Brown, City Clerk George J. Davis,City Controller Albert J. Jones, City Att- orney Bass Trumbo, City Engineer W.C. Smith and Aldermen*, Heflin, Christie, Watson, Thomas, Burgin, Faucette, Snd Short, Absent: Alderman Wheeler Purpose The Mayor reported that the purpose of the meeting was to pass a resolution authorizing the Mayor to of Meeting sign necessary papers to complete the proposed sewer mains to the Campbell Soup Comppnyrs new plant location,and take proper action on a proposed annexation to the city of Fayetteville, and that all members of the Council had been notified by U.S. Mail and by telephone, but Alderman Wheeler was unable tb attend due to illness but waived notice of the special meeting. WAIVER OF NOTIUE OF SPECIAL 14EETING OF FAYETTEVILLE CITY COUNCIL Comes now the undersigned, being a duly elected, qualified, and acting member of the City Council of the City, of Fayetteville, Arkansas, and specifically waives notice of a special meeting of the Fay- etteville City Council to be held in the City Council Room of the City Administration Building, Fay- etteville, Arkansas, at 12:00 o'clock noon, on Wednesday, Octo 2, 1963. Dated this 2nd day of October, 1963.,x% The City Attorney introduced a propsed resolution authorizing the Mayor to sign necessary papers of the Federal Offer and Acceptanbe tp complete the Sewer mains at the Campbell Soup new location. 'Alderman Thomas moved that the resolution be adopted. The motion was seconded by Alderman Chrisite and passed unanimously whereupon the Mayor declared the resolution be adopted. RESOLUTION N0. 15-63 Resolution WHEREAS, the City Council of the City of Fayetteville, Arkansas, has authorized a program of �No. 15-63 construction of sewerage works at ans estimated cost of $87,000.00, and the United States Government, Sewer Mains acting through the Public Health Service, has offered a Federal Grant in the amount of $26,100.00 as designated on Part A, Offer and Acceptanbe, now under consideration by bias body. NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Fayetteville, Arkansas, that said offer as anbmitted, together with the terms avid conditions thereof, is hereby accepted and approved; and that Gty E. Brown, Mayor of the City of Fayetteville, Arkansas, is hereby authorized and directed to sign said Offer and Acceptance and any other necessary documents required to complete the project on behlaf of haidCCity. BE IT FURTHER RESOLVED that the City of Fayetteville, Arkansas, has or will procure a fee simple or such other estate or interest in the site of the project, including the necessary easements and rights of way, as to assure undisturbed use and possession for the'purposes of construction, operation and m maintenance of the works for the estimated iffe of the project; and that in the event such title, eas estate, or interest in such site,.easements or rights of dray may in the future be contested,'the City of Fayetteville, Arkansas, will defend and maintain its title in such site and hold the United States Government blameleessin such action; and that before any Federal payment is requested pursaafit to said grant, said City will provide certification as to the sufficiency of such estate of interest. ROWN, 'MAYOR GEORGE IS, CITY CLERK The Mayor presented a map of territory proposed to be annexed to the city of Fayetteville, by a vote of the people at the general Election November 5, 1963. After a long discussion, the City Attorney introduced and at the request of the Council read a proposed ordinance in its entirety, for the first 1370 ce time entitled,"AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY1OF FAYETTEVILLE, ARKANSAS; THE QUESTION OF ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTICOUS TO THE PRESENT CORPORATE LIMITS OF rmexation THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURPOSES." Alderman Thomas moved that the rule be suspended and the ordinance placed on a'second reading. The motion was seconded by Alderman Short and upon roll call the following vote was recorded: "Aye?_, Heflin, Christie 21olat son, Thomas, Burgin, Faucette and Short. "Nay", none. Thereibeing seven "ayes"QNO no "nays", the Mayor declared the rule suspended and the ordinance placed on the second reading. The ordinance was then read for the second time. Alderman Burgin moved that the rule be suspended and that theordrd- inance be placed on the thrid andAfffagal reading. The motion was seconded by Alderman Heflin and upon roll call the follovring vote was recorded: "Aye", Heflin, Christie, Watson, Thomas, Burgin, Fauebtbe, and Short. "Nay", none. There being seven "ayes" and no "nays", the Mayor declared the motion passed. The Ordinance was then read"for the third and final time. The Mayor declared the ordinance open for discussion. There being seven "Ayes" and no "Nays", the Mayor declared the ordinance passed. ORDINANCE N0. 1370$ AN ORDINANCE SUBMITTING TO THE ELECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS, THE QUESTION OF ANNEXATION OF CERTAIN TERRITORY ADJACENT AND CONTIGUOUS TO THE PRESENT CORPORATE LIMITS OF THE CITY OF FAYETTEVILLE, ARKANSAS, AND FOR OTHER PURFOSES. WHEREAS, the present coporate limits of the City of Fayetteville, Arkansas, fail to include thickly populated areas adjacent and contiguous to the City of Fayetteville, Arkansas; and WHEREAS, service is now being rendered to some parte pf the territory by the City of Fayetteville, nsas, gratuitouslu; and 2.5 Cont. WHEREAS, the residents of the contiguous areas are without the benefit of police and fire pro- tection and are neing penalized on insurance rates by reason of the lack of adequate fire protection; WHEREAS, such contiguous areas are needed for the extension of streets, sewer, gas and water syst to supply places for abode and business; and for the extension of needed police regudAtions; and WHEREAS, such contiguous areas, 'if annexed, will unite with the presently established city limits to make up a homogenous city which will afford to its several parts the ordinaty benefits of local govern- ment; and WHEREAS, the City Council of the City of Fayetteville, Arkansas, is of the opinion that the quest: of annexing the territories hereinafter described should be submitted to the qualified electors of the City of Fayetteville, Arkansas, at its next annual election to be held on November 5th, 1963. