Stations The motion was seconded by Alderman Heflin and upon roll call the following vote was recorded "Aye" Heflin, Christie, Thomas, Burgin, Faucette, and Short. "Nay" Wheeler. There being six "Ayes" and only "Nay' the Mayor declared the motion passed. M. in the Council Room in the City Administration Building. Present: Mayor Guy E. Brown, City Clerk George J. Davis, City Controller Alber6•J. Jones, City Attorney Bass Trumbo, City Engineer W. C. Smith, Chief of Police Hollis Spencer, Fire Chief Burl Skelton, and Aldermen: Heflin, Watson, Wheeler, Thomas, Burgin, and Faucette. Absent: Aldermen Christie and Short. Putman appeared before the Council in behalf of R. W. Dearing and Jerry Watson, who had filed an application with the City Clerk for a franchise for a Taxi -cab Company (new). After a long discussion, Alderman Burgin moved to grant a franchise to R. W. Dearing and Jerry Watson for a taxi -cab service and that the Mayor and City Clerk be and they are hereby authorized to execute the necessary documents for the franchise. , The motion was seconded by Alderman Wheeler and upon roll call the following vote was recorded,"Aye" Heflin, Watson, Wheeler, Thomas, and Burgin. "Nay" None. "Abstaining" Faucette. There being five "Ayes", no "Nays" and only one"Abstaining", with two Aldermen absent, the Mayor declared the motion passed as there was a majority of all the Aldermen voted "Aye". Alderman Faucette read a letter from Attorney J. W. Murphy, Chairman of the Civil Service Commissfion of Fayetteville, Arkansas, in which he stated the Civil Service Commission had recommended that the City Council create the position of Assistant Chief of Police, as provided in the Budget for.the year of 1963, and that they had further recommended that City Patrolman Elmo Ritbhiebe appointed to this position. Alderman Faucette then moved to accept the recommendation of the Civil Service Commission and create the position of Assistant Chief of Police and to appoint Patrolman Elmo Ritchie to that position. The motion was seconded by Alderman Wheeler and passed unanimously. The Mayor reported that it was necessary for the Council to set a time limit for the construction of the new Police Station and the Central Fire Station which would also be agreeable with the contractors. After a brief discussion, Alderman Burgin moved that a time limit of 240 days(CalendW) would be allowed for the Police Station and 270 Calendar days for the Central Fire Station. The motion was seconded by Alderman Thomas and passed unanimously. The City Attorney introduced and at the request of the Council read a proposed ordinance in its entirety for the first time entitled,"AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURPOSES IN THE CITY OF FAYETTEVILLE, ARKANSAS". Alderman Burgin moved that the rule be suspended and the Ordinance be placed on a second reading. The motion was seconded by Alderman Wheeler and passed unanimously. The ordinance was then read for the second time. Alderman Burgin moved that the rule be further suspended and the Ordinance be placedon the third and final reading. The motion was seconded by Alderman Faucette and passed unanimously. The Ordinance was then read for the third and last time. The Mayor then declared the Ordinance open for discussion. There being no discussion, the Yayor asked the question, "Shall the Ordinance pass?" Upon roll call the following vote was recorded: "Aye" Heflin, Watson, Wheeler, Thomas, Burgin, and Faucette. "Nay" none. There being six "Ayes" and no "Nays" the Mayor declared the Ordinance passed. ORDINANCE N0, 1349 AN ORDINANCE ACCEPTING THE DEDICATION OF CERTAIN REAL ESTATE FOR STREET PURPOSES IN THE CITY OF ARKANSAS BE IT ORDAINED BY THE CITY.COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. That the City Council hereby accepts the dedicatioh of the following described property for street purposes, to -wit: Forty (40) feet of equal and uniform width off the North side of a tract described as a part of the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 3, Township 16 North, Range 30 and more particularljr. described as beginning at a point 490 feet and 10 inches East of the Southwest corner of said forty -acre tract, and running thence East 224 feet to the West side of U.S. Highway