principal and interest, evidenced by.said bonds, and relieved District No. 1 and District No. 3
of any and all obligations with reference thereto, and authorized and directed the Mayor, for and
on behalf of the City, to deliver allstid bonds and all interest coupons to McIlroy Bank,
Fayetteville, Arkansas, the Paying Agent designated by District No. 1 and District No. 3 for the
respective bond issues, for cancellation; and
WHEREAS, it was the irrevocable purpose and intent of the action authorized and directed by said
Resolution N6. 10=63 that the principal and interest of all the above described bonds of both
Districts be considered fully paid as if lawful money of the United States of America had been
received in exchange therefor, to the end and withthe result that the above described bonds of
bott! Districts be no longer.considered outstanding and unpaid; and
WHEREAS, the Mayor, acting pursuent tosaid Resolution No. 10-63, did deliver all of said
bonds and interest coupons to McIlroy Bank, as Paying Agent, for cancellation; and
WHEREAS, the McIlroy Bank, as Paying Agent, refused to cancel said bonds and returned
same to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVTLT23
ARKANSAS:
Section 1. That the Mayor be, and he is hereby, authorized and directed, for and
on behalf of the City, to surrender and deliver directly to District No. 1 all the outstanding'
bonds, being bonds Nos. 55 and 86, and all interest coupons of District No. 1 for cancellation,
and to deliver to District No. lean appropriate writing evidencing the renouncing of all rights
of the City to siid bonds and interest coupons and forever discharging District No. 1 from any
obligations thereunder.
SECTION P. That the Mayor be, and he is hereby, authorized and directed, for and
on behalf of the City, to surrender and deliver d irectly to DLstrict No. 3 the outstanding b ond,
being bond NQ. 90, and all interest coupons of District No. 3 for cancellation, and to
deliver to District No. 3 an appropriate witing evidencing the renouncing of all rights of the
City to said bond and interest coupons and forever discharging District No. 3 from any obligations
thereunder.
Section 3. That the public health, safety andwelfare of all citizens and water
users of the City require that the Water Department beoperated as economically as possible, and
that only peoper and legal expenditures be made in order to insure the availability of sufficient
funds f or adequate mterservice upon as economical a basis as possible. Inasmuch as the action
takentythis resolution is necessary to accomplishment of the above specified public purposes,
an emergency is hereby declared to exist, and this resolution shall take effect and be in force
from and after its passage.

WHEREAS, the County Court of Washington County, Arkansas, did on June 26, 1963, make an

order annexing the following described territory to the City of Fayettevgle, Arkansas, to -wit:
SW4 lying South of Highway 45 East, all in Section

scribed as follows: Beginning at the Northwest corner of said forty acre tract, and running thence
South 210 feet, thence Fast 210 feet, thence North 210 feet, thence West 210 feet to the place of
beginning; containing in the aggregate 21 acres, more or less.

WHEREAS, the County Clerk of Washington County, Arkansas, has forwarded a transcript of said
proceedings to the City Council of the City of Fayetteville, Arkansas, and
WHEREAS, more than thirty days have elapsed since the date of said order and no proceeding
has been instituted in the Circuit Court to prevent said annexation and no notice thereof has been
given as required by law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS:
SECTION 1. That the Annexation of the above-described territory to the Corporate Limits
of the City of Fayettlaville, Arkansas, be and the same is hereby,accepted and all of said territory
is hereby assigned to and nade a part of Ward 4 of the City of Fayetteville, Arkansas.
SECTION 2. This ordinance shall be in full force and effect from the after its passage,
approval and publication.

The Building Inspector presented a final plat for a proposed sub -division to be known as South Sunny
Acres Sub -division, which has been approved by the planning commision on one condition that the sub-
divider, Mr. Johnnie Bassett, dedicate a 60 foot strip for a. street purposes. After a brief dis-
cussion, the City Attorney introduced and at the request of the Council, read a proposed ordinance
-its entirety entitled, "AN ORDINANCE TO ACCEPT AND CONFIRM THE DEDICATION OF ALL STREETS, ALLEYS,
AND EASEMENTS IPJ THE SOUTH SUNNY ACRES ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS."
Alderman Thomas then moved that the ordinance pass on conditions as approved by the Planning Commisicn.
The motion was seconded by Alderman Wheeler and passed unanimously whereupon, the MaYor declared the
ordinance passed.

WHEREAS, there has been duly presented to the City Council of the City of Fayetteville,
Arkansas, a plat dated April, 1963, known as the South Sunny Acres Addition to the City of Fayetteville,
Arkansas which is a part of the south half (Sj) of the Northwest -quarter (NWS) of the Southwest quarter
(SW�) of StetiontB&ieT'bwnsh4.o.1-6(Nor•h,,[Rgnee 30 West of the 5th Principal Meridian, more parti-
cularly described as follows: Beginning at a point 330.0 feet North of the Southeast Corner of said

The Mayor reported that the purpose of the meeting was to discuss the contract for Suburban Water
District No. 7 (Elkins) with representatives of the district and that all members of the Council had_
been notified by U.S. mail and by telephone.
A long discussion was held by the representatives for the Elkins Suburban Water District, all members
of the Council, the Water Superintendent, W. C. Smith; and the City dontroller, Albert J. Jones, but
no further action was taken at this time.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVI=1 ARKANSAS.
SECTION 1. It shall be unlawful for any persons, firm or corporation, to park any vehicle
of any kind whatsoever on the following described streets as hereinafter provided: (a) on the west
side of Whitham Street from Maple to Cleveland Street (b) on the west side of Lindell Street, bettaeen
Maple Street and Cleveland Street;T(rco on the south side of Reagan Street, between Arkansas Avenue and
Gregg Street (e) on Ozark Street from Fairview Street to Buchanan Street., E
SECTION 2., Any persons violating Section 1 of this Ordinance shall be deemed guilty of a
middemeanor, and upon conviction shall be fined in the sum of not less thah $1.00 and not more than
$25,00.