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That there be submitted to the qualified effectors of the City of Fayetteville, Arkansas, at the nest annual election to be held on November 5th, 1963s the question of annexation of territory contiguous and adjacent to the present corporate limits of the City of Fayetteville, Arkansas, so as to annex to the present corporate limits of the City of Fayetteville, Arkansas, the following described territories, to -wit: Group A Tracts - All located in Township 16 North, Range 29 West of the Fifth Principal Meridian. 1. All of the South Halt (SJ) of the North Half (NJ) and all of the North Half (NJ) of the South Half (SD of Section 20, containing approximately 320 acres. 2. All of the South Half (SJ) of the North Half (NJ) and all of the North Half (NJ) of the South Hal& (SJ) and all of the West Half (WJ) of the North One -Fourth QJ) of Section 199 containing approximately 400 acres. Group B Tracts - All located in Township 16 North, Range 30 West of the Fifth Principal Meridian. 1. All of Section 1 not now within the corporate aiea of the City of Fayetteville, Arkansas, containing approximately 430 acres. 2. All of Section 2 not now t4ithin the corporate 8tea of the City of Fayetteville, Arkansas, containing approximately' 420 acres. 3; All of Section 11 not now within the corporate area of the City of Fayetteville, Arkansas, containing approximately 260 acres. 4. All'of the Southwest Quarter (S*) of the Northwest Quarter (NW�) and all of the Northwest Quarter (NA) of the Southwest Quarter of Section 12, containing approximately 80 acres. 5. All of the South Half (S#).'and all of the West One -Fourth (WJ) of the North Half (NJ) of Section 13, containing approximately 400 acres. 6. All of Section 14, containing approximately 640 acres. 7. All of Sedtion 15 not now within the'corporate area of the City of Fayetteville, Arkansas, containing approximately 90 acres. 8. All of the North Half (NJ) df the North Half (N2) of Section 24, containing approximately 160 acres. 9. All of the North Half of the Northeast Quarter (NE4) and all of the Northwest Quarter (NWA) and all of the North Half (NJ) of the Southwest Quarter (SWA) of Section 23, containing approximately 320 acres. 0. All of Section 22 not now within the corporate area of the City of Fayetteville. Arkansas, containing pproximately 500 acres. 1. All of the East One -Fourth (EA) of the South HAlf (SJ) of Section 21, containing approximately 80 Cres, 2. Group C Tracts - All located in Township 16 North^, Range 31 West of the Fifth Principal Meridian. 1. All of Section 24, except the North Half (N2) of the North Half (N2) and That part within the corporate area of the City and/or Town of Farmington, Arkansas containing approximately 380 acres. Group D Tradts - All located in Township 1I North, Range 30 West of the Fiftb Principal Meredian. 1. All of Section 36, except the West Half (W2) of the West Half (W2), containing approximMately 480 acres. 2. All of Section 35 not now within the corporate area of the City of Fayetteville, Arkansas, conta approximately 240 acres. 3. All of Section 34, containing approximately 640 acres. 4. .All of Section 33, containing approximately 640 acres. 5. All of the East Half (E2) of the West Half (W2) and all of the West Half (W2) of the East Half (ED of Section 25, containing 320 acres. 6. All of Section 26 not now withingthe corporate area of the City of Fayetteville, Arkansas, con- taining approximately 430 acres. 7. All of the Fast Half (E2) of Section 27, containing approximately 320 acnes. 8. All of Section 23 not now within the corporate area of the City and/or Town of Johnson, Arkansas, and not now within the corporate area of the City of Springdale, Arkansas, and not now within the corporate area of the City of Fayetteville, Arkansas, containing approximately -170 acres. 10. All of the Fast Half (E2) of the Southwest Quarter (SW4) and all of the West Half (W2) of the Southeast Quarter (SES) of Section 24, containing approximately 160 acres. The aggreggte acreage In all tracts in Groups A, B, C. and D, is 12,239 acres, or 19.15 square miles. SECTION 2. The ballot title shall appear as follows: "The,Aiuestion of Annexation of Certain Territory to the City of Fayetteville, Arkansas, For Annexation Against Annexation" SECTION 3. That in the event of the approval of said annexation by the qualified electors of the City of Fayetteville, Arkansas, as hereinabove provided for, that such steps be taken as are necessary to comply with the will of the people as expressed in said election. GMVIS, CITY CLERK Submit Alderman Short moved that the matter of the annexation of the territories described in Ordinance No. Annexation 1370 be submitted to the electors of Fayetteville, Arkansas, in the general election on Tuesday, Nov - to vote of ember 5, 1963. The motion was seconded by Alderman Burgin and passed unanimously. People There being no further business, Alderman Heflin moved to adjourn.' Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Attorney Bass Trumbo , City Engineer W.C. Smith, Assistant Chief of Police Elmo Ritchie, Rire Chief Burl Skelton, and Aldermen: Faucette, Christie, Watson, and Heflin. Absent: Aldermen Wheeler, Thomas, Burgin and Short. Quorum IThe Clerk reported there were four Aldermen present and four absent. Hence the required number of five Not Fresen for a majority were not present.