No. (concrete rodd); thence in a Northeasterly direction along the West side of said Highway a distance of 213 feet; thence West 246 feet to the East side of the Old State Highway No. 71; thence in a Southeast direction with East side of Old Highway a distance of 213 feet to the place of beginning. The minutes of the regular meeting on Monday, April 22, 1963, and of --the special meetings (3)on Thursday, April 25, 1963, Tuesday, April 30, 1963, and Thursday, May 92 19639.copies of which had previously been mailed to each of the Aldermen, were approved as written. After a long discussion on the petition to vacate and abandon that portion of Edgewooll Street lying west 01.44 of Gregg Avenue and north of Prospect Street, Alderman Thomas moved to refer the petition,"to the Street Committee for study and recommendation.! The motion was seconded by Alderman Wheeler and passed unanimously. Absent: None, Alderman Christie reported that -the Street Committee had recommended the -vacating and abandoning that portion of Edgew6od Street lying West of Gregg Avenue and north of Prospect'Street, as requested in the petition of F. F. Stice and Charlotte A. Stice, his wife, and Lois M. Cunningham, which was filed in the City Clerks Office'on the 29th day of March, 1963, and on which said petition a public hearing was held on Monday, April 22, 1963, there being,no opposition to the vacating of said street. The City Clerk presented letters from the three utility companies, VZ,Arkansas Western Gas Co., Southwestern Electric Power Co., and the Southwestern Bell Telephone Co, stating they had no opposition to the vacating of said street. .' The City Attorney then introduced,and at the request of the Council,•read a proposed ordinance in its entirety entitled; "AN ORDINANCE VACATING AND ABANDONING EDGEWOOD STREET LYING WEST OF GREGG AVENUE AND NORTH OF PROSPECT STREET, IN THE MITCHELL ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS". Alderman Thomas moved that the ordinance pass. The motion was seconded by Alderman Faucette and passed unanimously, whereupon the Mayor declared the Ordinance passed. ORDINANCE N0. 1350 AN ORDINANCE VACATING AND ABANDONING EDGSIOOD STREET LYING WEST OF GREGG AVENUE AND NORTH OF PROSPECT STREET, IN THE MITCHELL ADDITION TO THE CITY OF FAYETTEVILLE, ARKANSAS WHEREAS, a petition was duly filed with the City Council of the City of Fayetteville, Arkansas, on the 29th day of March, 1963, by Lois M. Cunningham, F. F. Stice and Charlotte A. Sties, husband and wife, asking the City Council to vacate and abandon all of the street designatedias follows: All of Edgewood Street lying West of Gregg Avenue and North o£'Prospect Street, said street being situated in the.Michell Addition of the City of Fayetteville, Arkansas, and WHEREAS, after due notice as required by law, the council has, at the'time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street; has not been actually used by the public generally for a period of at least five years subsequent to the filing of the plat; that all the owners of the property abutting upon the street to be vacated have filed with the Council their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAYETTEVILLE, ARKANSAS: SECTION 1. The City of Fayetteville, Arkansas, hereby releases, vachtes, and abandons all its rights, together with the rights of the public generally, In and to Edgewood Street lying West of Gregg Avenue and North of Prospect Street in the Mitchell Addition to.the City of'Fayetteville, Arkansas, reserving unto said City of Fayetteville, Arkansas, its successors and assigns, an easement or right-of-way on, over, under and across the South Twenty feet of said street hereby vacated for the purpose of constructi installing, laying, and relaying, relocating and maintaining all public utilities now located, or which may hereafter be located, upon said vacated street by said City or any corporation having a franchise or right-of-way from said City, without recourse by the owner, owners, or occupants for damages incurred by the construction or maintenance of said utilities. SECTION 2. A copy of the Ordinance duly certified by the City Clerk shall be filed in the Office of the Recorder of the County and recorded in the Deed Records of the County. SECTION 3.
