacent to the above described premises at a rental of Twenty-five Dollars ($25.00) per space per year. The location of these parking spaces shall he determined b;: the Licensor. The Licensee shall not assign nor sub -let the licensed pvemisehonithout prior written consent of the Licensor. The Licensor shall provide and pay for all lights, heat, water, and other utilities for these premises. The Licensee agrees to maintain the licensed premises in goo repair and in a tenantable condition. 256 If the licensed premises be destroyed by fire or other casualty, this license shall immediately terminat In case of partial destruction or damage so as to render the premises untentable, either party may term- inate the license by giving written notice to the other within fifteen (15) days thereafter, and if so terminated, no rent shall accrue to the licensor after such partial destructs on or damage. The Licensor shall have the right to cause Licensee to remove any signs or advertisements from the licensed premises which to the Licensor are deemed if any way objectionable or undesirable. Alderman Burgin moved that the Ordinance pass. The motion was seconded by Alderman Faucette and passed unanimously, whereupon the Mgyor declared the ordinance passed. ORDINANCE ORDINANCE N0. 1373 N0. 1373 Ali ORDINANCE CHANGING THE NAME OF A STREET WITHIN THE CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARK= ANSAS. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: i Section 1. That the name bf the following streets shall be changed as follows: rAV yppi -inN Austin Avenue in the Northridge Sub-division(to lune Way Terrace ; Oakwood Avenue in the Watson Addition to Briarwood Lane; Oak Street to Andrew Street; a d the street between Williams and Sequoish to Rex Drive. Alderman Helfin read a proposed set of rules and regulations governing suburaban water districts inre- lation to the sale of water outside the city limits. After a long discussion, Alderman Heflin moved that the rules and regulations be adopted. The motion was seconded by -Alderman Burgin, but before a vote was taken, the Mayor requested that the Council study this more carefully. Alderman Heflin, with the consent of Alderman Burgin, withdrew the motion. There being no farther business, Alderman Faucette moved to adjourn.
