No. streets, alleys, and easements, dedicated in Valley Vista Subdivision to the City of Fayetteville, 1360 Arkansas, and hereby declares said streets, alleys, and easements to be public streets, alleys, and Cont. easements, and the said City Council hereby assumes the care, control and jurisdiction of the same. SECTION 2. That this Ordinance shall be in force and effect from and after its passage, approval, and publication. PASSED AND APPROVED this 8th day of July, 1963. The minutes of the regular meeting on Monday, July 8, 1963, a copy of which had previously been mailed to each of the Aldermen, were approved as written. The Building Inspector presented a proposed street easement from Mr. Leonard Gabbard, St. Easement After- a brief discussion, Alderman Christie moved to accept the street easement from Mr. Gabbard and that accepted. the Building Inspector be instructed to issue the Building Permit to Mr. Gabbard as requested. (U�abbard ) The motion was seconded by Alderman Faucette and passed unanimously. Alderman Short read a letter from the Retail Merchants Parking Association requesting that a study be mad by the Council in regard to issuing monthly parking permits on Off=Street Parking Lots-. Letter Read After a long discussion, Alderman Short moved to refer this to a special committee con,sistrfng'of from Parking Alderman Wzatson and Heflin, Chief of Police Hollis Spencer, and City Controller Albert J. '"+4 '1 The City Controller reported that he had been studying the ordinances of the City and he recommended that the City Attorney be instructed to write several Codifying Companies relative to having the City Ordinanc horize Codified. y AttorneyAlderman Thomas moved to accept the recommendation of the City Controller and that the City Attorney be write lauthorized and diredied to submittthe information to the various Codifying Companies -for their proposals hying on the codification of the City Ordinances of Fayetteville, Arkansas. The motion was seconded by Alderman Burgin and passed unanimously. Alderman Short introduced and read a proposed resolution dealing with the outstanding bonds o$c Fayetteville Surburban Water Districts No. 1 and 3'. After a brief discussion, Alderman Short moved that the resolution be adopted. The moution was seconded by Alderman Burgin and upon rollcall the following vote was recorded: °Aye". Christie, Watson, Wheeler, Thomas, Burgin, Faucette, and Short. "Nay" None. There being seven "Ayes" and no "Nays", the Mayor declared the Resolution adopted. Alderman Short then moved thatthe emergency clause be adopted. The motion was seconded by Alderman Faucette and upon rollcall the foll6wing vote was recorded: "Aye" Christie,Watson, Wheeler, Thomas Burgin, Faucette, and Short. "Nay" None. There being seven "Ayes" and no "Nays", the Mayor declared the Emergency C3ansedadepted, RESOLUTION N0. 13-63 tiJHERLAS, on the 27th day of May, 1963, the City Obuncil (hereafter sometimes referred to as . "Council") of the City of Fayetteville, Arkansas (hereafter sometimes referred to as "City") duly adopted Resolution N9. 10-63, such resolution providing that the City, as owner and holder of all the outstanding bonds of Fayetteville Suburban 'dater District No. 1 of iv`ishington County, Arkansas (hereafter sometimes referred to as "District No. 111), and as owner anddlolder of all the outstanding bonds of Fayetteville Suburban Water District No. 3 of Washington (brunty, Arkansas, hereafter sometimes referred to as "District No. 3") by such resblution did forgive, cancol and terminate the indebtedness, Regular Session 2411 principal and interest, evidenced by.said bonds, and relieved District No. 1 and District No. 3 of any and all obligations with reference thereto, and authorized and directed the Mayor, for and on behalf of the City, to deliver all mid bonds and all interest coupons to McIlroy Bank, Fayetteville, Arkansas, the Paying Agent designated by District No. 1 and District No. 3 for the respective bond issues, for cancellation; and WHEREAS, it was the irrevocable purpose and intent of the action authorized and directed by said Resolution ft. 10163 that the principal and interest of all the above described bonds of both Districts be considered fully paid as if lawful moneyof the United States of Emerica had b een received in exchange therefor, to the end and withthe result that the above described bonds of bothDistricts be no longer considered outstanding and unpaid; and WHEREAS, the Mayor, acting pursuent tosaid Resolution No. 10-63, did deliver all of said bonds and interest coupons to McIlroy Bank, as Paying Agent, for cancellation; and WHEREAS, the McIlroy Bank, as Paying Agent, refused to cancel said bonds and returned same to the City; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVTLLE, ARKANSAS: Section 1. That the Mayor be, and he is hereby, authorized and directed, for and on behalf of the City, to surrender and deliver directly to District No. 1 all the outstanding' bonds, being bonds Nos. 55 and 86, and all interest coupons of District No. 1 for cancellation, and to deliver to District No. lean appropriate writing evidencing the renouncing of all rights of the City to said bonds and interest coupons and forever discharging Mstrict No. 1 from any obligations thereunder. SECTION 2. That t he Mayor be, and he is hereby, authorized and directed, f or and ' on behalf of the City, to surrender and deliver directly to District No. 3 the outstanding bond, being bond N0. 90, and all interest coupons of District No. 3 for cancellation, and to deliver to District No. 3 an appropriatevriting evidencing the renouncing of all rights of the City to said bond and interest coupons and forever discharging District No. 3 from any obligations thereunder. Section 3. That the public health, safety andvelfare of all citizens and water users of the City require that the Water Department beoperated as economically as rossible, and that only peoper and legal expenditures be made in order to insure the availability of sufficient funds f or adequate vater service upon as economical a basis as possible. Inasmuch as the action takentythis resolution is necessary to accomplishment of the above specified public purposes, an emergency is hereby declared to exist, and this resolution shall take effect and be in force from and after its passage. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Albert J. Jones, City Engineer W. C. Smitb, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Christie, Watson, Wheeler, Thomas, Burgin, Faucette, and Short. Absent: None. The City Attorney introduced and at the request of the Council, read a proposed ordinance in its entirety entitled, "AN ORDINANCE ACCEPT?NG TERRITORY AN1VE}CED TO THE CITY OF FAYETTEVILLE, ARKANSAS: ASSIGNING SAID TERRITORY TO WARDS, AND FOR OTHER PURPOSES." Aldermen Burgin then moved that the ordinance pass. The motion was seconded by Alderman Chrisite and passed unanimously, whereupon the Mayor declared the ordinance passed. ORDINANCE N0. 1361
